Solicitation Questions Part I

Question 1.

Solicitation Document SF 1449; Page 29, Paragraph (f)(3)

This paragraph states that the Government will evaluate offers in accordance with the policies and procedures of FAR Part 25. FAR Part 25 applies 6% and 12% factors to items that are not from a qualifying country and therefore non-domestic items. On the other hand, DoD procurements subject to DFARS 225.502(c)(ii)(E) require that a 50% factor be applied to these same non-domestic items. Because solicitation FA4855-13-R-00017 cites FAR Part 25 to evaluate offers and not DFAR 225, please confirm what factor will be applied to all non-domestic items not originating from a qualifying country.

Also, please confirm that offered items originating from qualifying countries, allowed under

FAR 52.225-5 Trade Agreements, will not be applied any additional price factor.

Answer

Pursuant to FAR 25.105(a)(1) and DFARS 225.105(b), the government will apply a 50% factor to non-domestic items proposed.

Pursuant to FAR 25.105(a)(2), evaluation factors on DFARS 225.105(b) will not be applied to items originating from qualifying countries under FAR 52.225-5 Trade Agreements.

Question 2.

Solicitation Document SF 1449; Page 29, Paragraph 3, Factor 2-Price Evaluation

The second paragraph after the TOTAL EVALUATED PRICE table states, “substitutions are not acceptable for any items for this evaluation.” Consequently, Page 19 includes FAR Clause

52.211-6 Brand Name or Equal, which states or equal products meeting the requirement are acceptable. Also, Attachment 2, Fixed Price Listing, also includes several or equal statements within the item descriptions and manufacturer references. Please confirm that or equal products meeting the requirements of FAR 52.211-6 will be considered acceptable for evaluation and remove the statement referenced in the solicitation document that states substitute items will not be acceptable for this evaluation.

Substitutions will be accepted except for LI#88. RFP revised to remove the “substitutions are not acceptable for any items for this evaluation” language.

Question 3.

Solicitation Document SF 1449; Contract Line Item Numbers

CLINs X001 are "inclusive of (1) Contractor's fee for running COCESS, (2) New Mexico Gross

Receipts Tax, (3) Overhead and Profit." Pages 79 of the RFP states "The offeror shall submit complete pricing data for all items listed in Attachment 2... Each line item (LI) shall include all materials, labor, transportation, supervision, and other incidentals; administrative support; New

Mexico Gross Receipts Tax (NMGRT); overhead; and profit necessary to accomplish the work identified in the SOW."

Can the government please clarify where the price for NMGRT, overhead, and profit are to be calculated so they are not added twice in evaluation?

Each CLIN should be treated independent of each other. NMGRT, overhead, and profit must be applied to each CLIN separately. For instance, CLINs X001 should include price associated with providing support or managing the COCESS facility. This should include NMGRT, overhead, and profit for this portion of the contract only. CLINs X002 should be for all supplies and materials that will be purchased under this contract. NMGRT, overhead, and profit should be applied to this CLIN for supplies and materials only. CLINs X004 are for

Standby/Emergency Support. The hourly rate proposed for these CLINs must include the

NMGRT, overhead, and profit for Standby/Emergency Support only.

Question 4.

Attachment 01, SOW; Page 13, Paragraph 1.11.7

What counts as an equal to Tra-Ser Pro? Will the government please provide examples of an equal?

Government is still researching more information. Answer will be posted on FBO.

Question 5.

Attachment 01, SOW; Page 9, Paragraph 1.7.1

Does the Government or the Contractor purchase and own the Self Help tools?

Answer:

The government will purchase self-help tools for CE craftsman. Please be advised that Self-

Help program is limited to minor replacement items such as light bulbs/lamps, switch/receptacle covers, ceiling tiles, paint for an office, etc.

Question 6.

Attachment 2 – Fixed Price Listing Line 21 CSL AB564S "LAMP FLUORESCEN

MEDIUMBASE 120V" MAINTENANCE WAREHOUSE 313971

Maintenance Warehouse has been bought by HD Supply. The part number 313971 is no longer a good number for them. Please provide a manufacturers name and part number so offerors can accurately quote this line.

Attachment 2 – Fixed Price Listing has been updated. Substitutions are accepted unless otherwise noted. As such, the contractor may propose alternative to Line Item #21.

Question 7.

Fixed Price Listing

Will the Government please provide transaction data for the items in Attachment_2 for the previous two years?

The Government determined that historical data or transaction data past 2012 provides little or no value on future purchases in this contract. As such, the government will not provide additional transaction data for the items listed in Attachment 2.

Question 8.

Attachment 01, SOW; Page 2, Paragraph 1.3.16.5 & Page 3, Paragraph 1.5.1

In paragraph 1.3.16.5, the Government states, “Issue / sell bench stock materials to CE craftsmen using the CEMAS computer system.” Then, in paragraph 1.5.1 the Government states, “Planning and final abstracts created thru CEMAS will be used for ordering or purchasing materials. However, the Government reserves the right to convert from CEMAS to contractor’s on-line ordering system when deemed better or beneficial to the Government.”

Please confirm that the Government intends to require the contractor to manage orders being received from both the Government CEMAS ordering software as well as the

Contractor’s on-line ordering system.

Yes. The Government intends to require the contractor to manage orders from the Government

CEMAS ordering software and the Contractor’s on-line ordering system.

Question 9.

Attachment 01, SOW; Page 8, Paragraph 1.7.1

The Government states, “The contractor shall use the inventory management system of their choice and CEMAS to maintain the inventory of all store-stocked items sold to the government.” The Contractor’s understanding is that the government would like a complete inventory maintained on two inventory management software systems. Please confirm that the contract requirement will be for the Contractor to maintain store stocked item inventories on both CEMAS and the Contractor inventory software system.

The government requires the contractor to maintain their inventory in our CEMAS computer system. All issues/sales will be processed within CEMAS. Maintaining an inventory within the contractor’s computer system is at the contractor’s discretion; however, it would probably be advantageous for them to do so.

Please clarify if the Attachment 3 forms fulfill the requirement for Past Performance or if they are in addition to the information listed in
