| Question # | Reference | Question | Response |
| 1 | EPA 402-R-93-078, Radon Mitigation Standards, Section 11.4; |
EPA RMS 2.0 (2021), Section 11.2;
NRPP Certification Guidance;
Previous DET 2 OL-B Response to 2024 Solicitation, Question #1. In the prior solicitation for this same scope of work, we submitted an RFI regarding the necessity of conducting Pressure Field Extension (PFE) tests, in accordance with EPA 402-R-93-078, Section 11.4. The Government's response at that time stated that a PFE test was not required for the project.
As a certified NRPP Radon Residential Mitigation Provider, we respectfully request clarification, especially considering that both EPA Radon Mitigation Standards (402-R-93-078) and EPA RMS 2.0 (2021) identify the PFE test as a fundamental tool in the proper design of sub-slab depressurization systems. Specifically, the RMS states:
“The purpose of the RMS is to provide radon mitigation contractors with uniform standards that will ensure quality and effectiveness in the design, installation, and evaluation of radon mitigation systems in detached and attached residential buildings three stories or less in height.”
In the absence of a PFE test, mitigation systems must be installed based on generalized assumptions, which may lead to ineffective or improperly balanced systems and may be construed as inconsistent with the standard of care expected under EPA guidance and NRPP practices. We are aware that no sub-slab permeability data has been provided to bidders, which further limits the ability to design compliant systems without site-specific diagnostics.
To that end, we respectfully request written clarification on the following:
1. Can the Government confirm whether PFE testing remains excluded from the project, despite its identification as a best practice under EPA and NRPP standards?
2. If excluded, will the Government assume responsibility for the potential variability in mitigation effectiveness that may arise from non-site-specific system designs?
3. Will bidders who include PFE testing in their proposal for compliance purposes be evaluated less favorably due to cost, despite aligning with EPA and NRPP guidance?
This clarification is important not only for technical accuracy and regulatory alignment, but also to ensure that all proposals are evaluated equitably and that no contractor is disadvantaged by including industry-standard diagnostic measures.
DET 2 OL-B: 1. Contractor shall comply with the SOW as written and follow the (REFERENCE: Use the most current Code, Regulations and Guidance as it applies: Especially follow Kadena Design Guide 07 Feb 2020 relating to this project. 2 SOW Section 2.1.f;
29 CFR 1910.146;
EM 385-1-1 (2024), Section 34;
Prior RFI Response (2024 Solicitation, DET 2 OL-B Response to Question #2). In the previous solicitation for this same project, we submitted an RFI citing that inspection beneath crawl spaces would likely constitute permit-required confined space (PRCS) entry per 29 CFR 1910.146 and EM 385-1-1. The Government responded affirmatively, instructing us to include confined space training costs in our proposal. Based on this response, we also included the cost of providing an Entry Attendant and Entry Supervisor, as required for PRCS operations.
However, the contract was awarded to a bidder that did not include or deploy any confined space attendants, raising concerns about regulatory compliance and unequal cost assumptions across proposals. Despite our previous inquiry, this issue remained unaddressed.
For this new solicitation, we therefore request a clear, written confirmation on the following:
1. Are all bidders required to include the cost of a qualified Confined Space Entry Attendant (one per entry point) and Entry Supervisor, as mandated by OSHA and EM 385-1-1 for PRCS work?
2. Will proposals be evaluated for compliance with these safety requirements?
3. In the event of omission, will such proposals be deemed non-responsive or technically unacceptable?
We submit this request to avoid a recurrence of what occurred in the last award cycle—where our compliance with stated safety requirements was penalized by a higher cost, while the selected contractor proceeded without those same safety controls.
We respectfully request written clarification to ensure fair competition and alignment with applicable federal safety regulations.
DET 2 OL-B: 1. Contractor shall comply with the SOW as written and follow the (REFERENCE: Use the most current Code, Regulations and Guidance as it applies: Especially follow Kadena Design Guide 07 Feb 2020 relating to this project. A completed Kadena Design Guide will be issued to award contractor for reference and guide.
2. Award contractor will be required to submit all required plans in compliance with the project ( Equipment, materials, HAZMAT, HAZWASTE, EPP, Safety, APP, etc) for review and approve prior start of work.

16. All bidders must comply with 29 CFR 1910.146 and EM 385-1-1 (standard safety protocol) during performing work. When working underneath the crawl space all workers must be trained and certifed for Confine Space entry. Government will not dictate how many workers. This is for the contractor to decided. 17. Safety is always part the proposal - award contractor will need to submit safety plan for approval prior start of work.
18. All bidders shall comply with SOW Page 22, REFERENCE: Use the most current Code, Regulations and Guidance as it applies: 19. Government policy is all safety need to be follow to protect general public, workers, facility and the environment.
