SECTION L

Section L - Instrs., Conds., and Notices to Offerors

INSTRUCTIONS TO OFFERORS

I. General Instructions:

A. This Solicitation is a HubZone Set-Aside.

B. Provide an electronic copy via email of your proposal and all information required by this RFP to Contract Personnel. Please title your email subject line: Extend Boardwalk at NCO Beach - FA481924R0020

Questions and Answers are due on 23 July 2024 at 1:00 PM, CST. Proposals are due no later than 8 August 2024 at 2:00 PM, CST. Recommend all offerors (via telephone call to appropriate Government POC) confirm receipt of all emailed proposals and revisions. Ensure you acknowledge all amendments in your proposal.

C. Site Visit Details

Date: 16 July 2024 Time: 1000 Location: Visitor's Center Parking Lot, Tyndall AFB, FL

Directions: Each Prime Contractor is allowed to bring two personnel. Contractors shall provide the names of who will be attending the site visit no later than 12 July 2024, 4:00 PM CST by filling out Attachment 6 Base Access Request EAL and sending to all Points of Contact listed above. Interested contractors will be limited to two (2) personnel, shall wear an appropriate face mask, and adhere to social distancing and CDC guidelines.

L-1 PROPOSAL PREPARATION INSTRUCTIONS

A. To assure timely and equitable evaluation of the proposal follow the instructions contained herein. Your proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation.

Alternate proposals will not be accepted.

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness of the price.

C. Format for proposal shall be as follows:

1. Electronic Copy Please submit your proposal via email. Covers for tables of contents, indices, title pages, cross reference indices, and section dividers/tables will not be included in the page count if they are inserted solely to provide ease to the reader in locating volumes/sections of the proposal. They will be counted if they contain any other information, (e.g. diagrams, extraneous data, etc). Pages marked "This page intentionally left blank" will not be counted.

Distributed material will be identified as source selection sensitive and distribution will be strictly limited to appropriate personnel. Should you object to your proprietary information being shared between source selection evaluators and advisors via commercial email as described above, please advise Contracting Personnel using the contact information above.

2. Type face shall not be less than 12 font, with 1" margins on all sides. Smaller, legible font size, no smaller than 6 point, may be used for charts and tables.

3. Elaborate formats or color presentations are not desired or required.

4. Electronic copies shall be searchable documents.

5. Documents submitted in response to this solicitation must be fully responsive to and consistent with the following:

a. Requirements of the solicitation, and government standards and regulations pertaining to the specification.

b. Evaluation Factors for Award in Section M of this solicitation.

c. Any limitation on the number of proposal pages. Pages exceeding the page limitations set forth in this Section L will be removed from the proposal and not read or evaluated.

6. The estimated magnitude of construction for this project is between $250,000 and $500,000.

7. Specific Instructions: Documents submitted in response to this RFP must be fully responsive to and consistent with the following:

I. Volume Organization

A. General: Proposals shall be submitted to the Government in 4 separate volumes (PDF Attachments) as set forth below. Be sure to label your proposal to match the volumes and sub-sections as listed in the chart below.

*Excess pages will not be evaluated.

In addition to the page limitations set forth above, proposal volumes shall comply with the following format:

1. Offerors shall prepare their proposal as set forth in table above. The titles and contents are defined in the above table, all of which shall be within the required page limits and with the number of copies as specified in the table. The contents of each proposal are described in the following paragraphs. In the event that this table conflicts with the detailed instructions in the paragraphs that follow, the detailed instructions shall take precedence.

2. In using mail or hand carry, the sealed package used to submit the proposal package must show the time and date specified for receipt. Each volume shall be marked with the RFP number and the offeror's name and address, and the number of the Volume, i.e. I, II, III, etc. Proposals shall be in the English language and all monies shall be proposed in United States dollars.

