DIVISION 01 - GENERAL REQUIREMENTS

SECTION 01 01 00

GENERAL REQUIREMENTS

PART 1 - GENERAL

This section applies to all divisions of these specifications except as specified otherwise in each Individual Division.

1.01 STATEMENT OF WORK: This project is to construct 202.82 SM (2,183 SF) of reinforced concrete building for new Medical Administration Annex facility adjacent to Vet Clinic, B-731. The facility consist of three (3) standard offices, one (1) large open administration office, male and female restroom, one (1) lounge/conference room with kitchenette and cabinet, three (3) storage rooms (for office supply, perishable products, and janitor closet), one (1) communication room, and one (1) mechanical room. The incidental works includes, but not limited to, clearing and grubbing of affected existing trees and vegetation, demolition of affected existing structure, site preparation, provision of new utilities connection; provision of interior and exterior painting, acoustical ceiling, fixtures such as doors and windows, and interior finishes; provision of new three-phase pad-mounted transformer, interior lighting system, interior and exterior electrical distribution systems, telecommunication system, and fire alarm system; provision of HVAC and plumbing systems, and Testing, Adjusting, and Balancing of HVAC system.

1.02 PROJECT ENGINEER QUALIFICATIONS: The Contractor shall appoint a 1st Grade Architect with professional registration and 5 years minimum experience or 1st Class Kenchiku Sekou Kanri Gishi license, Electrical Engineer – Graduate Electrical Engineer with professional registration and 5 years minimum experience or Class 3 Denki Gijutsusha license, Mechanical Engineer – Graduate Mechanical Engineer with professional registration and 5 years minimum experience or Kenchiku Setsubishi license.

1.03 WORKMANSHIP:

A. Materials shall be installed in accordance with the approved recommendations of the manufacturer. The installation shall be accomplished by workmen skilled in this type of work.

B. Sufficient precautions shall be taken during construction to protect all personnel from injury and to prevent damage of the U.S. Government owned materials and equipment. The Contractor damaged U.S. Government properties caused by this project shall be replaced with new materials or equipment without additional cost to the Government. The work shall proceed in such a manner as to minimize the spread of dust.

C. Demolition: Material shall be removed carefully so as not to damage to existing material.

Sufficient safety precautions shall be taken to protect all personnel from injury. All unsalvageable items or items to be removed shall be disposed of off base by the Contractor in an approved dumping area in accordance with the local law at no additional cost to the U.S. Government. Contractor shall block, patch, paint and restore all damaged surfaces as a result of work under this contract to match new and/or existing adjacent surfaces.

1.04 DELIVERY AND STORAGE: Materials shall be properly stored and adequately protected and carefully handled to prevent damage before and during installation. Materials shall be handled, stored, and protected in accordance with the manufacturer’s recommendations and as approved by the Contracting Officer. Damaged or defective materials shall be replaced with new materials at no cost to the U.S. Government.

1.05 STANDARD PRODUCTS: Materials shall be essentially the standard catalogued products of manufacturers regularly engaged in production design that complies with the specification requirements.

Materials shall essentially duplicate items that have been in satisfactory commercial or industrial use at least two years prior to the date for receipt of proposals. Where two or more units of the same type and class are required these units shall be products of a single manufacturer.

1.06 DISPOSITION OF EXCESS CONTRACTOR-FURNISHED MATERIALS: The disposition of excess Contractor-furnished United States materials that have been exempt from Japanese Customs duties and taxes pursuant to Status of Forces Agreement (SOFA) shall be the Contractor’s responsibility.

If the U.S. Government and Contractor agree that the Contractor is to retain such excess materials, they shall be reported to the Prefectural Government Customs office authorities for payment of applicable duties and tax fees.

1.07 SUBMITTALS: See Attachment 2, AF Form 66 for the list of material submittals requirements. Contractor shall submit these material submittals to the Contracting Officer not later than 60 calendar days after receipt of Notice to Proceed. The time required for the Government review of each submittal is twenty-one (21) calendar days after receipt of the submittal. Details of submittal requirements will be found within the individual sections. All submittals shall be in English or provided with English translation.

1.08 AS-BUILT DRAWINGS: The Contractor shall provide the corrected contract drawings, indicating as-built conditions, Seven ( 7 ) calendar days after the final inspection. Provide Electronic copy (CDs) in AutoCAD and PDF. Contractor shall coordinate with 718 CES/CENME on format of electronic copy (CDs) prior to submittal.