3 SOW Section 2.1.g;
NFPA 5000: Building Construction and Safety Code;
Prior DET 2 OL-B Response to Question #6 (2024 Solicitation). In response to our previous RFI regarding NFPA 5000 compliance, the Government confirmed that “all electrical work shall comply with NFPA 5000.” Based on this, we included in our bid the cost of compliant firestopping systems, particularly around penetrations through fire-rated and non-fire-rated assemblies, as required under Chapter 49 and Chapter 55 of NFPA 5000. These code-based measures ensure that utility penetrations (e.g., for vents, fans, or electrical raceways) maintain the required level of passive fire protection.
We respectfully request clarification on the following points:
1. Will the Government require bidders to explicitly identify how their proposed installation methods comply with NFPA 5000 requirements?
2. What mechanism or process will the Government use to confirm post-award compliance with NFPA 5000, particularly regarding the use of tested and listed firestop systems at all penetrations?
3. Were contractors in the prior award cycle required to submit documentation (e.g., submittals, cut sheets, UL listings) for firestopping assemblies used? If not, how was code compliance verified?
This clarification is essential to ensure that all bidders incorporate equivalent code-compliant measures in their pricing, and that no bidder is competitively advantaged by excluding required life-safety provisions. It also helps ensure the awarded system satisfies the Government’s stated intent to comply with NFPA 5000.
DET 2 OL-B: 1. Contractor shall comply with the SOW as written and follow the (REFERENCE: Use the most current Code, Regulations and Guidance as it applies: Especially follow Kadena Design Guide 07 Feb 2020 relating to this project. | 4 | EM 385-1-1 (2024), Section 22-3.(2);
| Prior DET 2 OL-B Response to Question #7 (2024 Solicitation). | In response to our previous RFI, the Government confirmed that scaffold work under this contract must comply with EM 385-1-1 (2024), Section 22-3.(2), which requires that employees receive training specific to the type of scaffold used, provided by a qualified person, and tailored to the hazards involved. In preparing our bid, we included the full cost of this training, including delivery in Japanese language, as required for local crews, and conducted by a qualified instructor familiar with EM 385 protocols. |
However, given the extremely limited number of providers in Japan—and especially in Okinawa—offering such EM 385-compliant scaffold training in Japanese, we respectfully seek clarification on the following:
1. What verification process does the Government have in place to ensure that awarded contractors comply with this scaffold training requirement?
2. Are contractors required to submit training records, curriculum details, or instructor qualifications for scaffold-related training in accordance with EM 385-1-1?
3. In the prior project award cycle, were such documents requested, reviewed, or approved by the Government to confirm training was completed as required?
We raise this issue because full compliance with EM 385 scaffold training incurs measurable costs and scheduling considerations. If some bidders included this cost in good faith and others did not, this could result in an unfair competitive advantage for non-compliant bids and undermine the safety intent of the regulation.
We respectfully request written confirmation that the Government will ensure this requirement is enforced equally across all contractors for this solicitation.
DET 2 OL-B: 1. Contractor shall comply with the SOW as written and follow the (REFERENCE: Use the most current Code, Regulations and Guidance as it applies: Especially follow Kadena Design Guide 07 Feb 2020 relating to this project. | 5 | EM 385-1-1 (2024), Section 22-4.1.(1) and Section 22-3.b;
| Prior DET 2 OL-B Response to Question #8 (2024 Solicitation). | In the previous round of this solicitation, the Government responded that contractors must comply with EM 385-1-1 (2024), Section 22-4.1.(1), which requires a Competent Person (CP) to supervise scaffold erection, use, and dismantling, and that such costs should be included in our estimate. |
Accordingly, we included in our proposal the assignment of a designated Scaffold Competent Person, meeting the qualifications outlined in Section 22-3.b, including verified training and relevant experience in the type of scaffold used.
However, based on multiple site visits during the previous performance period, we observed no visible presence of any designated CP during scaffold operations, nor did we see evidence of CP-led inspections, oversight, or corrective action. While we acknowledge that we cannot verify all work schedules or shifts, this absence raises concern that not all contractors may be including or implementing this requirement as specified.
To ensure fairness and compliance in this solicitation, we respectfully request clarification on the following:
1. Will bidders be required to submit the name and qualifications of their designated Scaffold Competent Person (CP) as part of their proposal or post-award documentation?
2. Will the Government review contractor CP qualifications or verify on-site presence during scaffold activities through logs, daily reports, or visual inspection?
3. What measures are in place to confirm ongoing CP oversight during scaffold erection, use, and dismantling, in accordance with EM 385-1-1?
This confirmation is critical, as assigning a qualified CP is not only a safety requirement, but also a significant cost consideration. Ensuring all bidders address this equally avoids an unintentional competitive disadvantage for those who comply in good faith.