3. Print shall be no smaller than a font size of 12 and should be on 8 1/2 x 11 inch paper, excluding any charts, graphs, drawings, diagrams, supporting illustrations, or spreadsheets, etc. Charts, graphs, drawings, diagrams, supporting illustrations, spreadsheets, etc., shall not be greater than 11" x 17". Each volume within the proposal shall be separately tabbed and identified. Tabs are not counted towards the page limitations, however any content on the tabs will not be evaluated. Blank pages will not be counted. Margins shall be no smaller than 1 inch and each page within a volume shall be numbered consecutively. Elaborate formats, bindings or color presentations are not desired or required.

4. The page limitation includes any cover page, charts, graphs, drawings, diagrams, supporting illustrations, spreadsheets, etc., but excludes any table of contents or list of acronyms (if utilized). Offerors are cautioned that any pages that exceed the page limitations shall not be read but shall be removed and either retained in the contract file without being considered in the evaluation, or, sent back to the offeror.

5. Page limitations may be placed on responses to Evaluation Notices (ENs), if issued. The specified page limits for EN responses will be identified in the letters forwarding the ENs to offerors or on the EN form itself.

6. Each page containing proprietary information should be so marked.

7. Each page should contain the following legend at the bottom of each sheet:

8. Submission of one electronic copy of the initial proposal packages is required via email, DOD SAFE, mailed, or hand-delivered. In order to submit a package through DoD SAFE, the offeror must contact SSgt Benjamin Spear at benjamin.spear.1@us.af.mil for a drop-off link at least four (4) hours prior to the time proposals are due. CONTRACTORS SHOULD VERIFY VIA PHONE THAT THEIR PROPOSAL IS RECEIVED ON TIME. Offerors are cautioned that Tyndall AFB has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. Some delay should be anticipated when hand- delivering proposal packages. Offerors should allow for sufficient time to obtain a visitor pass and arrive at the specified office PRIOR to the time specified for receipt of proposals.

B. Specific Instructions: Documents submitted in response to this RFP must be fully responsive to and consistent with the following.

I. Volume I: RFP

a. Cover Letter: Provide a cover letter that briefly describes your company and how this solicitation fits within your company’s area of expertise. Be sure to include the following:

i. Company Overview

ii. Address

iii. CAGE code

iv. UEI code

v. Size of Business to include any and all social economic categories

vi. List of Authorized Personnel w/ contact information

b. List of Exceptions: If applicable, provide a detailed list of exceptions from the SF1442, SOW, attachments, etc. Each exception should identify what the exception is, the part/section of the RFP the exception is referencing, and the rationale of why the exception is needed.

c. SF 1442: Submit a completed RFP consisting of the completed and signed RFP, to include any amendments issued, with a cover letter delineating any exceptions taken to the RFP terms and conditions with accompanying rationale. However, offerors are cautioned that any noncompliance with the terms and conditions of the RFP may cause their proposal to be determined unacceptable and therefore not considered eligible for award. Offerors shall ensure that all clauses and provisions that require “fill in” information are appropriately completed, including the proposed prices associated with the contract line items in the Schedule of the RFP.

d. Completed Financial Responsibility Questionnaire (Attachment 10)

II. Volume II – Past Experience

a. Past Experience: Provide three (3) examples of completing recent and relevant projects. Recent is defined as a completed project within the last five (5) years. Relevant is defined as work in concrete, sidewalks, general carpentry, piers, docks, or similar work.

Include at a minimum:

i. Overview of the SOW

ii. Awarded dollar amount

iii. Final amount at completion

iv. Date of award, period of performance, date of final acceptance.

v. Copy of the final inspection sheet showing completion of the project.

vi. Awarding Agency’s point of contact (name, e-mail address, and phone number)

III. Volume III – Technical

a. Qualifications (Sub-Factor 1)

i. Quality Control Manager

1. Must have a minimum of five (5) years’ experience in construction with at least two (2) years as a Quality Control Manager (CQCM) on project similar to the relevancy of the required project. Must hold a current certificate of the USACE/NAVFAC Construction Quality Management for Contractors program.

