The Agency has received several questions regarding the Service Contract Act wage rates applicable to this contract. To clarify the Government’s previous response……

The awardee will be required to compensate its employees in accordance with the Service Contract Act. Wage Determination CBA-2016-9071 applies to the contract and dictates minimum wages payable. While the CBA may expire on August 31, 2019, it is not guaranteed to expire, and, therefore, offerors should submit their proposals with the understanding that the CBA applies to the entire period of performance. Pursuant to the clause at FAR 52.222-43(b), contractors will be required to warrant that the proposed prices do not include any allowances to cover increased costs as a result of anticipated wage determination adjustments. If the CBA WD does expire or change, contractors may be entitled to a price adjustment pursuant to the clause at FAR 52.222-43.

RFP: FAR 52.212-1

We understand that the Page Numbering of our proposal is to be sequential. Does the government intend that each volume is to be sequentially numbered or are all volumes to be sequentially numbered starting with Volume I and ending with Volume III?

Offerors shall not continue with pages previous the previous volume. See Proposal instructions in Addendum to FAR 52.212-1, pg. 69 of the RFP.

PWS para 6.1. Please provide Section 6.1 of the PWS as of 19 October 2017. It appears to be missing from the final document.

Corrected. Section 6 was deleted from the 12 December 2017 PWS version.

RFP: Amendment 1 - Para 5.5. Should the Executive Summary be placed before or after the Table of Contents in Volume II – Technical?

The Executive Summary may be placed either before or after the Table of Contents in Volume II – Technical.

RFP: Amendment 1 - Para 2.1. Will the Government send read receipts to offerors via email upon receipt of emailed proposals?

Yes. However, It is the offeror’s responsibility to confirm receipt of all formal communications.

RFP: Amendment 1 - Para 5.4. Does the Government have a size limitation for email attachments (i.e. xx MB)? There is no size limit.

RFP: Attachment 6 (CBA) The CBA that is incorporated into the solicitation expires during the Base Year.

Please clarify if offerors shall utilize the rates from the last year of the CBA for option years or if offerors shall propose SCA wages after the CBA expires.

Offerors may submit pricing based upon the CBA through 8/31/2019, and then revert back to the established DOL WD rates. However, CBA wage rates take precedence over DOL WD rates.

RFP: Technical Subfactor C and PWS para 4.1.2.1.1.

Technical Subfactor C instructs for the offer to provide a Quality Control Plan as part of the proposal and PWS 4.1.2.1.1 Quality Control Plan instructs the contractor to provide a draft Quality Control Plan 30 day after award date and a final Quality Control Plan 30 day after the CO provides the contractor feedback.

Will the Government please clarify the expectation for the Technical Subfactor C?

PWS para 4.1.2.1.1 was corrected. All offerors shall include a Quality Control Plan (QCP) with their proposals in accordance with Subfactor C. The final QCP will be due 30 days after contract award.

Will any resultant equitable adjustment be allowed to include any indirect such as Overhead, G&A, and Fee?

FAR 22.1904(b)(1); The contractor may request a price adjustment only after the effective date of a new annual E.O. minimum wage determination published pursuant to paragraph (a). Prices will be adjusted only for increased labor costs (including subcontractor labor costs) as a result of the annual E.O. minimum wage, and for associated labor costs (including those for subcontractors). Associated labor costs shall include increases or decreases that result from changes in social security and unemployment taxes and workers' compensation insurance, but will not otherwise include any amount for general and administrative costs, overhead, or profit.

RFP Q&A Posted on 8 December 2017 Will the predecessor CBA wage and benefits remain in effect for the full term of the successor contract, to include all option years, or only in effect for the base year of the contract for bidding purposes?

The CBA ends on 31 August 2019. The incumbent shall honor this agreement until it expires. The union may extend or negotiate another CBA.

There are several labor classifications with multiple categories which would indicate a difference is skill or capabilities required to perform on this contract.

The job descriptions are necessary to ensure the appropriate qualifications are used when completing work.

No. The Government does not have job descriptions for each CBA labor classification.