6 EM 385-1-1 (2024), Section 21 “Aerial Lifts and Elevating Work Platforms”;
OSHA 29 CFR 1926 Subpart L;
Prior DET 2 OL-B Response to Question #9 (2024 Solicitation). In response to our prior RFI, the Government confirmed that aerial lift operations under this contract are subject to the requirements of EM 385-1-1 (2024), Section 21, and OSHA 29 CFR 1926 Subpart L, including the requirement for oversight by a Competent Person (CP) trained and experienced in aerial lift operations.
Accordingly, we included the cost of assigning a designated Aerial Lift CP in our proposal, as the CP role involves direct oversight of daily inspections, safe operation practices, and hazard recognition for this equipment. These oversight and documentation requirements carry staffing and cost implications that we considered essential for full compliance.
However, during several site visits conducted during the prior performance period, we did not observe any individual visibly fulfilling the role of an Aerial Lift CP, nor did we witness documentation of required daily inspections or CP-led safety checks. While we recognize that our observations may not represent the full duration of operations, the apparent absence of CP activity raises concern regarding consistent enforcement of this requirement across contractors.
We respectfully request the following clarifications:
1. Will all bidders be required to designate and document a qualified Aerial Lift CP in their staffing plan or submittals?
2. Will the Government require the submission of daily inspection logs and CP documentation to confirm ongoing compliance with EM 385-1-1 §21 and OSHA aerial lift requirements?
3. What verification or enforcement measures does the Government have in place to ensure that CP oversight is actually implemented during field operations?
This clarification is necessary to ensure both safety and fairness in the bidding process. Failure to uniformly apply and verify these requirements could result in cost advantages for non-compliant bidders and increase operational risk on-site.

7 SOW Section 1.6, Table 1.11;
UFGS 02 82 13 “Asbestos Abatement”;
UFGS 02 83 00 “Lead Remediation”;
UFGS 02 83 00, Subsection 1.2.20. In the previous solicitation, we submitted an RFI noting that while UFGS 02 82 13 was referenced for asbestos abatement, UFGS 02 83 00 (Lead Remediation) was not referenced, despite the presence of paint coatings with detectable levels of lead.
The Government’s response at that time stated that past LBP testing showed “negative” results (i.e., <0.5% by weight) and therefore concluded that lead abatement was not required. However, this response appears to conflate Lead-Based Paint (LBP) with Paint with Lead (PWL)—two separate classifications under UFGS 02 83 00:
"Paint with Lead (PWL) is any material, including paint, which contains lead as determined by the testing laboratory using a valid test method."
(UFGS 02 83 00, Section 1.2.20) PWL does not require ≥0.5% lead by weight to be subject to control measures. While it may not trigger LBP abatement under EPA/HUD residential thresholds, it still requires protective handling, work practices, and waste management under UFGS 02 83 00 and EM 385-1-1—especially in DoD and construction settings involving paint disturbance (e.g., drilling, sanding, scraping, demolition).
In the previous award cycle, numerous painted surfaces were classified as PWL, but the omission of UFGS 02 83 00 left ambiguity regarding how contractors were expected to handle this material. We included controls in our bid, but we are unsure whether others did, or whether enforcement was consistent.
Accordingly, we respectfully request clarification on the following:
1. Does the Government acknowledge that materials classified as PWL—but not meeting the 0.5% LBP threshold—are still subject to protective work practices under UFGS 02 83 00 and EM 385-1-1?
2. Will contractors be required to include protective measures (e.g., containment, PPE, worker hygiene, waste handling) for PWL materials as part of their bid, even if full LBP abatement is not triggered?
3. If UFGS 02 83 00 remains excluded, under what specification should PWL handling requirements be enforced?
4. Will cost and compliance disparities between bidders who include proper handling of PWL and those who do not be evaluated for fairness?
This clarification is essential for regulatory alignment and to ensure that no bidder is unfairly advantaged by disregarding protective measures clearly required by DoD standards for materials containing any detectable lead.

ASHRAE 62.2, ASHRAE 189.1;
EPA RMS 2.0 (2021). The SOW references various standards that may relate to ventilation and airflow performance for radon mitigation systems, but does not clearly define which provisions apply to the design, installation, or verification of the ventilation components to be integrated into occupied family housing.
To ensure consistency of interpretation and system performance, we respectfully request clarification on the following:
1. Which specific standards or performance benchmarks apply to the ventilation components of the radon mitigation system (e.g., ASHRAE 62.2, ASHRAE 189.1, EPA RMS 2.0)?
2. Are minimum airflow rates or pressure differentials specified for depressurization or dilution systems, and how should these be measured or validated?
3. What ducting materials, sealing practices, and integration methods are permitted when connecting to existing HVAC systems in occupied units?
4. Are there requirements for maintaining occupant comfort and noise levels, particularly where mitigation fans or ventilation devices are located near bedrooms or living areas?
Clarifying these design and integration criteria will help ensure that all bidders propose systems that are not only technically effective, but also maintain safety, comfort, and long-term IAQ performance in family housing.