A. In addition to the as-built drawings required in the paragraph above, provide floor plan, scale 1:40M, with dimensions in both metric and feet. Indicate room name/description and number in accordance with the contract drawings and room floor area in square metric and square feet. Do not indicate movable furniture and equipment.

1.09 INTERPRETER: The Contractor shall have an English speaking representative on the job site at all times during the performance of work under this contract. Failure to provide such representative could result in the Contractors work being stopped (at his/her expense) until such time as one is provided.

1.10 TROPICAL CYCLONE CONDITIONS OF READINESS (TCCOR): In order to protect people and U.S. Government property, the following actions will be taken upon declaration of Tropical Cyclone conditions and/or high wind warnings.

A. Tropical Cyclone Condition 3: When Condition 3 is declared, the Contractor will perform general area clean up which will exceed the requirements contained in contract clause 52.236-12 entitled Cleaning Up. All loose debris, waste and excess Contractor owned supplies, materials and equipment will be removed from U.S. Government facilities and disposed of off base in accordance with local Prefecture and Japanese laws at Contractor’s expense. Work may continue provided effective and adequate clean up has been accomplished.

B. Tropical Cyclone Condition 2: When Condition 2 is declared, all exterior work will cease immediately and interior work will be continued until Condition 1C is given. The Contractor will take the necessary action listed below to secure the job site against damages which may result from anticipated weather conditions. The Contractor may be called at any time to complete tropical typhoonization;

therefore, he will provide emergency telephone numbers and/or addresses where at least three (3) officials of the company may be reached and notified that immediate typhoonization (Contractor activities to safeguard lives and proterty taker upon declaration of tropical cyclone conditions or high winds) is necessary.

1. General Area Clean Up: Clean up and disposal of loose debris and waste will continue as directed by Paragraph 1.10.A.

2. Barrels and Similar Containers: All remaining barrels will be placed within the construction building when available. When a building is not available, barrels will be tied together and securely staked to the ground or filled with sand or gravel.

3. Contractor Field Office: All Contractor field offices will be either (i) removed from the military installation or (ii) securely anchored by heavy cable as approved by the Base Civil Engineering representative.

4. Concrete Forms, Form Supports, and Accessory Materials: All concrete forms, form supports, and accessory materials required for future construction will be tied together into bundles with heavy wire, cable or rope and will be placed within the construction building or structures where available and practical.

5. Sand and Aggregate: All piles of sand or aggregate will be completely covered by either a tarpaulin weighted with building blocks or other methods approved by the Base Civil Engineering representative.

6. Contractor Equipment: All medium size equipment will be removed, or placed close to a building or placed inside a building. Equipment placed close to a building will be secured with blocks or anchored with cable or both. Items of small equipment will be moved inside a building and secured or moved off U.S. Government facilities.

C. Tropical Cyclone Condition 1: When Condition 1 is declared without the normal progression through Condition 3 and/or 2, the Contractor will take actions listed in Paragraph 1.10.B.1 through 6 above. These actions will commence immediately upon declaration of Condition 1. The Contractor will be notified either at the job site or at the emergency phone numbers and/or addresses when tropical typhoonization is required in accordance with this paragraph.

D. High Wind Warning: When wind gusts of 30 knots per hour or greater are forecasted, the Contractor may be required to accomplish general area clean up in accordance with Paragraph 1.10.B.2 to bundle and securely tie or securely cover and weight small wooden items, to remove and secure wooden barricades and to remove loose materials from roofs and other high unprotected areas.

E. Tropical Cyclone Condition 1Emergency (TC 1-E): All outside activities are prohibited.

F. TC-1 Recovery: Destructive sustained winds of 50 knots are no longer occurring. No outdoor activity is authorized other than workers from pre-designated emergency crews.

G. TC - Storm Watch: Normal activities may resume with caution two hours after declaration of

STORM WATCH.

H. Salvageable Material: Salvageable material may not be taken to Defense Reutilization and Marketing Office after a tropical cyclone condition is declared. The Contractor will be responsible for tropical typhoonization of such material.

I. Contractor’s Representative: The Contractor’s representative will not leave the job site after notification under Paragraphs 1.10.B, 1.10.C and 1.10.D above until the area has been inspected and cleared by a Base Civil Engineering representative. The Contractor may request an inspection by calling Chief, Construction Management, telephone number 634-2191.

1. The Contractor shall provide to the Contracting Officer the names, addresses, and telephone numbers of at least two individuals (who speak English) who can be contacted during typhoon emergencies.

