Questions _Concerns
| FA4890-22-R-CN02 - FOL BOS - Questions and Answers | ||||
| No. | Reference (i.e. document - PWS) | Reference Text (i.e. paragraph #) | Vendor Question/Comment | Government Response: |
| 1 | PWS 4.1.7.1 and 4.1.7.1.1, Section B Pricing Sheet | RFP Language: “Contractor is responsible for procuring parts and supplies to support mission requirements that do not require CO approval.” and “Purchases approved by the CO shall be cost reimbursable. If a purchase is not approved by the CO and the contractor purchases the item(s), the Contractor will not be reimbursed for any costs associated with the purchase(s).” | DRAFT RFP Question: In the Section B Pricing Sheet, CLINS X001 through X003 and X008 through X012 are priced using labor only. And CLIN X007 is a plugged figure, there doesn’t seem to be a place in the Excel pricing sheet to price any ODC unrelated to lodging CLIN X006 and Contractor Furnished Vehicles CLIN X004. |
PWS 4.1.7.1 defines certain costs that do not require CO approval and that includes most items under the micro-purchase threshold. Section 4.1.7.1.1 indicates any item not approved by the CO won’t be reimbursed, which would indicate anything under the micro-purchase threshold that contractors purchase won’t be reimbursed unless the CO approves.
| Is it the intent for contractors to assume that the CO will approve all reimbursable items under the micro-purchase threshold and these costs are covered in the CLIN X007 plug? Or should contractors assume a certain level of reimbursable micro-purchases within the fully burdened labor pricing of CLINS X001-X003 and X008-X012 for parts/supplies/services? | PWS Para 4.1.7.1 was updated in the final RFP to provide clarity that: "If a purchase is above the micro-purchase threshold (or any values for d. and i. below) and is not coordinated and approved by the CO, the Contractor will not be reimbursed for any costs associated with the purchase(s)." So as long as a cost is allowable and under the contractor's threshold, (or properly approved by the CO if above the threshold), then the costs will be reimbursed. | ||||
| 2 | Section B Pricing Sheet, ODCs Tab | DRAFT RFP Question: Does the CLIN 0007 Service/Parts/Freight/Travel/Utilities plug cover all reimbursable parts and services required for this contract? Should contractors price any parts/services for work related to CLINs 1-3 and 8-12 within those FBLRs? | A majority of parts and services required to perform PWS requirements will fall under CLIN X007 (e.g centrally managed PPE, material, and parts). All labor and incidental expenses such as uniforms and personally issued PPE should be included in overhead. | ||
| 3 | Section B Pricing Sheet and RFP Section L-9.2.2 | The proposal’s pricing narrative shall break out the fully burdened labor rates, (including direct labor rates and all indirect rates, e.g., G&A, overhead, fringe, profit/fee, etc.) for each labor category proposed to accomplish the work described in the PWS. | DRAFT RFP Question: Section L-9.2.2 requires pricing labor only on the FFP CLINs, and the pricing Excel sheet for FFP CLINs X001-X003 and X008-X012 only seems to allow labor pricing. Does the Government expect any non-labor related cost priced within these CLINs? For instance, any parts or services related to work done in these CLINs. | For the referenced CLINs; a majority of parts and services required to perform PWS requirements will fall under CLIN X007 (e.g centrally managed PPE, material, and parts). The only non-labor costs for these CLINs is considered minor and incidental expenses such as uniforms and personally issued PPE which should be included in overhead. | |
| 4 | L-2.1, SECTION L, APPENDIX 4 Q&A Form | Any formal communication or questions such as requests for clarification, and information concerning this solicitation should be submitted in writing (utilizing the template provided) via e-mail to all POCs listed below no later than 12:00 PM EST on 31 May 2022. Questions will be considered at any time prior to, during or after the site visit up to the deadline above; however, official answers will be provided to written questions only. | DRAFT RFP Question: We are not able to access the Q&A template on page 22 of section L. Will the government resend or reattach the template so that we can submit any further questions in the template as instructed? | The Q&A document was added to the Final RFP SAM.Gov Posting. | |
| 5 | Draft Section L-8.1.2 Past Performance Information (PPI) |
Draft Section M.3.2.1 Recency L-8.1.2 Past Performance Information (PPI) and Draft Section M.3.2.2 Recency both require each relevant contract shall have a minimum of six (6) months of active performance within four (4) years preceding the FOL-BOS final solicitation issuance date. DRAFT RFP Questions:
Q1: Would the Government clarify its intent? Is its the Governments intent that bidders shall provide contract past performance examples that have at least 6 months of active performance to measure performance?
