(End of Provision)
Addenda to RFO Provision 52.212-2, Evaluation – Commercial Products and Commercial:
(a) Evaluation Factors The Government will award a contract resulting from this solicitation to the responsible vendor whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate quotations in descending order of importance:
1. Technical Capability
2. Past Performance (Relevant Experience )
3. Price
Technical Capability and Past Performance (Relevant Experience), when combined, are more important than Price. However, as quotations become more equal in non-price factors, price becomes increasingly important.
To be considered for award, a quotation must receive a rating of "Acceptable" or higher for the Technical factor. The Government reserves the right to award to a higher-priced offeror if the perceived benefits of a superior Technical rating and/or Past Performance record are determined to be worth the additional cost.
1. Factor 1 – Technical Capability
1.1 The Government will evaluate the vendor’s demonstrated ability to successfully provide managed internet and wireless network services supporting twelve unaccompanied housing facilities in accordance with the requirements of the Statement of Work (SoW). The technical approach will be rated using the following:
Outstanding - Quote demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths. Risk of unsuccessful performance is low.
Good - Quote demonstrates a thorough approach and understanding of the requirements and contains at least one strength. Risk of unsuccessful performance is low to moderate.
Acceptable - Quote meets requirements and indicates an adequate approach and understanding of the requirements. Risk of unsuccessful performance is no worse than moderate.
Marginal - Quote has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable - Quote does not meet requirements of the solicitation, contains one or more deficiencies, and is un-awardable.
A Strength is an aspect of a quote that has merit or exceeds specified performance or capability requirements to the advantage of the Government.
A Deficiency is a material failure of a quote to meet a Government requirement.
1.2 Areas of Evaluation for Technical Acceptability:
1.2.1 Proposed technical solution and infrastructure plan to ensure it effectively delivers the mandatory minimum speeds (100 Mbps down/20 Mbps up) to 750 individual rooms and supports 10 simultaneous users per common areas.
1.2.2 Preliminary project schedule to ensure all system design, installation, setup, testing, service activation/commissioning and acceptance can realistically be completed within the mandated 120 calendar days from award.
1.2.3 The offeror's approach to implementing the required network features, including the content-filtering system and user captive portal, in accordance with DoD guidelines.
1.2.4 The preliminary System Security Plan (SSP) and the offeror's methodology for supporting the Government in achieving an Authority to Operate (ATO) prior to service launch.
1.2.5 The Service Level Agreement (SLA) framework to ensure the offeror can successfully provide 24/7 technical support, meet the 2-hour initial response time, and achieve 18-hour service restoration for major disruptions.
1.2.6 How the offeror satisfy the requirements within the Statement of Work.
1.2.7 The technical quote shall clearly demonstrate the vendor’s understanding of the SoW requirements and ability to successfully perform the required services. The technical quote shall not merely restate or paraphrase the solicitation requirements.
Technical quotes shall not exceed twenty (20) pages.
2. Factor 2 - Past Performance (Relevant Experience)
The Government will evaluate the vendor’s recent and relevant experience providing comparable internet, telecommunications, managed wireless, or network support services.
The Government will evaluate the offeror's past performance based on the information provided in the Past Performance Information volume and any other information available to the Government (e.g., CPARS, SPRS).
The purpose of the past performance evaluation is to assess the offeror's ability to successfully perform the required work based on its previous experience.
Past performance will be rated as follows:
Substantial Confidence: Based on the offeror's recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence: Based on the offeror's recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral: No recent/relevant performance record is available or the offeror is a new entrant. A neutral rating will be assigned in these cases.
Limited Confidence: Based on the offeror's recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence: Based on the offeror's recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
In determining the relevancy of past performance information, the Government will consider the following factors:
- Similarity of the work performed to the requirements of this solicitation (e.g., campus-wide ISP delivery, coax/broadband infrastructure).
- Work performed with the Federal Government, including adherence to ATO and network security protocols.
- Contract dollar value.
- Complexity of the work.
- Recency of the performance (within the last 5 years).
- Ability of contractor to complete work in accordance with Period of
Performances.
- The Government may consider past performance information from any available source, including but not limited to:
- References provided by the offeror
- CPARS (Contractor Performance Assessment Reporting System)
- Other government databases
- Information obtained through market research
If the vendor has no relevant experience, the vendor shall clearly state so in its quotation.
A vendor without relevant experience will not be evaluated favorably or unfavorably on that basis alone.
3. Factor 3 – Price
The Government will evaluate total proposed price for fairness and reasonableness.
The total evaluated price may include:
- Monthly recurring charges
- Installation costs
- Equipment costs
- Option year pricing
- Other associated charges
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Extension of Services. As part of the price evaluation, the Government will evaluate the Option to Extend Services under RFO 52.217-8 by adding an additional six-months of potential extension based on the vendor's six month option period prices to the vendor's total price. Price will be evaluated as Total Evaluated Price (TEP). TEP is the sum of the base year plus all option years, plus the six-month extension of services. The extension of services performance is calculated as one half of a twelve month option year.
(c) Notice of award. A written notice of award or acceptance of a quote furnished to the successful Vendor within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
In accordance with Revolutionary FAR Overhaul (RFO) Subpart 9.1, “Responsible Prospective Contractors,” the vendor must be determined responsible by the Contracting Officer to be eligible for award.
The Government may request additional information from the vendor, as necessary, to support the responsibility determination, including information related to financial capability, resources, technical capability, or performance history.
Upon request by the Contracting Officer, the vendor shall provide sufficient information demonstrating adequate financial resources, or the ability to obtain such resources, necessary to successfully perform the contract requirements.
RFO 52.212-4, Contract Terms and Conditions—Commercial Products and Commercial Services applies to this acquisition with the following Addendum:
Paragraph (d) of this clause is tailored as follows: Changes in the terms and conditions of this contract may be made only by written agreement of the parties with the exception of administrative changes, such as changes in the paying office, appropriations data, etc., which may be changed unilaterally by the Government.