2. The individuals named by the Contractor shall be responsible for monitoring the various forms of communications (i.e., local and AFN radio and television stations) during the typhoon season.

The Contractor is responsible for ensuring these individuals are available during and after duty hours - to include weekends.

J. If the Government has to perform typhoonization of a construction site or field office, due to the non-availability of the designated individuals, the Contractor may be held liable for all cost associated with performing said work. In addition, Contractor waives all claims to damage or loss that arise from governments actions.

1.11 WORKDAYS AND HOURS: The Contractor shall be allowed to work from 0800 to 1800 hours, Monday through Friday, excluding the following U.S. legal holidays:

When U.S. Government legal holidays occur on Saturday or Sunday, the preceding Friday or following Monday shall not be considered work days until changes in work schedules are approved by the Contracting Officer. No work will be allowed on Friday if the preceeding Thursday is a U.S. Government legal holiday. The Contractor is to account for this in his construction schedule and offer. Any deviations from the above shall be submitted in writing to the Contracting Officer for approval on a case-by-case basis.

1.12 WORK AREA: The Contractor’s personnel are restricted to the area of construction only.

Transiting of areas not in the contract is not permitted except as required in the performance of this contract. The contractor shall maintain the grass and pick up litter at the end of each working days within

the work area. The Contractor shall maintain the working area and its surroundings clean at all times.

Existing grass shall be maintained to minimize damage.

1.13 FINAL INSPECTION: Final inspection will be conducted during the period of Monday through Friday between 0800 and 1600 hours. The U.S. Government will perform the inspection within 72 hours after (a) written notification by the Contractor to the Contracting Officer or (b) the contract completion date whichever comes first. Final inspections falling due on weekends or U.S. legal holidays will be postponed to the following workday.

1.14 NOTIFICATION BEFORE STARTING ON-SITE WORK:

Base Buildings: The Contractor shall notify the Using Agency through Contracting Officer a minimum of fourteen (14) calendar days prior to starting on-site work.

A. Airfield: The Contractor shall notify the Contracting Officer and 18 OSS/OSAM a minimum of fourteen (14) calendar days prior to starting on-site work.

1.15 PREPARATION OF MATERIAL APPROVAL SUBMITTALS: The Contractor is responsible for the submission of all required submittals, whether or not they are listed on the Material Submittal list found in the contract specifications.

1.16 PREPARATION OF PROGRESS SCHEDULES AND REPORTS: The reports comtemplated by the clause FAR 52.236-15 (Apr 1984) 52herein entitled, “Schedule for Construction Contracts” shall be accomplished on and in accordance with instructions pertaining to AF Form 3064, Contract Progress Schedule and AF Form 3065, Contract Progress Report. The Contract Progress Schedule shall be submitted to the Contracting Officer within fourteen (14) calendar days prior to start of on-site work.

1.17 DRAWINGS AND SPECIFICATIONS AT THE SITE: The Contractor shall maintain in good condition at the site one copy of all drawings, specifications, addenda, modifications, approved shop drawings and other related documents affecting the work. Drawings and specifications shall be marked to record all changes during construction. These documents shall be made available to the COR during construction and shall be delivered to the Contracting Officer upon completion of the work.

1.18 MATERIALS ON-HAND PRIOR TO STARTING ON-SITE WORK: On-site construction shall not start until such time that sufficient Contractor-furnished materials are on hand so as to afford progress in accordance with the approved Contract Progress Schedule, or as directed by the Contracting Officer.

1.19 USE OF EXPLOSIVES: The use of explosives is not permitted on U.S. Government installations.

1.20 ASBESTOS CONTAINING MATERIALS (ACM) and PCB: The Contractor shall not use material which contains asbestos and PCB.

1.21 LEAD BASED PAINT (LBP): The Contractor shall not use paint that contains more than 0.05 percent lead weight in the total non-volatile content of liquid paint.

1.22 FIRE SAFETY REGULATION: The Contractor shall obtain a permit (AF592) from the Kadena Fire Prevention Section (Bldg. 739) prior to conducting any type of welding or soldering or whenever the use of open flame is necessary during the construction phase. The Contractor and his employees will be required to adhere to Kadena ABI 32-2001, “Fire Prevention and Protection”, dated 4

1.23 AVAILABILITY OF LATRINES: Latrines are not available in the project area. The Contractor shall be responsible for providing latrines for his personnel. Location of the latrines shall be designated by the Contracting Officer. Any and all Contractor latrine shall be removed from U.S.