Q2: The current construct of the M.3.2.1 effectively creates a 3.5 year recency requirement rather than the stated 4, due to the additional requirement for 6 months of performance within the 4 year period, (i.e., a contract ending 3 years and 10 months ago which would qualify under the 4 year requirement but would fail to meet the 6 month performance requirement within the 4 year period - only two months within 4 year period). As such, would the Government consider striking the reference to "within four (4) years"? Q1: Yes, each PPI reference shall have (minimum of six (6) months) performance that was/were performed during the last four (4) years preceding the FOL-BOS final solicitation issuance date.
Q2: No change to this requirement as written. The requirement is for (6) months performance that was/were performed during the last four (4) years.
6 Draft Section L-8.1.2 Past Performance Information (PPI)
Draft Section M.3.2.2 Relevancy
| Draft Section M.3.2.3 Performance Confidence Assessment | L-8.1.2 Past Performance Information (PPI), M.3.2.2 Relevancy, and M.3,2,3 Performance Confidence Assessment. Requires each offeror to submit a minimum of two (2) and a maximum of five (5) contract references (CR); at least two (2) of the references provided shall be on the Offeror (Prime Contractor), if available. Draft Sections L and M did not provide examples of how PPIs would be scored or how the Contractor Performance Assessment Reports (CPAR) scores would factor into the PPI scores. However, if the process employed in the award of the existing Curacao BOS contract is a guide, then numeric values were assigned to the adjectival ratings described in section M.3.2.2 for each CR and the CPAR rating for each contract year was averaged and added to the adjectival ratings for each CR for a total score. The total scores for each CR were then totaled minus any Government subtracted points for the Offerors PPI score. It is important to note that all Offerors competing for the existing contract were each required to submit three (3) CRs | DRAFT RFP Question: Since the DRAFT RFP requires the Offerors to submit a minimum of two (2) and maximum of five (5) CRs ,will the Government consider averaging the total scores for each CR to arrive at the Offeror PPI score instead of totaling the total scores for each CR? To do otherwise, will require all Offerors to provide five (5) CRs since the total of 5 will always beat the total of 2. If not, what is the Governments process for scoring past performance? | Individual PPIs will not be scored, Recency determination is recent/not recent; and the Relevancy determination will utilize M-3.2.2 Table 5. Per M-3.2: "The performance confidence assessment will be assessed at an overall factor level..." | ||
| 7 | Draft Section L-8.1.2 Past Performance Information (PPI) | ||||
| Draft Section M.3.2.1 Recency | L-8.1.2 Past Performance Information (PPI). and Draft Section M.3.2.2 Recency both require each relevant contract shall have a minimum of six (6) months of active performance within four (4) years preceding the FOL-BOS final solicitation issuance date. | DRAFT RFP Question: Would the Government consider using a five (5) year recency standard which is more common rather than four (4) years. This change would not prejudice any Offeror and instead would encourage broader competion. | The evaluation criteria were carefully crafted to ensure the the Government was evaluating offerors with recent and relevant past performance. No change. | ||
| 8 | Draft Section L, paragraph L-7.4.1.2(viii) | The referenced section directs Bidders to, "Identify overall fleet (GPV/SPV) and (CFV) as prescribed in PWS para 4.1, utilizing GFE and CFE listings at Tab 2 - Government Vehicles and Tab 3 - CTR Vehicles in Appendix K." | DRAFT RFP Question: These instructions imply that Appendix K is to be somehow be included in the Technical Volume (Volume I). Is this the Government's intent? If so, provide direction where Appendix K is to be included in the Technical Volume and confirm the Appendix K is excluded from the volume's 15-page limit. | The intent of this section is to confirm that the bidder's transition plan for vehicle support is sound and logical and can be accomplished in the 60-day transition period. The annotated Appendix K will be included at the end of your technical volume and will not be included in your page count. | |
| 9 | Draft Section M, paragraph M-3.1.2 SUBFACTOR 2: Technical Understanding | This paragraph indicates that Subfactor 2 consists of (A) Communications Support, (B) Airfield Services and Management, and (C) Fire and Emergency Services. | DRAFT RFP Question: Can the Government confirm if the inclusion of Fire and Emergency Services is correct, or should this be replaced by Civil Engineering Mission Support as reflected in M-3.1.2.3? | Corrected between Draft and Final RFP to Civil Engineering Mission Support in M-3.1.2.3. | |
