The RFP had a “DRAFT” watermark. Additionally, the vendor wanted more information regarding an industry day, and a questions deadline.

Is the solicitation a draft or final solicitation? ? FBO notes it is the final, however the document has a watermark for the draft. Is there an industry day planned. If so, please confirm when registration is due. When is the deadline for questions.

Answered in Amendment 01 This is not a draft solicitation. The 1449 was updated to remove the watermark; no changes in information.

A pre-proposal site visit will be held on June 2, 2017 at 0900 MST IAW the RFP.

3.18 Notice of Pre-proposal Site Visit

A pre-proposal site visit will be conducted at MAFR for the purpose of answering questions regarding this solicitation. It will be held on the day and time indicated on the solicitation announcement on the FedBizOpps website.

Submit the names of all attendees (not to exceed 3) to the POCs listed in section 3.3.

This information must be provided in advance in order to ensure access to the military base/conference site and adequate seating for the conference attendees.

Offerors are requested to submit questions to the point of contact noted above not later than 5 days after the pre-proposal site visit. Information provided at this conference shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

3.16 Request for Proposal (RFP) Technical Clarifications Offerors who determine that the technical requirements of this RFP require clarification(s) in order to permit submittal of a responsive proposal are requested to submit all questions in writing within 10 business days from release of the RFP. These questions shall be directed to the POCs identified in section 3.0.

3.16 Request for Proposal (RFP) Technical Clarifications

This paragraph states Questions are due in writing within 10 business days from release of the RFP.

3.18 Notice of pre-proposal site visit

This paragraph states Questions are due not later than 5 days after pre-proposal site visit.

Question: Please clarify these questions due dates.

Answered in Amendment 01 Paragraph 3.16 refers to questions relating to technical requirements of the RFP that require clarification, they are due within 10 business days from release of the RFP. The pre-proposal site visit is scheduled on 2 June, any questions that result from that site visit that have not previously been asked in writing (IAW 3.16) or asked at the site visit (IAW 3.18) are due 5 days after the site visit (IAW 3.18). The intent of these differing due dates is to allow for the Government to provide timely responses to all questions.

3.3.6

Within the RFP documents, dated 22 May 2017, Regarding Section 3.3, Volume IV Past Performance Factor (page 55-57) describes a list of past performance requirements which must be met by the prime vendor in order to receive either a Very Relevant or Relevant rating. Specifically, to receive a VERY RELEVANT rating, Page 55, paragraph 3.3.4, Table 5 requires the prime vendor to have past performance in all nine performance requirements. To receive a RELEVANT rating, the offeror needs to demonstrate past performance in eight of the nine performance areas listed.

Further, page 57, paragraph 3.3.6 states that “Past performance regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirement will not be weighted as heavily as past performance information for the prime Contractor.”

In section 52.212-1, “Instructions to Offerors” Paragraph 1.0, it states, “Market research confirmed that subcontracting and teaming arrangements are likely due to the broad scope of the contract requirements; therefore such arrangements are encouraged to ensure mission success.”

Question1A: As the Government acknowledged market research indicates subcontracting and teaming will be likely due to the broad scope and encouraged small businesses with only partial capabilities to respond, was it the intent of the Government, in the Evaluation Criteria, to require that the Prime vendor have the dominant past performance, rather than considering the past performance of the totality of the team to increase the competitive pool of offerors?

Question 1B: Based on Instructions to Offeror’s Paragraph 1.0, will the Government consider totality of past performance of Prime/Subcontractors in overall relevance assessment rather than each individual citation, as very few 8(a)s will have demonstrated capabilities to reach the “Relevant” Past Performance Rating?