Government property prior to issuance of final payment.

1.24 AVAILABILITY OF UTILITY SERVICE: The Government will furnish electricity and water when available to the Contractor at no cost in accordance with FAR 52.236-14 (Apr 1984) entitled “Availability and Use of Utility Services”.

1.25 BARRICADES: Where pavement markings do not provide adequate definition of closed or hazardous areas use reflective orange and white colored barricades with amber-yellow lights. All barricades must be anchored or be of sufficient mass to retain an established position where they are placed. Flashing lights must be at least five (5) candelas effective intensity and flash at a rate of 55 to 75 flashes per minute. Continuous burning lights must have an effective intensity of 10 candelas.

Place barricades at 15.24 meter (50 feet) minimum intervals and use dual markers and lights on corners and ends.

A. Contractor shall provide approved barriers to prevent dust from going into other areas. Where necessary, the Contractor shall utilize vacuum equipment during his work to minimize dirt emission. The Contractor shall provide, if necessary, temporary partitions to prevent spread of dust in adjacent areas. If partition is required build an acceptable wood or metal framing and apply 3/8” minimum thickness sheating. The Contracting Officer shall determine if partition is required.

B. Contractor shall provide barriers/signs to keep unauthorized persons from entering working area.

1.26 CLEAN-UP OF AREA: All Contractor generated debris and rubbish shall be collected daily at the end of the day and deposited at a location designated by the Contracting Officer.

1.27 POWER OUTAGES:

A. The number of power interruptions in the existing system shall be kept to a minimum. Outages

to facilitate the new connections to the existing system shall be scheduled to take place during the “off peak” period or during the periods of minimum demand between 0900 and 1500 hours.

B. Maximum power outage for any one interruption shall not exceed 8 hours per day, unless the need for a longer outage can be fully justified in writing to the Contracting Officer. In the event the Contractor disagrees with the contract documents in the phasing and scheduling of utility interruptions, the Contractor shall submit a written plan for the approval of the Contracting Officer. Such alternate plans, when approved shall be part of the contract documents. In no event shall utility outages be granted for a period in excess of 4 hours, unless suitable temporary connections, approved by the Contracting Officer, are provided which satisfy the customer’s essential operational needs. Power shall be restored at the end of each working day.

C. Outage of utilities requiring the presence U.S. Government personnel to turn off and turn on utilities shall be identified and submitted, in writing, to the Contracting Officer at least forty (40) calendar days in advance.

D. In the event of an emergency, such as a typhoon or military exercise, the Contracting Officer shall declare such event to the Contractor and the Contractor shall have a period of no more than two (2) hours to return all utility services to normal operation.

E. The schedule of power outage shall be verified sufficiently in advance with the affected user or shop.

1.28 DISCONNECTION OF SERVICES: If it becomes necessary to interrupt the utility service to building or utilities not a part of this Contract, coordinate with 18 CES Utiliies, and prior approval shall be obtained in writing from the Contracting Officer. Notify that the utility service will be interrupted to affective occupants. If boiled water is inetrruped, prior coordination with SGPB will be required depengin on the situation. The Contractor shall request such approval 30 calendar days in advance of when it is needed.

1.29 DEBRIS AND RUBBISH CONTROL: For removal and transport of debris and rubbish, use only the route designated by the Contracting Officer. Remove and transport debris and rubbish in a manner so as to prevent spillage. Contractor shall be responsible for clean-up of any spills. Burning of debris and rubbish on U.S. installations is prohibited. Concrete, masonry, and other materials, other than concrete permitted to remain in place, shall be disposed of outside the limits of Government-controlled land by the Contractor.

1.30 DISPOSAL OF SALVAGEABLE/UNSALVAGEABLE MATERIALS: Materials and equipment to be removed will remain the property of the U.S. Government, unless determined to be unsalvageable. The determination of which materials are unsalvageable will be made by the Contracting Officer. Daily, unsalvageable materials will be disposed of outside U.S. Government installations, at no cost to the U.S. Government, in accordance with Government of Japan laws or provisions. Salvageable material shall be delivered to a warehouse or storage area specified by the Contracting Officer at no cost to the U.S. Government.

1.31 WARNING SIGNS: Necessary bilingual warning signs will be provided by Contractor and will be used in construction areas. Contractor will protect open excavations with barricades and battery-powered lights at night as warning lights. These lights are to be continuously operated and conform with the airfield regulations. Warning signs and battery-powered lights shall be removed only after the affected area has been inspected and accepted as directed by the Contracting Officer.

