About this file

This document is a Questions and Answers (Q&A) file for a roofing repair contract (QUUG 25-1010 / FA557525B0016) at Moron Air Base in Spain. The Q&A addresses three key inquiries from a potential contractor registered in Italy: (1) eligibility for EU member state companies to participate, (2) acceptability of EU-based bank guarantees, and (3) storage requirements for materials and tools. The responses indicate that contractors must comply with Spanish legislation for government works, submit required documentation to the U.S. Office of Defense Cooperation for verification, and be responsible for securing their own storage area with a mobilization plan detailing storage location and safekeeping methods.

Questions and Answers for QUUG 25-1010 / FA557525B0016 – Repair Roofs for Multiple Buildings, Moron Air Base, Spain

1. Our company is officially registered in Italy. Could you please confirm whether being registered in another EU member state allows us to participate in this procurement, and if so, what additional documentation (if any) is required?

In accordance with the Agreement of Defense Cooperation between the U.S.A. and the Kingdom of Spain, Annex 6, article 1:”The contractors must meet the requirements established by Spanish legislation for execution of government works. Spanish material, labor, and equipment shall be used whenever feasible and consistent with the requirements of the United States, which are in accordance with the specifications of the contract contained in the invitations to bid issued by the United States authorities.”

If Spanish legislation says that other EU member states can perform work in Spain, you must submit the documents required by Spanish legislation and we would send to our Office of Defense Cooperation in the embassy for verification and approval.

2. Will bid security and performance guarantees issued by an EU-based bank (outside Spain) be acceptable, or must they be issued by a bank operating within Spain?

We believe any EU-based bank would be acceptable, but this would have to be verified by the Office of Defense Cooperation at the time of submission.

3. Will a closed, secure storage area be provided on-site for materials and tools, or should the contractor arrange their own off-site storage?

The successful contractor will be responsible for storing the necessary materials and tools.

Normally, the company awarded the contract must submit a mobilization plan, indicating the storage area, either on the construction site itself or in a nearby area that is available and authorized. The contractor will be responsible for the safekeeping of materials and tools using the means it deems appropriate, such as fencing, construction containers, etc.
