Offerors must meet size standard requirements and be registered in the System for Award Management. Pricing is requested for base and option years for training events and travel. The contract will be awarded using simplified acquisition procedures to the lowest priced technically acceptable offeror.

Combined Synopsis/Solicitation

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

The Request for Quotation (RFQ) number FA489022Q0002 shall be used to reference any written quote provided under this RFQ.

The solicitation documents and incorporates provisions and clauses and those in effect through Federal Acquisition Circular 2021-07; Effective 2021-09-10.

This is a 100% Small business set-aside for Service Disabled Veteran-Owned Small Businesses.

The North American Industry Classification System (NAICS) code for this project is 611699 – All other Miscellaneous Schools and Instruction, with a size standard of $12,000,000.00. SIC code 8299.

The purpose of this combined synopsis and solicitation is the purchase and delivery of Expeditionary Medical Decontamination Team (EMDT) Training in accordance with the attached Performance Work Statement (PWS), Attachment 1.

The bid schedule and contract line item number (CLIN) schedule is below. Contractors are to fill in their prices for all CLIN’s except those noted as “to be negotiated”.

All companies must be registered in the System for Award Management at https://www.sam.gov/ to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instruction shall be provided at time of award.

“Pursuant to FAR 12.602 contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Vendor’s submissions will be evaluated based upon the following:

(1) Technical: quote must be rated as technically acceptable to be eligible for award. In order to be deemed technically acceptable, the following evaluation criteria must be met:

a. Training Event Schedule

1. The contractor shall provide a schedule of events for a training event that includes all the requirements of the Expeditionary Medical Decontamination Training Tactical Training Plan, Attachment 2.

2. Contractor’s technical solution is acceptable when it demonstrates a sequence of events for the training that includes all the requirements of the Expeditionary Medical Decontamination Training Tactical Training Plan.

b. UTS Shelter/Equipment Instructor Qualifications

1. The contractor shall provide a narrative that demonstrates the ability to meet the requirement at Section 4.5.2.7 of the Performance Work Statement.

2. Contractor’s technical solution is acceptable when it includes a narrative that demonstrates the ability to meet the requirement at Section 4.5.2.7 of the Performance Work Statement. Re-stating the PWS Section 4.5.2.7 is not an adequate narrative and may result in the RFQ being deemed unacceptable.

(2) Price: Award will be made to the lowest priced technically acceptable vendor.

The Government will evaluate offers for award purposes by adding the total price for all options, except those noted as “to be negotiate”, to the total price for the basic requirement, known as the “total evaluated price”. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the options.

A vendor must be determined to be responsible by the Contracting Officer in order to be eligible for award.

Responsibility is described in Federal Acquisition Regulation (FAR) Subpart 9.1, “Responsible Prospective Contractors.” Part of the determination addresses financial capability. Please provide the names, addresses and points of contact for all financial institution organizations utilized to determine if contractor has adequate financial resources to perform the contract or the ability to obtain them to include written authority to contact the provided financial institution.

Discussions: The government intends to award a purchase order without discussions with respective vendors/quoters. The government however, reserves the right to conduct discussions if deemed in its best interest.

FAR Provision *52.212-3, Offeror Representations and Certifications -- Commercial Items (Feb 2021), with its Alternate I (Oct 14), applies to this acquisition. All vendors must be registered in System for Award Management at https://www.sam.gov/portal/public/SAM/ at the time of Quote submittal.

FAR clause at 52.212-4, Contract Terms and Conditions -- Commercial Items (Oct 2018), applies to this acquisition with the following Addendum: Paragraph (c) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-

DFARS 252.223-7999 ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL

CONTRACTORS (DEVIATION 2021-O0009) (OCT 2021)

(a) Definition. As used in this clause – United States or its outlying areas means—

(1) The fifty States;

(2) The District of Columbia;

(3) The commonwealths of Puerto Rico and the Northern Mariana Islands;

(4) The territories of American Samoa, Guam, and the United States Virgin Islands; and

(5) The minor outlying islands of Baker Island, Howland Island, Jarvis Island, Johnston Atoll, Kingman Reef, Midway Islands, Navassa Island, PalmyraAtoll, and Wake Atoll.

(b) Authority. This clause implements Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors, dated September 9, 2021 (published in the Federal Register on September 14, 2021, 86 FR 50985).

(c) Compliance. The Contractor shall comply with all guidance, including guidance conveyed through Frequently Asked Questions, as amended during the performance of this contract, for contractor or subcontractor workplace locations published by the Safer Federal Workforce Task Force (Task Force Guidance) at https:/www.saferfederalworkforce.gov/contractors/.

(d) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts at any tier that exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the date of subcontract award, and are for services, including construction, performed in whole or in part within the United States or its outlying areas.