| 10 | Draft PWS, paragraph 6.0 | N/A | DRAFT RFP Question: Does the Government intend to exercise any of the options at the time of contract award? | The Government is not able to share this information at this time. | |
| 11 | SAM.GOV Related Notice dated 5/13/2022 | Section D will not be included in this solicitation as it is not applicable to this requirement. | DRAFT RFP Question: Will the Government please advise in which section it intends to address transition and provide a plug number for it in pricing template to level the playing field for competition? | Transition is unpriced. | |
| 12 | General | N/A | DRAFT RFP Question: Given the Pentagon's March 7, 2022 announcement that a new strategy to bring in small businesses is coming soon, would the Government consider including a 25-30% small business participation requirement for this work? | The Government welcomes small business participation, however, there is no minimum requirement. | |
| 13 | 4.3.1.2.1 FOL Support AEF Lodging | Provide nine hotel or apartment rooms with two full size beds… | DRAFT RFP Question: Does the Government require two full sized beds per hotel room or appartment (i.e., double occupancy hotel room with two beds within one room and a shared bath with no kitchen)? Or, is the intent to provide a private room and bathroom for each occupant? | The Government's requirement is as written; to provide as a minimum; two full-sized beds in a hotel room or apartment. It is permissible, but not a requirement, to provide a private room and bathroom for each occupant. | |
| 14 | General | N/A | DRAFT RFP Question: Is this a new requirement? | No | |
| 15 | General | N/A | DRAFT RFP Question: If not, could the government please provide the incumbent contract number, award value, and period of performance? | Contract Number: FA489016D0007-FA489017F3053, |

The page limit for Volume I - Technical is limited to 15 pages. |
| 18 | Section L-8.1 | Section L-8.1d and 8.1.2.1 indicate the PPI is limited to 3 pages for each contract reference. However, 8.1.2.1.3 says to limit the summary to 1 page. | It is unclear what part of the 3 pages is limited to 1 page. Is this to indicate the B (V.) section of the PPI template is limited to 1 page? | Section L-8.1.2.1.3 has been updated to remove the one (1) page limitation, as this falls within the 3 page limit for each PPI Reference (utilize Section L Appendix 3 - PPI Template). |
The intended structure of the Past Performance Volume is as follows:
| a. | Table of Contents (limited to one (1) page) |
| b. | Glossary (NO PAGE LIMIT) |
| c. | Past performance Summary: (Limited to two (2) pages for an overview summarizing all PPIs), and limited to two (2) pages for Organizational Structure change history. |

| 72 | Section_M_FA4890-22-R-CN02_FOL_BOS | M-3.3.1 | M-3.3.1 Price analysis will be conducted IAW FAR 15.404-1(b). Comparison of proposed prices received in response to this solicitation is the preferred and intended price analysis technique. If the Government cannot determine the proposed pricing to be fair & reasonable, balanced, and realistic based on competition; other than cost or pricing data may be requested. There is an expectation of competition for this requirement; |
FAR 15-404-1(b) states: Price analysis. (1) Price analysis is the process of examining and evaluating a proposed price without evaluating its separate cost elements and proposed profit.
Yet much of Section L and the Section B Pricing Sheet are written for a Cost Plus type of contract. Contractor Suggestion: Section L and Section B excel file be re-written to follow the evaluation criteria and FAR 15-404-1(b). No change to the solicitation on this topic.
Analysis of other than certified cost and pricing data is one of several price analysis techniques available at FAR 15.404-1(b). This detailed pricing information will help the Government conduct price realism analysis.
| 73 | Section_L_FA4890-22-R-CN02_FOL_BOS | L-9.2.1 | L-9.2.1 Supporting Price Backup Data. Based on the expectation of competition, certified cost and pricing data is not required. However, Offerors shall provide support for all proposed prices to include indirect rates proposed based on Offerors accounting system and provide any applicable Forward Pricing Rate Agreements, if available. | |
| Section M states a Price Analysis iaw FAR 15-404-1(b) will be used for evaluation therefore this type of data is not applicable to this Firm Fixed Price RFP and the evaluation criteria. Contractor Question: Because this is FFP Competitive, will the Government consider eliminating backup data to include direct labor and indirect rates? | No change to the solicitation on this topic. |

The proposal’s pricing narrative shall break out the fully burdened labor rates, (including direct labor rates and all indirect rates, e.g., G&A, overhead, fringe, profit/fee, etc.) for each labor category proposed to accomplish the work described in the PWS.