1.32 STORAGE OF MATERIAL AND FIELD OFFICE: Storage of materials and field office or assembly area on base will not be authorized for this contract as sufficient space is not available.The Contractor should be financially prepared to maintain the materials off base at his own expense.

1.33 MANAGING RADIOACTIVE MATERIALS: In all contracts where radioactive materials will be used, such as earthwork using a nuclear densometer, paint testing with an X-ray Fluorescence (XRF), etc. Contractors must obtain approval from the Base Radiation Safety Officer (RSO) at least 30 calendar days in advanced before bringing the materials to Kadena Air Base. The Base RSO is the 18th Medical Group’s Bioenvironmental Engineer (18 AMDS/SGPB, telephone number 634-4752), located at Building

428. The Contractor must submit to the RSO the following:

A. A brief description of the proposed activities.

B. A copy of a valid United States Nuclear Regulatory Commission License/Permit or similar approval from the Government of Japan (GOJ) to possess and use radioactive materials.

C. Japanese Contractors will comply with GOJ regulation: The Law Concerning Prevention of Radiation hazards Due to Radio-Isotopes, etc., Law No. 167, June 10, 1957 and subsequent revisions.

D. The name, local address, and telephone number for the responsible local representative and the name, address, and telephone number of the RSO named on their license permit.

E. A copy of that part of the AF contract describing work to be done at Kadena Air Base and the inclusive dates of the work.

F. An acknowledgement that the base RSO make periodic checks to ensure that Contractor personnel follow radiation safety practices. Contractor operations believed to be unsafe due to radiation hazards can be grounds for suspension of work.

1.34 TRANSFER AND ACCEPTANCE OF REAL PROPERTY AND HVAC IDENTIFICATION

FORM: The Contractor shall complete a DD form 1354 (Transfer and Acceptance of Real Property) and HVAC Identification Form, accordingly. These forms will be provided though COR upon request. Draft DD 1354 Form shall be submitted to the COR prior to requesting pre-final inspection for Government review. Submit the completed final form within ten (10) calendar days after final inspection.

1.35 REAL PROPERTY INSTALLED EQUIPMENT (RPIE) INVENTRY LIST: The contractor shall perform a RPIE inventry of new building, and complete inventried RPIE list and submit to 18th Medical Group (MDG) to load and update Defense Medical Logistic Support System-Facility Management (DMLSS-FM). The instructions and form (worksheet/spreadsheet) will be provided by MDG after award of the contract. The RPIE inventry list shall be submitted within 30 days after receiving the acceptance of joint inspection of the facility.

1.36 WRITTEN COMMUNICATIONS IN ENGLISH: All documents required under this contract, including but not limited to, safety hazard analysis plans, all correspondence of any nature whatsoever, and all other written communications, documents, drawings, reports, etc., of every description, shall be written in English or translated into English, before being provided to the Government by the Contractor.

Delays encountered because a translated copy was not submitted shall be at the Contractors’ expense.

1.37 (RESERVED)

1.38 AVAILABILITY OF BUILDING/FACILITY: The primary construction areas under this

contract will be unoccupied and made available to the Contractor. The Contractor shall provide safe access at all times for the adjacent facility users which require joint use. The Contractor shall provide temporary utility connections to the occupied areas in the event of disruption of utilities will exceed two hours. Damaged to Government property by the Contractor shall be repaired or replaced at the Contractor’s expense.

1.39 QUALIFICATION STATEMENT: The following information applies to both the specifications and drawings. All references to “approve, approval, approved” or “directed” shall be by the Contracting Officer, except where it is specifically delegated to the Contracting Officer in this section or in writing by the Contracting Officer. Any reference to “shall take a Sample” or “in the presence of” shall be by the Contracting Officer. All references to “proposal opening” shall be replaced with “the date for receipt of proposals.”

1.40 VERIFICATION OF FIELD MEASUREMENTS: Locations of the existing work shown on the drawings are approximate. The Contractor is responsible for verifying the exact locations in the field.

1.41 INTERFERENCE WITH GOVERNMENT OPERATIONS: The Contractor shall establish work procedures and methods to avoid interference with existing operations within or adjacent to the construction area. Free passage into adjoining or adjacent buildings/areas not in the contract will not be permitted except as approved by the Contracting Officer. Procedures and methods shall also provide for safe conduct of work and protection of property which is to remain undisturbed.

