PERFORMANCE WORK STATEMENT FOR
FA4819-19-Q-6050 FOR
BULK MULCH/ CONSTRUCTION AND DEMOLITION (C&D) DISPOSAL SERVICES AT TYNDALL AFB, FL
11 Dec 2018
1.0 INTRODUCTION
The disposal of vegetative (mulched) and construction/demolition debris at Tyndall Air Force Base (AFB) is required as a result of the destruction caused by Hurricane Michael.
2.0 SCOPE OF WORK
2.1 SCOPE & APPLICABLE DOCUMENTS
The contractor shall provide debris disposal services at Tyndall AFB, Florida IAW this PWS.
2.2 DESCRIPTION OF WORK
The Contractor shall implement the following tasks and meet the specifications for the completion of this project:
A) Load and transport Not To Exceed (NTE) 100,000 cubic yards of organic mulch from Tyndall AFB to the nearest regulated landfill or legally approved site that will accept the product for disposal.
B) Load and transport NTE 50,000 cubic yards of Construction and Demolition (C&D) debris from Tyndall AFB to the nearest regulated landfill that will accept the debris for disposal. This does not include metals which have been identified by the 325th Civil Engineering Squadron as recyclable material.
C) Provide the CO and/or COR with all bills of lading, weight tickets and landfill receipts verifying at a minimum; location name, location address, quantity of disposal, and type of debris disposed. These documents are required to accompany all invoices to substantiate the disposal services completed under this contract. The contractor's failure to provide these documents with their associated invoices for work complete will result in non-payment for services. The contractor shall not surpass the NTE amounts of 100,000 cubic yards of vegetative debris and 50,000 cubic yards of C&D debris.
2.3 WORK PHASE
The 325th Contracting Squadron will host a pre-performance meeting with the contractor to approve hauling routes, dates and times. Upon the approval of the Contracting Officer, the contractor may commence loading and hauling debris from Tyndall AFB, FL.
2.3.1 On-Site Field Oversight Requirements
The Contractor shall provide all manpower, equipment, material, services, and transportation necessary to ensure oversight services throughout accomplishment of this contract. It is the responsibility of the Contractor to establish and maintain open communications between the Contracting Officer and Contracting Officer’s Representative (COR) throughout performance of this contract.
2.3.2 Debris Load Monitoring
The Contractor shall provide independent third party debris load monitoring for tracking and verification of the debris removed from Tyndall Air Force Base. The independent third party shall provide the government with a signed certification of independent and unbiased performance of debris monitoring and documentation requirements of this effort. The debris load monitoring shall comply with the FEMA Public Assistance Debris Monitoring Guide, FEMA 327 October 2010 or latest revision. Electronic load tickets shall be submitted to the Contracting Officer and Contracting Officer’s Representative by noon the following day.
3.0 QUALIFIED PERSONNEL
The Contractor shall ensure that only qualified and competent personnel carry out the tasks outlined in this PWS. Competent is defined as registered professional or, where registration is not applicable, trained, and/or certified in their respective field. Exceptions are administrative and support personnel who participate in document publication.
3.1 DEBRIS DISPOSAL REQUIREMENTS
3.1.1 All work that is specified under this contract shall comply with applicable federal, state, and local statutes/standards; Air Force Standards, military instructions, manuals, handbooks, regulations, guidance, and policy letters; Tyndall Air Force Base Safety, Environmental Protection and FDEP Regulations and Codes. It is the Contractor’s responsibility to identify and comply with all applicable requirements.
3.1.2 The Contractor shall comply with the requirement of Florida Department of Environmental Protection Emergency Final Order, OGC No. 18-1335 Emergency Authorization for Repairs, Replacement, Restoration and Certain Other Measures Made Necessary by Hurricane Michael, dated/signed on 8 Oct 2018. (See Attachment 3 – Emergency Final Order OGC No. 18-1335 dated 8 Oct 2018).
3.2.2 Any damage to grounds, infrastructure, utilities, communication network, etc. caused by the contractor shall be restored to pre-existing conditions at no cost to the Government.
3.2.3 The contractor shall provide accurate, on-time submittals of all contract deliverables and timely identification and solution of impediments to successful project execution.
3.2.4 This work includes furnishing all labor, materials, transportation, tools, equipment, and supervision needed to satisfy this requirement. The Contractor shall field verify pre- existing conditions.
3.2.5 The contractor shall invite the COR, Base Civil Engineer (BCE) representatives, CORA, CO and any other organizations interested in advance, to participate in all acceptance inspections. The COR will coordinate the final acceptance inspection with the contractor.
4.0 GENERAL INFORMATION
4.0.1 The 325th Civil Engineering Squadron will advise the Contractor of the location and processes to obtain Personnel identification badges, vehicle passes, and/or entry permits.
4.0.2 Contractor truck access to and departure from Tyndall AFB will be limited to the Commercial Entry Gate between the hours of 0600 and 1800 seven days a week.