Yes. Contractors will receive notification that proposals were received.

The government stated during the Industry Day that they would provide a list of government owned vehicles and large equipment that will be utilized for this contract. Could we get the completed list since they were not listed in the amended documents posted on December 8th and 11th?

A technical exhibit will be added to the RFP regarding GFP provided by the Government. The amendment will be posted to FBO.

RFP: 52.212-1, Para 5.5., Volume III

If the successor contractor has bid SCA wage rates for the Option Years and subsequently negotiates a new CBA with the union, will the Government honor the new CBA wage rates or will the Government insist that the contractor be paid only for the SCA wage rates bid, plus any WD changes

Yes, IAW FAR Part 22, the Government is required to incorporate CBA wage rates for CBA's in effect during the period of performance.

Will the Government consider removing the ambiguity in the current instructions by defining a consistent basis for submission of labor price bids? Examples include (1) requiring the use of SCA Wage determination for the Option Years, or

(2) requiring extension of current CBA rates through all option periods.

Offerors may submit pricing based upon the CBA through 8/31/2019, and then revert back to the established DOL WD rates. However, CBA wage rates take precedence over DOL WD rates.

Please clarify whether the required cover sheet includes Volume I – Past Performance, thereby reducing the number of pages allowed to this volume to 4 for the total number of reference.

Wet Sprinkler Risers Dry Sprinkler Risers Tamper Switches Waterflow Switches Pre-Action Systems (computer rooms) Manual Pull Stations Smoke Detectors Heat Detector Duct Smoke Detectors Fire & Smoke Dampers Fire Extinguishers Backflow Preventers (Fire & Domestic) Fire Pumps Kitchen Hood Suppression Systems Special Hazards Suppression (FM-200, Halon Systems, etc.)

For Wet Sprinkler Risers, Dry Sprinkler Risers, Tamper Switches, Waterflow Switches, Manual Pull Stations, Smoke Detectors, Heat Detectors, Duct Smoke Detectors, and Fire & Smoke Dampers, the square footages in Technical Exhibit 1-003 may be used to estimate the quantities of each fire protection/suppression component.

Pre-Action Systems, Backflow Preventers (4" and above are fire, below 4" are domestic), and Fire Pumps should be priced using the information in Technical Exhibit 5-002.

Fire Extinguishers nor Kitchen Hood suppression systems will be maintained by the Contractor.

Preventive Maintenance on Special Hazard Suppression systems is not the responsibility of the contractor. Any unforeseen activations/discharges/system downtime shall be taken care of under a Service Order.

PWS Para 2.3.4.11 When was the last time the fire & smoke dampers tested? This is an annual requirement met on a rolling basis in 2017.

PWS Para 2.3.3.5.2.2.4 Please provide the historical service orders for TRADOC Buildings 661 and 950 so offerors can estimate the required manpower and materials for TRADOC Unscheduled Support.

PWS Paras 2.2, 2.9 and 2.10 Please confirm that PWS Sections 2.9 Stormwater Best Management Practices (BMP) and 2.10 Facility Condition Inventory & Assessment Requirement are new additions to the scope for this contract since the last solicitation.

PWS Para 2.5.2.2.4.1 The PWS states, The Contractor shall provide temporary water service, where applicable, while the system is down.

How many times has the incumbent contractor provide temporary water service on the current contract?

The incumbent has not provided temporary water service on the current contract.

PWS Para 2.6.2.2.11 The PWS states, The Contractor shall ensure to provide and install new barcodes on all HVAC equipment as in accordance with the builder SMS recommendation and as well update all barcode Builder SMS program. Are contractors responsible for purchasing the barcodes? Does all the installed HVAC equipment have barcodes already?

The contractor shall be responsible for all purchasing and labeling barcodes on new or replacement HVAC equipment. Yes, all installed HVAC equipment listed in TE 5-002 presently have been barcoded. However, if there are any missing barcode on a HVAC equipment, the contractor shall be required to barcode them as discovered.