1.42 TEMPORARY FENCING AROUND CONSTRUCTION SITE: The Contractor shall provide temporary fencing of the construction area during construction. After construction the temporary fence shall be removed and disturbed and/or damaged areas shall be restored to their original condition. New sod shall be used to restore damaged grass areas and the sod shall be placed edge to edge in a staggered pattern.

1.44 INSTRUCTION TO GOVERNMENT PERSONNEL: The Contractor shall furnish the services of competent instructors who will give full instruction to the designated personnel in the inspection, including pertinent safety requirements specified.

40 CFR 260 Hazardous Waste Management System: General

1.2 DEFINITIONS

1.2.1 Class I and II Ozone Depleting Substance (ODS)

Class I and II ODS are listed in JEGS Chapter 2, Table C2.T1.

1.2.2 Contractor Generated Hazardous Waste

Contractor generated hazardous waste is materials that, if abandoned or disposed of, may meet the definition of a hazardous waste. These waste streams would typically consist of material brought on site by the Contractor to execute work, but are not fully consumed during the course of construction. Examples include, but are not limited to, excess paint thinners (i.e. methyl ethyl ketone, toluene), waste thinners, excess paints, excess solvents, waste solvents, excess pesticides, and contaminated pesticide equipment rinse water.

1.2.3 Electronics Waste

Electronics waste is discarded electronic devices intended for salvage, recycling, or disposal.

1.2.4 Environmental Pollution and Damage

Environmental pollution and damage is the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life; affect other species of importance to humankind; or degrade the environment aesthetically, culturally or historically.

1.2.5 Environmental Protection

Environmental protection is the prevention/control of pollution and habitat disruption that may occur to the environment during construction.

The control of environmental pollution and damage requires consideration of land, water, and air; biological and cultural resources; and includes management of visual aesthetics; noise; solid, chemical, gaseous, and liquid waste; radiant energy and radioactive material as well as other pollutants.

1.2.6 Hazardous Debris

As defined in paragraph SOLID WASTE, debris that contains listed hazardous waste (either on the debris surface, or in its interstices, such as pore structure) in accordance with JEGS. Hazardous debris also includes debris that exhibits a characteristic of hazardous waste in accordance with JEGS.

1.2.7 Hazardous Materials

Hazardous material is any material that is capable of posing an unreasonable risk to health, safety, or the environment if improperly handled, stored, issued, transported, labeled, or disposed because it displays a characteristic listed in JEGS Table C5.T1, "Typical Hazardous Materials Characteristics," or the material is listed in Table AP1.T.4, "List of Hazardous Waste/Substances/Materials." Munitions are excluded.

1.2.8 Hazardous Waste

Hazardous Waste is discarded material that may be solid, semi-solid, liquid, or contained gas, and either exhibits a characteristic of a hazardous waste as defined in JEGS section AP1.T1 through AP1.T4.

Excluded from this definition are domestic sewage sludge, household wastes, and medical wastes.

1.2.9 Installation Pest Management Consultant

Installation Pest Management Consultant (IPMC) is the professional DoD pest management personnel located at component headquarters, field operating agencies, major commands, facilities engineering field divisions or activities, or area support activities who provide technical and management guidance for the conduct of installation pest management operations. Some pest management consultants may be designated by their component as certifying officials.

1.2.10 Land Application

Land Application means spreading or spraying discharge water at a rate that allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, or discharge into defined drainage areas (includes drainage ditches, streams, rivers, ocean, etc.)

must occur. Comply with JEGS and all applicable Federal, GOJ national or prefectural laws and regulations, and installation requirements.

1.2.11 Oily Waste

Oily waste are those materials that are, or were, mixed with Petroleum, Oils, and Lubricants (POLs) and have become separated from that POLs.

Oily wastes also means materials, including wastewaters, centrifuge solids, filter residues or sludge, bottom sediments, tank bottoms, and sorbents which have come into contact with and have been contaminated by, POLs and may be appropriately tested and discarded in a manner which is in compliance with JEGS and all applicable Federal, GOJ national or prefectural laws and regulations, and installation requirements.

This definition includes materials such as oily rags, "kitty litter" sorbent clay and organic sorbent material. These materials may be land filled provided that: It is not prohibited in JEGS and all applicable Federal, GOJ national or prefectural laws and regulations, and installation requirements; the amount generated is "de minimus" (a small amount); it is the result of minor leaks or spills resulting from normal process operations; and free-flowing oil has been removed to the practicable extent possible. Large quantities of this material, generated as a result of a major spill or in lieu of proper maintenance of the processing equipment, are a solid waste. As a solid waste, perform a hazardous waste determination prior to disposal. As this can be an expensive process, it is recommended that this type of waste be minimized through good housekeeping practices and employee education.