In accordance with FAR 15-404-4(b)(5) The contracting officer shall not require any prospective contractor to submit breakouts or supporting rationale for its profit or fee objective but may consider it, if it is submitted voluntarily.
| Contractor Question: Will the Government consider removing the profit and indirect rates breakout iaw FAR 15-404(b)(5) and FAR 14-404-1(b)? | This FAR reference does not exist. Offerors shall provide their profit rate for FFP CLINS IAW L-9.2.2. This detailed pricing information will help the Government conduct price realism analysis. | |||
| 75 | Section_L_FA4890-22-R-CN02_FOL_BOS | L-9.2.2 | L-9.2.2 A Basis of Estimate (BOE) shall be included in the narrative price volume that addresses each labor category, and each CLIN by functional area and location. | |
| Contractor Question: A BOE could very easily push the Price Narrative over the 7 page limit. Additionally a BOE should not be required IAW FAR 15-404-1(b) Price Analysis. Will the Governement consider either expanding the price narrative to 12 pages or elimitate the BOE requirement all together? | The Government believes 7 pages is adequate to convey the offeror's BOE in the pricing narrative. The pricing narrative page limit |
remains at 7 pages.
| 76 | Section_L_FA4890-22-R-CN02_FOL_BOS | L-9.2.3 | The value of the indirect rates and profit proposed on the plug number will be included in the TOEP for evaluation purposes only. | |
| Contractor Question: Section M-3.3.1 states Price analysis will be conducted IAW FAR 15.404-1(b). Indirect rates are not typically part of the evaluation process associated with that FAR clause. | 77 | Section_L_FA4890-22-R-CN02_FOL_BOS | L-9.3 | The indirect rates proposed for CLIN Series X005 and X007 shall be applied to the plug numbers and included in the TOEP for evaluation purposes only. The award value of these CLINs will be the plug number. | |
| Contractor Question: Since the award value will be the plug number, the indirect rates applied by a contractor are irrelavant. Additionally an offeror's indirect rates should not be an evaluation factor, IAW Section M, FAR 15-404-1(b). Suggest this be re-written to remove the indirect rates requirement. | No change to the solicitation on this topic. |
Analysis of other than certified cost and pricing data is one of several price analysis techniques available at FAR 15.404-1(b). This detailed pricing information will help the Government conduct price realism analysis.
The value of the indirect rates (and profit for X005) proposed on the plug number will be included in the TOEP for evaluation purposes only. Example: Offerors shall apply indirect rates to the $500k plug number which will yield a value for CLINs X005 exceeding $500k per year FOR TOEP/EVALUATION PURPOSES ONLY. Actual amounts billable under this CLIN will depend on the FFP values proposed for individual projects. Actual (plug number) value of CLIN 0005 will be $500k on the resulting contract.
| 78 | Section_L_FA4890-22-R-CN02_FOL_BOS | L-9.4.3 | L.9.4.3 you ask offeror’s to provide a copy of their disclosure statement, however a disclosure statement by itself will exceed the seven page limit of the price narrative. Contractor Question: Suggest the requirement for the disclosure statement be removed since Section K answers the question about Disclosure Statements: "When required, the Disclosure Statement must be submitted as a part of the offeror's proposal under this solicitation unless the offeror has already submitted a Disclosure Statement disclosing the practices used in connection with the pricing of this proposal." | Provide brief statements to address each L-9.4 subsection within the L-9.2 Narrative Price Volume (7 page limit). All documents required by L-9.4 are excluded from the page limit. |

Contractor Question: Will the Government consider removing this requirement since this is FFP with price evaluation and the ODCs on contract will be the plug amounts regardless of the indirect rates used by each offeror. Also suggest this be removed as an offeror’s indirect rates, that are submitted too and reviewed by DCAA/DCMA and recommendations provided by DCAA/DCMA, should not be an evaluation criteria. | No change to the solicitation on this topic. |