Answered in Amendment 01 It is the Government’s intention to encourage offerors’ with partial capability to provide past performance references of all teaming partners, subcontractors, and joint venture partners for evaluation. 52.212-1 para 7.0 Volume IV – Past Performance describes the Government’s intent to evaluate the past performance information of “the offeror and all subcontractors, teaming partners, and/or joint venture partners who are proposed to perform as documented in Attachment 1 Contractor Team Organization.” Amendment 01 revises the addendums to 52.212-1 and 52.212-2 to clarify the Government’s intent and to ensure that interested and capable 8(a) companies have to ability to provide relevant past performance information for themselves, their joint venture/teaming partners, and their subcontractors. The following paragraphs have been revised:

52.212-2 3.3.4, Table 5

Section L 2.0 Basis for Award and Section L 3.3.4 and Table #5 Relevancy Assessment. Section L 2.0 provides details indicating that the technically acceptable proposals will be evaluated on a Best Value basis with “Past Performance evaluated on a basis significantly more important than price considerations.” Section L 3.3.4 states “A more relevant past performance record will be weighted more heavily than a less relevant performance record. The Government will use the degrees of relevancy in Table 5 Past Performance Relevancy Rating Method when assessing relevant ratings to references.” Table #5 provides the requirements for obtaining three levels of “relevancy” for contracts submitted as past performance references. In order for an individual contract to receive either Very Relevant, Relevant, or Somewhat Relevant they must have provided Range Control Officer and Wildland Fire Operations plus experience from either ALL 7, 6, or 4 other service categories, respectively. This currently stated relevancy criteria provided in Table 5 provides an unfair competitive advantage to the incumbent. If not modified, the incumbent will be the only possible bidder that can obtain the Very Relevant rating since this is the only DoD contract that provides the Range Control Officer and Wildland Fire Operations plus experience ALL 7 of the other service categories. Many companies may have all or most of these elements covered in several separate contracts, but as currently written, all the elements have to be within an individual contract in order for them to be assigned a relevancy rating.

Please amend Section L 3.3.4 and Table 5 Relevancy criteria to allow the Relevancy evaluation on a cumulative basis across multiple contracts versus an individual contract.

Answered in Amendment 03 Amendment 03 revises the addendum to 52.212-2 to clarify the Government’s intent and to ensure that interested and capable 8(a) companies have to ability to provide relevant past performance information for themselves, their joint venture/teaming partners, and their subcontractors. The following sections have been revised:

PWS 3.1.15. SITFOR Support. PWS 3.1.15 states “SITFOR personnel will consult with requesting units prior to planning and execution of missions.” This level of expertise we are to be providing as consulting services with the requesting unit is unclear/undefined. It also does not define exactly what the consulting expertise is to cover.

Please clarify the level of expertise expected of the SIATFOR personnel that will be consulting with requesting units.

PWS (version 16 June 2017) paragraph 3.1.15 has been revised to clarify the Government’s requirement. Sentence “SITFOR personnel will consult with requesting units prior to planning and execution of missions.” has been revised to “SITFOR personnel will consult with requesting units prior to planning and execution of missions in order to determine theater and level of involvement with the training scenario (number of people, dress, etc.).

PWS 3.1.16

PWS 3.1.16. SITFOR Support. PWS 3.1.16 states “The participants will be capable, adaptive and able to replicate a hybrid theater based threat; be capability based, having the ability to engage verbally and non-verbally as required.” There is no definition of what languages are required and what level of language proficient (Defense Language Institute proficiency levels go from 0 to 5) is required. This is a critical data point for this support because with varying languages and language proficiency levels creates a cost difference that must be accounted for/priced into the CLIN.

Please provide languages required and DLI proficiency level ratings required.

No foreign languages are required of SITFOR support. English language is sufficient for the verbal communication requirement of PWS paragraph 3.1.16.

PWS 3.1.16

PWS 3.1.16. SITFOR Support. PWS 3.1.16 states “The contractor is responsible to provide personnel protective equipment to meet government standards.” While the PWS paragraph specifically discusses PPE it is silent about appropriate costume/wardrobe for the SITFOR personnel “providing immersive services to simulate real world conditions”. Hence it is unclear if the contractor is providing these or they are GFE. Again no mention of region, since clothing varies by geographical location. Also no costume/wardrobe for SITFOR personnel is listed in Table 3-3 Battlefield Atmospherics/Props.

Is the contractor required to provide uniforms/local clothing in addition to PPE for SITFOR personnel?

Yes. PWS (version 16 June 2017) paragraph 1.9.4.1 has been revised to clarify the Government’s requirement. Sentence “Contractor SITFOR personnel will wear scenario appropriate clothing provided by the contractor.” has been added.

