FLOORING IDIQ, MacDill AFB, FL

Attachment 6 Green Building Procurement Requirements

PART 1

GENERAL

The intent of this section is to increase the awareness of all Sub-Contractors as to the availability of products manufactured from, or that contain recycled materials, thereby increasing the use of these products in the construction of this project.

The various sections of the specifications contain references to new products purchased for the construction of this project. The Sub-Contractor shall use of the maximum practicable amount of recovered materials consistent with the performance requirements, availability, price reasonableness, and cost-effectiveness. It is the Sub-Contractors, equipment suppliers, and material suppliers’ responsibility for final determination of products that comply with this specification. Recycled products shall be used wherever possible subject to the exemptions as per the paragraph entitled 5. Exemptions. Substitution of recycled materials or recycled products for specified products are subject to the provisions of the paragraph entitled 6. Submittals.

1. It is the policy of MacDill AFB to purchase environmentally preferable products and services to the greatest extent possible. This means favoring products that have a lesser or reduced effect on human health and the environment when considering raw materials acquisition, production, manufacturing, packaging, distribution, reuse, operation, maintenance and disposal of the product.

2. Sub-contractors must comply with mandatory federal purchasing requirements in the following categories: recycled content products, energy and water efficiency, biobased products, non-ozone depleting substances and EPA priority chemicals.

3. Provided in Section 2 is a lists products and percentage of recovered content that are covered under this specification.

Although these exemption criteria apply to all items, written documentation is required when claiming an exemption for products on EPA’s Comprehensive Procurement Guidelines list (recovered/recycled materials).

4.

Sub-Contractor Responsibility A. For contracts under $100,000 the compliance with this specification shall be performance-based. Sub-Contractor shall certify that the percentage of recovered product content used in the performance of the contract will be at least the amount shown in Section 2. The Sub-Contractor is required to complete a certification of compliance with respect to the work and products being provided.

B. If the project is over $100,000 then the Sub-Contractor is required to submit product data showing compliance with CPG standards in addition to submitting the certification of compliance. The products that require submittal are provided in Part 2.

C. The Sub-Contractor is responsible for insuring all of their sub-contractors comply with this order. Each Sub-Contractor shall provide written documentation to support their decision not to acquire items meeting the minimum content levels. This documentation shall be forwarded to the Contracting Officer for review and approval. In the event the documentation fails to support the Sub-Contractor's findings, the Contracting Officer's Representative shall return the documentation to the Sub-Contractor citing the reason(s) for disapproval. The Sub-Contractor shall resubmit and address the deficiencies.

5.

Exemptions

The U.S. EPA recommends minimum content levels for those items listed at the end of this attachment. These levels are mandatory for Air Force procurements unless one of the following exemptions applies:

A.

The product is not available from a sufficient number of sources to maintain a satisfactory level of competition (i.e., available from two or more sources).

B.

The product is not available within a reasonable period of time.

C.

The product does not meet the performance standards in applicable specifications or fails to meet reasonable performance standards of the procuring agency.

D.

The product is not available at a reasonable price. For Air Force purposes, "unreasonable price" is defined as follows: If the price of the recycled-content product exceeds the cost of a non-recycled item, then the price is considered unreasonable.

6. Submittals

Approval is required for submittals shown below:

Product Data - The Sub-Contractor shall submit manufacturer's material specifications, installation instructions, physical characteristics, etc, to show that the product meets project and specification requirements.

Product Certificates – The Sub-Contractor shall submit documentation certifying that products meet or exceed the specified requirements.

PART 2