Must demonstrate the familiarity with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance, to include successful completion of the OSHA 10-hour Training Course within the past three

(3) years.

ii. Superintendent

1. Must have a minimum of five (5) years’ experience in construction with at least two (2) years of those years as a superintendent on projects similar to the relevancy of the required project. Must demonstrate the familiarity with the requirements of EM 385-1-1 and have experience in the areas of hazard identification and safety compliance, to include successful completion of the OSHA 10-hour Training Course within the past three (3) years.

iii. Program/Project Manager

1. The contractor's Program/Project Manager shall have as a minimum at least five

(5) years’ experience managing construction projects. The PM is the primary POC for the CO or all contractual issues with regards to project/program execution and is responsible for the overall management of this contract. The PM is to ensure that qualified personnel and subcontractors are assigned to complete performance. It is the PM's responsibility to ensure that contractor personnel and subcontractors possess the appropriate qualifications and experience to complete specified project tasks and that they comply with all statutes, regulations, as well as the contract requirements. The PM shall have and provide to CO, upon request, all required employee or subcontractor certifications and qualifications.

iv. Designer of Record (DOR)

1. Identify the architectural and/or engineering firm that will work on the design, calculations, and drafting of the plans, certify that all construction submittals meet the specifications, and validate, and certify the as-builts.

b. Technical Proposal (Sub-Factor 2)

i. Submit a narrative of the Offeror's understanding of this project. The narrative should not simply rephrase or restate the Government's requirements, but rather provide convincing rationale to address how the Offeror intends to meet these requirements. Where appropriate, specific examples of an Offeror's processes may be used to demonstrate how the Offeror will meet the Government's requirement. Offerors shall assume the Government has no prior knowledge of the Offeror's experience or capability and will base the Government's evaluation on the information presented in the Offeror's proposal.

Statements that the Offeror will provide a particular feature or objective without explaining how the Offeror proposes to meet that feature or objective are generally inadequate and may adversely impact the Government's evaluation of the Offeror.

1. Included in this sub-factor be sure to include the following at a minimum.

a. Plans to work around/through weather delays

b. List of projected subcontractors with their anticipated percentage of work compared to the whole project. Reference Limitations of Subcontracting Clause. Ex. Subcontractor A will complete 23% of this project.

c. List of permits required to include but not limited to state, federal, local, environmental, etc.

d. Identify long lead time materials

2. While not all inclusive, the following types of statements are considered inadequate:

a. Unsupported statements that the Offeror allegedly understands the requirements.

b. Unsupported statements that the Offeror allegedly can or will comply with requirements.

c. Unsupported statements that simply paraphrase the requirements.

d. Undefined or unexplained statements such as "best commercial practices will be used."

e. Undefined or unexplained statements such as "standard procedures will be used."

f. Undefined or unexplained statements such as "well-known techniques will be employed."

c. Project Schedule (Sub-Factor 3)

i. Project Schedule (AF Form 3064)

1. Provide a brief narrative of your thought process of completing the SOW within the period of performance of 360 days. Include project phasing and long lead time items.

2. Complete the attached AF Form 3064. Include the following at a minimum:

a. Identification of separate work elements including DOR.

b. Order of work elements to include project phasing (critical path)

c. Number of days for each work element

d. Incorporation of long lead time materials

IV. Volume IV - Pricing

a. Submit a completed Division Cost Estimate Worksheet (Attachment 10). Contractor should accurately reflect the cost of this project within the correct work division. Total cost should equal the amount listed in Section B of the SF 1442.

b. Provide a list of assumptions that was used to formulate the costs listed in Attachment 10.

SECTION M

I. Basis for Contract Award:

A. Source Selection Methodology: This acquisition will utilize the Lowest Price Technically Acceptable (LPTA) source selection procedure in accordance with FAR 15.101-2 and 15.3. The Government intends to award one contract as a result of this solicitation. The Government will conduct technical evaluations beginning with the lowest priced responsive proposal. If the lowest priced responsive proposal is determined to be technically acceptable, evaluations will continue until, at a minimum, two technically acceptable proposals are identified, but no more than three. If the lowest priced is found unacceptable, then the next lowest priced responsive proposal will be evaluated. Offerors are reminded that the Government will only evaluate one proposal from each offeror. Award will be made to the responsible offeror whose proposal is technically acceptable, conforms to all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements based on the results of the evaluation described in paragraph II below.