PWS 3.6 thru 3.6.8 and Attachment 11 Consolidated Government Furnished Property A review to the PWS and attachment and PWS Section 3.6 thru 3.6.8 is silent on who provides the fire fighting vehicles used by the Wildland Fire personnel. Additionally a review of all 296 line items in Attachment #11 Consolidated GFP listing shows no firefighting vehicles or equipment. PWS 3.6.3 only discussed individual wildland fire clothing and PPE but not vehicles

Does the contractor have to provide the Firefighting vehicles on the range?

Firefighting vehicles used for services required in 3.6 through 3.6.8 are supplied and maintained by the 27 SOCES/CEV.

PWS 3.6 -3.6.8 and Attachment 11 Consolidated Government Furnished Property.

If the contractor is to provide the firefighting vehicles on the range there is no quantity listed nor the specifications of these firefighting vehicles (such as vehicle size (minimum GVW), water tank storage capacity, and pump PPM, length and number of hoses).

Please provide the number and specifications of all the fire fighting vehicles the contractor is to provide.

Firefighting vehicles used for services required in 3.6 through 3.6.8 are supplied and maintained by the 27 SOCES/CEV.

PWS 1.7.6.3 states “The contractor shall include in their plan a list all additional proposed contractor-provided heavy equipment/vehicles to be used in performance of the PWS.”

Question: Are we to include fire COCO fighting vehicles in the Transition Plan as per PWS 1.7.6.3 and price the fire fighting vehicles? If so, where are these priced

(CLIN)?

PWS 1.0

CLINS 0005/0006/0007, PWS 1.0 page 6 and PWS 1.4 and FAR Part 16 with subparts 16.2 and 16.6. CLINS 0005/0006/0007 are clearly labeled FFP, but the discussion in the PWS at 1.0 page 6 and PWS 1.4 describes a Time & Material process using a fixed billing rate and estimate hours with a not to exceed total. This disconnect will clause issues with DCAA accounting reviews if not corrected as DCAA will expect those CLINS to be treated as FFP since they are labeled as such, not as described in the PWS. The process described in the PWS for AOH follows the guidance in FAR 16 subpart 16.6 not Subpart 16.2.

Please either revise the CLINS 0005/0006/0007 or revise the PWS AOH process so they are FAR compliant.

PWS (version 16 June 2017) Paragraph 1.0 has been revised to remove conflicting language on CLIN types. The AOH CLINs and SITFOR CLINs shall follow the process in PWS paragraphs 1.4 and 3.1.14 and priced in accordance with Attachment 3 – Price Proposal Workbook and the CLIN structure established in the SF 1449.

Reference PWS 2.8.1 and Attachment #11 (Line items 1, 3, 4, 5, 38 to 50 inclusive, 77, 80 to 84 inclusive, 89, 93 and 94). PWS 2.8.1 states “The contractor shall bear all operations and maintenance labor costs associated with government furnished vehicles as listed in the Government Furnished Property attachment.” In order to properly estimate these maintenance costs to be included in the FFP CLINS, information is needed on each Line item (vehicle/heavy equipment/agricultural equipment) listed above.

Please provide for Attachment #11 (Line items 1, 3, 4, 5, 38 to 50 inclusive, 77, 80 to 84 inclusive, 8, 93 and 94) the current maintenance conditions, year of manufacture, year of acquisition on Melrose Range (by incumbent or prior incumbent is passed on), miles/hours on odometer/hour meters, any major assemblies replaced and when (engine, transmission, hydraulic pumps), any structural/frame damage and if repaired and when, and any warranties that may be in place with expiration dates

Attachment 11, Consolidated Government Furnished Property Listing (version 16 June 2017) has been revised to include manufacture years for the vehicles for which the Government has record of the manufacture dates. Full maintenance records will be provided to the awardee.

PWS 2.8.1

Reference PWS 2.8.1. PWS 2.8.1 states “Parts or maintenance not associated with routine maintenance as approved by the COR shall be provided by the Government.”