1.2.12 Pesticide

Pesticide is any substance or mixture of substances, including biological control agents that may prevent, destroy, repel, or mitigate pests.

1.2.13 Pesticide Treatment Plan

A plan for the prevention, monitoring, and control to eliminate pest infestation.

1.2.14 Pests

Anthropods, birds, rodents, nematodes, fungi, bacteria, viruses, algae, snails, marine borers, snakes, weeds, undesirable vegetation, and other organisms (except for microorganisms that cause human or animal disease) that adversely affect the well-being of humans or animals; attack real property, supplies, equipment, or vegetation; or are otherwise undesirable.

1.2.15 Regulated Waste

Regulated waste are solid wastes that have specific additional JEGS, Federal, or GOJ national and prefectural controls for handling, storage, or disposal.

1.2.16 Sediment

Sediment is soil and other debris that have eroded and have been transported by runoff water or wind.

1.2.17 Solid Waste

Solid waste is garbage, refuse, sludge, and other discarded materials, including solid, semi-solid, liquid, and contained gaseous materials resulting from industrial and commercial operations and from community activities. It does not include solids or dissolved material in domestic sewage or their significant pollutants in water resources, such as silt, dissolved or suspended solids in industrial wastewater effluent, dissolved materials in irrigation return flows, or other common water pollutants.

Types of solid waste typically generated at construction sites may include:

1.2.17.1 Debris

Debris is non-hazardous solid material generated during the construction, demolition, or renovation of a structure that exceeds 60 mm particle size

SECTION 01 57 19 Page 3LXEZ 11-8687 that is: a manufactured object; plant or animal matter; or natural geologic material (for example, cobbles and boulders), broken or removed concrete, masonry, and rock asphalt paving; ceramics; roofing paper and shingles. A mixture of debris and other material such as soil or sludge is also subject to regulation as debris if the mixture is comprised primarily of debris by volume, based on visual inspection.

1.2.17.2 Green Waste

Green waste is the vegetative matter from landscaping, land clearing and grubbing, including, but not limited to, grass, bushes, scrubs, small trees and saplings, tree stumps and plant roots. Marketable trees, grasses and plants that are indicated to remain, be re-located, or be re-used are not included.

1.2.17.3 Material Not Regulated as Solid Waste

Material not regulated as solid waste is nuclear source or byproduct materials regulated under the Federal Atomic Energy Act of 1954 as amended; suspended or dissolved materials in domestic sewage effluent or irrigation return flows, or other regulated point source discharges;

regulated air emissions; and fluids or wastes associated with natural gas or crude oil exploration or production.

1.2.17.4 Non-Hazardous Waste

Non-hazardous waste is waste that is excluded from, or does not meet, characteristic of a hazardous waste as defined in JEGS section AP1.1 or is listed as a hazardous waste in JEGS Tables AP1.T1 through AP1.T4. Excluded from this definition is medical wastes.

1.2.17.5 Recyclables

Recyclables are materials, equipment and assemblies such as doors, windows, door and window frames, plumbing fixtures, glazing and mirrors that are recovered and sold as recyclable, wiring, insulated/non-insulated copper wire cable, wire rope, and structural components. It also includes commercial-grade refrigeration equipment with Freon removed, household appliances where the basic material content is metal, clean polyethylene terephthalate bottles, cooking oil, used fuel oil, textiles, high-grade paper products and corrugated cardboard, stackable pallets in good condition, clean crating material, and clean rubber/vehicle tires. Metal meeting the definition of lead contaminated or lead based paint contaminated may not be included as recyclable if sold to a scrap metal company.

1.2.17.6 Surplus Soil

Surplus soil is existing soil that is in excess of what is required for this work, including aggregates intended, but not used, for on-site mixing of concrete, mortars, and paving. Contaminated soil meeting the definition of hazardous material or hazardous waste is not included and must be managed in accordance with paragraph HAZARDOUS MATERIAL MANAGEMENT.