N/A Will the Government confirm incumbent personnel are qualified and certified, based on the requirements of the PWS? The incumbent personnel are qualified and certified based on the current PWS requirements.

PWS Para 2.10.2.1 The PWS states, The Contractor shall provide baseline inventory and FCA services to all facilities and real property installed equipment (RPIE) using seven (7) mandatory and other optional building systems with Uniformat II nomenclature, in accordance with the Sustainment Management System (SMS) 9-point direct rating method. Is BUILDER active and up-to-date? If so, would the incoming contractor still be required to conduct a baseline inventory? Or would the incoming contract validate the inventory and FCA services?

BUILDER is active and the software is kept up to date by the Army Corps of Engineers. The contractor will not be required to execute a baseline inventory, but will be required to execute the 20% rolling inventory assessment as stated in the PWS.

PWS Para 2.10.2.2.1 The PWS states, The Contractor shall maintain management and technical support capabilities throughout the duration of this contract. The Contractor shall utilize structural, architectural, HVAC, mechanical (to include plumbing), civil, fire protection, and electrical technicians and engineers who have completed BUILDER-specific training (computer based or other Government provided training) to ensure accuracy, objectivity, and efficiency during component-section inventory and inspection data collection. Will the Government confirm this training is Government-provided and incumbent staff is qualified? Also, how many technicians and engineers are required to support this requirement?

BUILDER training will be provided by the Government in the form of instructional videos. Assessment guide documents for the required systems will be provided by the Government. The incumbent staff is qualified according to the current PWS. The Government can not state a required number of personnel to fulfil this portion of the PWS. According to PWS paragraph

2.10.2.6 "All personnel conducting Facility Condition Assessments (FCA) shall be certified/licensed journeyman/master craftsmen in the systems they are inspecting."

PWS Para 2.10.2.2.4 The PWS states, The Contractor shall utilize the most current versions of the BUILDER and BUILDER Remote Entry Database (BRED) software programs for the execution of this Task Order unless otherwise directed by the COR. Will the Government confirm this system is provided by the Government and the system has the most current version?

BUILDER is a web-based system maintained and updated by the Army Corps of Engineers. BUILDER Remote Entry Database (BRED) is also maintained and updates are released by the Army Corps of Engineers for download, but it is a desktop-program so the contractor will need to periodically download the most recent version released by the Army Corps of Engineers.

PWS Para 2.3.3.2.3 The PWS states, The Contractor shall submit all certifications and proof of license to the contracting Officer prior to award of this contract. Are the incumbent technician(s) NICET Level III certified? Also, can the Government confirm these certifications will be due prior to contract start and not prior to award?

All technicians are required to be NICET Level II certified.

Certifications are due prior to contract start date. Note that correction for due date is revised in the PWS.

The list of government furnished property will be posted as an amendment to the RFP.

PWS Para 2.3.3.2.3 PWS Section 2.3.3.2.3 states “The Contractor is required to have a current NICET Level III certification in Fire Alarm Systems, Inspection and Testing of Water-Based Systems OR Special Hazard Suppression Systems.” Is the requirement that they have only one of the three Level III certifications listed, or a total of two certifications (the Fire Alarm Systems certification AND one of the other two certifications [Water-Based Systems or Special Hazard Suppression])

The requirement is for the contractor to have both Water-Based Systems and Fire Alarm Systems Level III Certifications.

PWS Para 3.2.19.1.5. Comprehensive and detailed plan shall be submitted to the COR for review and approval within 60 calendar days prior to implementation. With the provided clarification that the Award Date is 1 Sept, please confirm that this deliverable is due after 31 October?

The contractor shall submit the Energy and Utility Conservation Plan within 60 calendar days after contract award date.

PWS Para 2.10.3.1. Perform on site annual inventory and assessments on a rolling 20% of the Real Property Inventory per year. Would the Government provide the actual or estimated work load data for this requirement?

There are approximately 7.2 million square feet of real property assets to be inventoried and assessed, (a total which is subject to change over the course of the contract), 20% of which should be inventoried and assessed each year.