B. General: By submission of its proposal in accordance with instructions provided in Section L - Instructions to

Offerors, the Offeror agrees to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or sub-factors. All proposals with acceptable non-priced factors shall be treated equally except for the respective prices. Proposals that fail to strictly comply with Section L, Instructions to Offerors, may be determined unresponsive and therefore ineligible for award.

C. Discussions: The Government intends to award without discussions but reserves the right to conduct discussions if determined necessary. Any discussions will be conducted in accordance with FAR 15.306.

II. Proposal Evaluation: The evaluation process will be accomplished as follows (Organized by Volume):

A. Proposals will be evaluated using (3) evaluation factors: (1) Past Experience, (2) Technical and (3) Cost/Price.

The past experience and technical factors will receive either an acceptable or unacceptable factor rating.

B. Technical Ratings: Each offeror's written technical proposal shall be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of those requirements. The offeror's proposal shall be evaluated to determine whether the proposal is acceptable or unacceptable, using the ratings and descriptions outlined in the table below. One technical rating will be assigned to each technical subfactor. In order to be considered awardable, there must be an "acceptable" rating in every subfactor.

C. Past Experience: The past experience assessment will assess the offeror's/joint venture members' ability to successfully accomplish the proposed effort based on the offeror's demonstrated present and past work record.

Technical Acceptable/Unacceptable Ratings:

Adjectival Rating Description

Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

III. Evaluation Factors

The following evaluation factors will be used to evaluate each proposal: Award will be made to Lowest Price, Technically Acceptable proposal based upon an integrated assessment of the evaluation factors described below.

No award will be made to an offeror who has received an unsatisfactory rating in any factor or subfactor.

Factor 1: Past Experience Factor 2: Technical Sub-factor 1: Qualifications Sub-factor 2: Technical Sub-factor 3: Project Schedule Factor 3: Cost/Price

In accordance with FAR 15.304(e), all evaluation factors other than Cost/Price, when combined, are approximately equal to cost or price.

I. Volume I

a. The information submitted within Volume I will be reviewed for accuracy to ensure the contractor has filled in the required information on the SF1442, representations and certifications are current, to validate any exceptions, and the Financial Responsibility Questionnaire is completed.

II. Volume II - Past Experience

a. Evaluation Process: The past experience evaluation considers each offeror's demonstrated recent and relevant record of performance in supplying products and services that meet the contract's requirements.

i. Recency Assessment: An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past five (5) years from the issuance month of this solicitation. Past experience information that fails this condition will not be evaluated.

ii. Relevancy Assessment: The Government will conduct an in-depth evaluation of all recent performance information obtained to determine how closely the products provided/services performed under those contracts relate to the Technical factors. Technical acceptability will consider work involving concrete, sidewalks, general carpentry, piers, docks, or similar work.

III. Volume III - Technical

a. Qualifications (Sub-Factor 1): Sub-factor 1 will be considered acceptable when the proposal documents that the minimum qualifications have been met by the Superintendent, Program/Project manager, and the A&E firm.

b. Technical Proposal (Sub-Factor 2): Sub-factor 2 will be considered acceptable when the proposal demonstrates sufficient understanding of all aspects of the SOW, can show a full grasp of the government's needs, provides a sound solution to meet the government's needs, and considers weather delays, long lead time items, etc.

c. Project Schedule (Sub-Factor 3): Sub-factor 3 will be considered acceptable when the proposal provides a comprehensive project schedule, taking into consideration design/construction time, all applicable work elements, long lead time items, etc., and completes the schedule within the government's period of performance.

IV. Volume 4 - Pricing

a. The offeror's Cost/Price proposal will be evaluated to ensure it is reasonable, pursuant to FAR 15.404.