1.2.17.7 Scrap Metal

This includes scrap and excess ferrous and non-ferrous metals such as reinforcing steel, structural shapes, pipe, and wire that are recovered or collected and disposed of as scrap. Scrap metal meeting the definition of

1.2.17.8 Wood

Wood is dimension and non-dimension lumber, plywood, chipboard, hardboard. Treated or painted wood that meets the definition of lead contaminated or lead based contaminated paint is not included. Treated wood includes, but is not limited to, lumber, utility poles, crossties, and other wood products with chemical treatment.

1.2.18 Surface Discharge

Surface discharge means discharge of water into drainage ditches, storm sewers, or creeks. Surface discharges are discrete, identifiable sources and require a permit from the governing agency. Comply with JEGS and all applicable Federal, GOJ national or prefectural laws and regulations, and installation requirements.

1.2.19 Wastewater

Wastewater is the used water and solids from a community that flow to a treatment plant.

1.2.19.1 Stormwater

Stormwater is any precipitation in an urban or suburban area that does not evaporate or soak into the ground, but instead collects and flows into storm drains, rivers, and streams.

1.2.20 Wetlands

Wetlands are those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions.

1.3 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submittals with an "S" are for inclusion in the Sustainability Notebook, in conformance with Section 01 33 29 SUSTAINABILITY REPORTING. 1.4 PAYMENT

No separate payment shall be made for work covered under this section.

Payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor, and payment of all fines/fees for violation or non-compliance with GOJ, Federal, and local laws and regulations are the Contractor's responsibility. All costs associated with this section shall be included in the Contract price.

1.5 ENVIRONMENTAL PROTECTION REQUIREMENTS

Provide and maintain, during the life of the Contract, environmental protection as defined. Plan for and provide environmental protective measures to control pollution that develops during construction practice.

Plan for and provide environmental protective measures required to correct conditions that develop during the construction of permanent or temporary environmental features associated with the project. Protect the environmental resources within the project boundaries and those affected outside the limits of permanent work during the entire duration of this Contract. Comply with JEGS and all applicable Federal, GOJ national or prefectural laws and regulations, and installation requirements pertaining to the environment, including water, air, solid waste, hazardous waste and substances, oily substances, and noise pollution.

Tests and procedures assessing whether construction operations comply with Applicable Environmental Laws may be required. Laboratory analyses necessary to implement JEGS shall be conducted in a laboratory certified by a U.S. or GOJ regulatory authority for the applicable test method. In the absence of a certified laboratory, contact the Contracting Officer for further guidance.

1.5.1 Conformance with the Environmental Management System

Perform work under this Contract consistent with the policy and objectives identified in the installation's Environmental Management System (EMS).

Perform work in a manner that conforms to objectives and targets of the environmental programs and operational controls identified by the EMS.

Support Government personnel when environmental compliance and EMS audits are conducted by escorting auditors at the Project site, answering questions, and providing proof of records being maintained. Provide monitoring and measurement information as necessary to address environmental performance relative to environmental, energy, and transportation management goals. In the event an EMS nonconformance or environmental noncompliance associated with the contracted services, tasks, or actions occurs, take corrective and preventative actions. In addition, employees must be aware of their roles and responsibilities under the installation EMS and of how these EMS roles and responsibilities affect work performed under the Contract.

Coordinate with the installation's EMS coordinator to identify training needs associated with environmental aspects and the EMS, and arrange training or take other action to meet these needs. Provide training documentation to the Contracting Officer. The Installation Environmental Office will retain associated environmental compliance records. Make EMS Awareness training completion certificates available to Government auditors during EMS audits and include the certificates in the Employee Training Records. See paragraph EMPLOYEE TRAINING RECORDS.

1.6 SPECIAL ENVIRONMENTAL REQUIREMENTS

1.6.1 Asbestos Prohibition and Certification

a. Materials or products containing more than one-tenth of one percent (0.1 percent) by total weight, of the material or product, of asbestos shall not be used in this project. The Contracting Officer, at any time prior to acceptance of the work, or during the period designated for warranty of the work, if any, may reject materials and products that contain asbestos in excess of one-tenth of one percent by weight, and direct the removal of such materials and products from the job site, at the sole expense of the Contractor, and without additional time granted for performance of the work. After completion of this Contract, if asbestos (exceeding 0.1 percent by weight) is discovered in the products or materials (excluding items permitted by the exception) installed by the Contractor, the Government reserves the right to direct the Contractor to perform asbestos abatement and restoration work, as required, at the Contractor's sole cost.

Asbestos abatement work (removal and disposal of asbestos-containing materials and products) shall be accomplished in accordance with currently applicable Government standards for such work.