It is unclear what “not associated with routine maintenance” actually means. The way PWS 2.8.1 is written it seems to include preventive and corrective maintenance so it is confusing on exactly what the government defines as “not routine”. This is needed so we can properly price the maintenance in the FFP CLINS.

Please clarify what is meant by “not associated with routine maintenance”

PWS (version 16 June 2017) paragraph 2.8.1 has been revised to clarify the Government’s requirement. Sentence “Parts or maintenance not associated with routine maintenance as approved by the COR shall be provided by the Government.”

has been deleted and replaced with sentence “Parts, not associated with preventative maintenance or instances of abuse, will be provided by the Government.”

PWS 1.9 and PWS 1.9.4.4. PWS 1.9 states “provide a list of range key personnel (Site Manager, Alternate Site Manager, Quality Control Inspector, Ground Operations Foreman and Chief Range Control Officer (RCO))” yet PWS 1.9.4.4 states “Key Personnel: Program Manager and Alternate, Primary and Alternate Site Managers, Quality Control Inspector, Chief RCO, Ground Operations Foreman, Burn Boss”.

Also, the Proposal Pricing Workbook does not list either the Program Manager or the Alternate PM.

Which positions are considered key personnel?

PWS paragraphs 1.9 and 1.9.4.4 have been revised to correctly identify the key personnel: program manager, primary and alternate site managers, Quality Control Inspector, Chief RCO, Ground Operations Foreman and Burn Boss. The Government does not anticipate that the Program Manager work required under this contract will be a direct cost, however, offerors have the discretion to add labor categories of their choosing to CLINS X001, X002, X003, X004, and X008. Attachment #3 Price Proposal Workbook, RFP Section L Volume III 6.1.5.2.

Attachment #3 Price Proposal Workbook X001 Air and Ground Operations Support does not show two personnel listed in the PWS the Program Manager (PWS 1. & 1.9.4.4) and Alternate Program Manager (PWS 1.9.2). Also the Program Manager is cited as a key person. RFP Section L Volume III 6.1.5.2 states “Offerors must complete the Price Proposal Workbook as designed. Any attempt to reformat or remove cells is unauthorized and may be a reason to reject an offeror’s proposal.” It is unclear how we are to price the Program Manager given the restrictions of L.6.1.5.2

Please provide instruction on how to price the Program Manager in the Attachment #3 Price proposal Workbook.

The Government does not anticipate that the Program Manager work required under this contract will be a direct cost, however, offerors have the discretion to add labor categories of their choosing to CLINS X001, X002, X003, X004, and X008.

Attachment #3 Price Proposal Workbook, RFP Section L Volume III L.6.1.5.2.

Attachment #3 Price Proposal Workbook cell C8 shows 2080 hours but Column C is titled FBLR which we interpret as Fully Burdened Labor Rate. FBLR are multiplied by productive hours not the full 2080 potential hours in a year (52x5x8). Again RFP Section L Volume III L. 6.1.5.2 does not permit changing of prepopulated area done by the Government. Multiplying FBLB by 2080 overstates the proposed price.

Please address the issue of 2080 versus productive hours for multiplying by FBLR.

Answered in Amendment 03 Amendment 03 revises Attachment 3, Price Proposal Workbook (rev 01) to incorporate a change allowing for productive hours to be input by offerors. On the “TEP” tab, the column marked “Hours or Qty” has been revised from a “pre-determined value” of 2080 to a blank “Fill-in Field(s)” for labor categories associated with CLINs X001, X002, X003, X004, and X008. The “Instructions” tab has been updated to revise instruction #2 to include the requirement for offerors to provide productive hours for the labor categories/CMEs for CLINs X001, X002, X003, X004, and X008.

Attachment #3 Price Proposal Workbook, RFP Section L Volume III L.6.1.5.2.

Attachment #3 Price Proposal Workbook, cell A30 states “Wildland Fire Manager (CBA Firefighter)” this does not appear to be correct.

For cells A2 A30 please identify the correct CBA labor position you expect see priced out for the Wildland Fire Manager.