4.1. SECURITY
4.1.1. SUITABILITY INVESTIGATIONS.
4.1.1.1 Personnel working in a government facility for less than 6 months or working anywhere on Tyndall AFB property are required to have a Local Files Check. The Unit Security Manager will coordinate the Background Affidavit (with Pass & ID) and DBIDS Application– allow 3-5 day process time. A favorable local files check is required to be granted base access. All contracts prohibit hiring of illegal aliens for base duties and corrective/punitive actions can be taken when violations occur (AFI 63-113, ACC Sup).
4.1.2. PASS AND IDENTIFICATION ITEMS. The contractor shall ensure the following pass and identification items required for contract performance are obtained for employees and non-government owned vehicles:
a. DBIDS, Defense Biometrics Identification System - Contractor Identification Card. Process a DBIDS Application to obtain a DBIDS contractor ID card (If no network access is required). A DBIDS contractor ID card is required for performance on the installation in a contractor capacity, regardless of alternate base access forms of identification (ex: retired military ID).
b. AF Form 75, Visitor/Vehicle Pass (AFI 31-204): The contractor shall adhere to local security policy when applying for short/long term visitors’ passes. Any contractor requesting a pass for more than 3 days will complete a Local Files Check with 325 SFS/Pass & ID. Vehicle passes (personal vehicles) are no longer required.
4.1.3. RETRIEVING IDENTIFICATION MEDIA. The contractor shall retrieve all identification media from employees who depart for any reason before the contract expires; e.g., terminated for cause, retirement and submit them to the COR.
4.2 PERMITS, LICENSES AND CERTIFICATIONS
Unless otherwise specified in this contract, obtain necessary permits, licenses, and certifications; give all required notices; and comply with applicable Federal, State, County, and local laws, codes, and regulations in performance of the requirements of this contract. Maintain records of such requirements and make the documentation available to the Government for review.
4.3 HOURS OF OPERATION
Perform grounds maintenance services during normal duty hours which are 6:00 am to 6:00 pm, Sunday through Saturday, excluding federal holidays, unless otherwise required in the contract or approved by the CO or COR. There may be situations that require the contractor to work at times other than normal working hours. When the contractor’s work schedule conflicts with an Air Force mission requirement, advise the CO or COR and reschedule the work to minimize disruption.
4.4 RECOGNIZED HOLIDAYS.
The contractor is not required to provide service on federal holidays, except in emergency situations; the holidays are:

If these holidays fall on Saturday, the preceding Friday will be observed. If these holidays fall on Sunday, the following Monday will be observed. If a holiday falls on a scheduled service day, the Contractor will be responsible for rescheduling services for the first day post the holiday observance.
4.4.1 BASE CLOSURES
Work scheduled but not accomplished because of base closure due to weather, exercises, or actual alert, will be accomplished as soon as possible after reopening the base.
4.5 SECURITY REQUIREMENTS
Security and base access requirements are contained in clause 5352.242-9000 “Contractor Access to Air Force Installations.” Contractor employees will be required to obtain and display identification badges. Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base. Procedures for commercial vehicle access to the base are subject to change without prior notice.
4.6 PERFORMANCE OF SERVICE DURING CRISIS OR HEIGHTENED SECURITY
In the event of crisis or heightened security caused by a national emergency, natural disaster, or other causes, continue performance as necessary in support of the Air Force mission. The contract price and delivery schedule may be adjusted to reflect any change of work that may be directed.
4.7 SPECIAL QUALIFICATIONS
The contractor shall provide the name and telephone number of the Contractor’s on-site contract manager and alternate responsible for all requirements in the PWS. Provide telephone numbers of contractor manager and alternate(s) for after duty hours. The contract manager and alternate(s) must be able to read, write, speak and understand English, or an interpreter must be provided to work alongside the contract manager or alternate(s) at no additional cost to the Government.
4.8 INTERFACES
Do not unduly interfere with regularly scheduled Government operational activities in the performance of contract requirements. In the event a Government supervisor so requests, temporarily cease work in the area and report the instructions, to include name of the Government person involved, to the CO immediately by the most expedient means. Notify the CO verbally of disputes with customers or other base contractors and follow-up in writing.
4.9 CONTRACTING OFFICER AND CONTRACTING OFFICER REPRESENTATIVE (QUALITY ASSURANCE PERSONNEL)
The Contracting Officer will appoint a primary and alternate representative for management of the day to day activities of the contract. The identity, title, and authority of this representative will be provided in writing to the contractor after contact award.
5.0 FINAL INSPECTION
The contractor shall conduct a final inspection with Government personnel and publish the findings in a final inspection report.
