About this file

This document is an Evaluation Criteria attachment for a Lowest Price Technically Acceptable (LPTA) solicitation for base-wide cell phone service. The solicitation (FA524026R0002) is for a Firm Fixed Price Single Award Indefinite Delivery/Indefinite Quantity (IDIQ) contract for cell phone services at a 36th Communications Squadron base location. The government will evaluate offers based on two primary factors: technical capability and price, with a pass/fail technical assessment that rates proposals as either Acceptable or Unacceptable. Only offerors receiving an Acceptable rating will have their price proposals evaluated, with the award going to the lowest-priced offeror meeting all solicitation requirements. Contractors must provide statements of capability for providing communication devices and services, and demonstrate ability to meet both Basic and Premium service requirements outlined in the attached Performance Work Statement.

FA524026R0002 36 Base-wide Cell Phone Service IDIQ Attachment 6 – Evaluation Criteria

Lowest Price Technically Acceptable (LPTA) Approach 52.212-2, Evaluation--Commercial Items (Oct 2014)

(a) The government shall award a Firm Fixed Price Single Award IDIQ contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The following factors will be used to evaluate offers:

(1) Technical Capability of the item offered to meet the Government requirement

(2) Price

(b) Options. The government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, will result in a binding contract without further action by either party. Before the offer's specified expiration time, the government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2, Evaluation - Commercial Items

Paragraph (b) of the provision is deleted in its entirety.

The following is inserted as new paragraph (d) of the provision:

“(d) BASIS FOR CONTRACT AWARD: This is a competitive Lowest Price Technically acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) Parts 12, 13.5, and 15. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All responsible offers shall be treated equally. Failure to meet a requirement may result in an offer being determined unacceptable. The government shall rank each proposal from least to greatest based on price. Then the government shall evaluate the technical aspects of each proposal and rate each offeror either acceptable or unacceptable based on the specified criteria. Award shall then be made to the offeror who has the lowest price with an overall acceptable rating.

The evaluation process will include the following:

(1) Technical. The government shall evaluate each offeror’s capability on a pass/fail basis and assign an Acceptable or Unacceptable rating as described in Table 1 below. The Government reserves the right to not award to any contractor deemed unacceptable.

Table 1. Responsibility Ratings Rating Rating Description

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the requirements of the solicitation.

The technical factor is met when the contractor provides all the following:

(a) A statement of capability to provide CMDs and Services listed in Attachment 2 – ELIN

Price List.

(b) A statement that the contractor can meet all the requirements for Basic and Premium service outlined in Attachment 1 – 36 CS Base-wide Cell Phone Services IDIQ_PWS.

The government will conduct the technical assessment before evaluating Price proposals. Only offerors with an Acceptable rating will have their Price proposals evaluated.

(2) Price Evaluation Factor. The government shall evaluate the total price proposal based off the current estimated quantities for each ELIN as outlined in Attachment 3 – Price Proposal Structure worksheet. The Government shall rank all offers by price in order from least to greatest. The price evaluation shall document the fairness and reasonableness of the price.

The government reserves the right to perform price realism analysis. If the Government elects to perform a price realism analysis, the Government reserves discretion over the method within which it performs its price realism analysis. If the Government elects to perform a price realism analysis and finds a proposal unrealistic, the Government may withhold award to that offeror.

The Government intends to award a Firm Fixed Price Single Award IDIQ contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

In order to be considered for award, the offeror’s proposal must be responsive to all the requirements listed within this solicitation and Performance Work Statement.