The requirement for wildland fire services in PWS paragraph 3.6 are performed by wildland fire management personnel who augment 27 SOCES/CEV firefighters. The current CBA refers to the job classifications associated with wildland fire services as “firefighter”, “senior fire fighter”, and “lieutenant”. Attachment 3, Price Proposal Workbook includes a reference to the CBA job classifications in order to clarify the equivalent labor category described in the PWS.

1.32 2.1.8

PWS 1.32 and PWS 2.1.8. PWS 1.32 states “The Government shall provide all hand and specialty tools required for the performance of this PWS.” Yet PWS 2.1.8 states “The contractor shall provide all management, tools, equipment, materials, transportation and labor necessary to ensure that pest management services…” These two SOW sections conflict as to who is providing tools.

Please clarify who is proving tools.

PWS (version 16 June 2017) paragraph 2.1.8 has been revised to clarify the Government’s requirement. The requirement to provide “tools, equipment, materials” has been deleted and sentence has been revised to state: "The contractor shall provide all management, transportation and labor necessary to ensure that pest management services are performed on MAFR in a manner that uses current Integrated Pest Management (IPM) techniques."

PWS 2.1.8

PWS 2.1.8 specifically states “The contractor shall have a New Mexico State Pesticide Applicators Certification License in the correct categories for the work being performed.” While this is specific, is it actually required that the prime contractor have the NM Pesticide Applicators certificate license if the work is done by a team member subcontractor or subcontracted vendor with a professional licenses NM Pest management firm.

If the prime subcontracts the pesticide application to a team mate or an outside private professional vendor must the prime still have the NM State License?

All work, including subcontracted services, is the responsibility of the prime contractor. The prime contractor shall ensure contractor established quality control measures are in place to provide qualified and certified personnel to perform all required services. IAW 52.212-1, Instructions to Offerors and PWS 1.7.1, the contractor shall submit with their proposal a management plan, sub-contractor, and/or team plan (when applicable) that validates employee qualifications and includes the certifications, licenses, and other qualifications necessary to accomplish services of the PWS, as well as a demonstration of how the offeror will maintain worker qualifications before expiration without oversight, additional cost , or intervention.

IAW PWS 4.4, the contractor is responsible for the development, implementation, and maintenance of a quality control inspection system that incorporates the contractor's Quality Control Plan and conforms to all the provisions of this contract and shall include as a minimum, the checklists and procedures to evaluate operations, maintenance and operator proficiency. Additionally, IAW PWS 1.9.4.8, the contractor shall make certifications available to the Government upon request.

CBA

CBA is underfunded

Will the Government please clarify the contractor’s financial responsibility, if any, with regards to an underfunded pension plan as referenced in the Union Pension Plan

Answered in Amendment 03 The Air Force does not have any knowledge of what the contractor’s financial responsibility would be should the pension plan become underfunded. That would be predicted and mandated under the Pension Protection Act regarding the establishment of a rehabilitation Plan in order to make the plan solvent.

Any pension surcharges mandated per a rehabilitation plan per the Pension Protection Act would not be reimbursed by the Air Force under an FFP contract since the Department of Labor does not deem a pension surcharge as a bona fide fringe benefit.

Nothing precludes a prospective offeror from contacting the union for such information since they are the ones administering the pension plan.

Answered in Amendment 03 As it relates to the incumbent contractor’s Health Insurance and other benefits, the Air Force does not have said information to provide since this is deemed as proprietary information. The Air Force is not required to request such information for bidding purposes unless the incumbent contractor has already voluntarily provided it. As it relates to the health insurance provided by the union, should employees opt out to the contractor’s provided insurance, the Air Force does not have said information to provide unless the incumbent contractor has already voluntarily provided it. However, nothing precludes any prospective offeror from contacting the union for such information since they are the ones administering the union’s Health Insurance and other benefits identified in Article 35 of the CBA.

Therefore, this should be accomplished for teaming partners if their efforts are part of the offeror's relevant past performance submitted for evaluation. A pamphlet or other commercial document describing such reorganizations may suffice.

The designated target complex is MAFR. The Government will not provide a number of target vehicles since the number fluctuates based on mission need. However, workload estimates in PWS Table 6 - TARGETS TO BE MAINTAINED/REPLACED, are based, in part, on the historical workload associated with movement of targets.