6.0 PERIOD OF PERFORMANCE
22 December 2018 through 21 February 2019
7.0 CONTRACT ADMINISTRATION / POINTS OF CONTACT
7.1 The Contracting Officer will be assigned upon contract award.
7.2 The Contracting Officer Representative will be assigned upon contract award.
7.3 The Contractor shall dispose of all debris off of Tyndall AFB property at a State of Florida approved site.
8.0 ENVIRONMENTAL REQUIREMENTS.
8.1 ENVIRONMENTAL LAWS AND REGULATIONS COMPLIANCE
The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws and permits, and DOD, Air Force, Major Command (MAJCOM), and Tyndall AFB environmental regulations, policies, and guidance. The Contractor shall establish policies and procedures to protect the health and safety of personnel using, living, or working on properties under the jurisdiction of Tyndall AFB and minimize or eliminate risks of environmental pollution. Contractor facilities and operations are subject to environmental compliance inspections without notice.
8.2 ENVIRONMENTAL SPILL PROCEDURES.
The Contractor will report and manage releases/spills of hazardous materials in accordance with applicable federal, state, and local laws and the Tyndall AFB Hazardous Material Emergency Planning and Response Plan (HAZMAT plan). The Contractor shall be responsible for cleanup and all costs associated with any spills from its operations and equipment. The Contractor shall immediately notify the COR(283-3074) and the installation environmental office (283-2398/2493) of any spills in order to assure that spills are properly cleaned up and disposed of. Copies of all manifests and/or shipping papers shall be provided to the government for approval prior to removing wastes from Tyndall AFB.
8.3 HAZARDAOUS WASTE/MATERIAL MANAGEMENT.
The Contractor shall manage the collection and disposal of hazardous wastes the Contractor generates on Tyndall AFB properties in accordance with applicable federal, state, and local laws and the Tyndall AFB Hazardous Waste Management Plan. The Contractor shall be responsible for the proper disposal and costs of proper disposal in accordance with 40 CFR 261-279. Copies of all manifests and/or shipping papers shall be provided to the government for approval and signature by the 325 CES/CEIE, prior to removing wastes from Tyndall AFB. The Contractor shall obtain an EPA ID number from Tyndall AFB as a generator of hazardous waste. FDEP also requires transporters of used oils to obtain a permit to transport Florida Administrative Code, Chapter 62-710, Used Oil Management. The Contractor shall provide training to its employees in accordance with 40 CFR 265.16, in the proper management of hazardous waste and special wastes. The Contractor shall provide the government with a copy of its action plan on how hazardous wastes and materials will be managed and how training will be provided to its employees. Hazardous waste and used oil storage areas will be approved by the 325 CES/CEIE and will be inspected without notice. Deficiencies identified will be corrected within twenty-four (24) hours after being notified.
8.4 ENVIRONMENTAL POLLUTION PREVENTION.
The Contractor shall perform all work so as to minimize environmental pollution or degradation of the environment or natural/cultural resources. When refueling equipment or performing maintenance on equipment, the contractor shall ensure such operations are conducted on an impervious surface (e.g. concrete pad) to prevent soil contamination in the event of a spill. Any storage tank placed on site for refueling equipment should comply with Florida Administrative Code, Chapter 62-761. Open burning or burial of materials on base properties is prohibited.
8.5 ENVIRONMENTAL MANAGEMENT SYSTEM
The following is a standard EMS awareness clause that is included in all contracts issued by the Base:
8.5.1 TAFB has implemented an Environmental Management System (EMS), which is based on ISO-14001, and is concerned about environmental issues. TAFB desires to conduct its business operations in an environmentally sound manner. Relevant significant aspects will be communicated to contractors (including those used for outsourcing) and suppliers through the bid package where applicable. TAFB expects its suppliers and contractors to provide, at the same quality and price, products and services that have the least environmental consequence of all available options.
8.5.2 Wherever possible, where a supplier's product is causing a significant environmental aspect at TAFB, TAFB will communicate to that supplier that they should select the available option that minimizes the potential environmental impact of that product. Any contractor with plans to be working six months or longer at TAFB must receive EMS awareness training and information on operational controls where applicable. This training is thirty minutes in duration and will be provided by TAFB. A copy of the TAFB Environmental Policy can be viewed on the Public Website via the Internet.
8.6. SAFETY
The Contractor shall comply with all federal Occupational Safety and Health Act (OSHA) requirements and standards as published in the 29 Code of Federal Regulations (CFR). Additionally, the Contractor will comply with Air Force Occupational Safety and Health (AFOSH) standards, along with installation safety and health requirements. The CO, COR, Base Civil Engineer or designated representative, ground safety and security police may issue an order to the Contractor or employees to stop all or part of the Contractor’s work until all violations are corrected. Bioenvironmental engineering personnel, who notice violation of OSHA, AFOSH, or local standards, will notify the COR who has the authority to stop all or part of the Contractor’s work. No part of the time lost during a stop work order shall be allowed to be the subject of a claim by the Contractor for time and money compensation. Contractor shall not be excused from unsatisfactory performance that may result from a stop work order. Provide a verbal report to the CO or COR as soon as possible of each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. Provide a completed copy of required Accident Investigation Reports to the CO within five calendar days of each occurrence.
