About this file

This is a Questions and Answers document for federal contract solicitation FA465427R0001, which addresses contractor inquiries regarding tax exemption status for the Building 450 Fire Suppression System Installation project. The document confirms that the project is tax-exempt with respect to state and local sales and use taxes because it is procured by a Nonappropriated Fund Instrumentality (NAFI) of the Department of the Air Force. According to the relevant NAF Construction Clauses, the NAFI is exempt from state and local sales and use taxes, and contractors are prohibited from including such taxes in their contract pricing. The document clarifies that contractors can utilize official contract documentation as proof of tax-exempt status when making material purchases through vendors for the project, eliminating the need for separate tax exemption forms such as state-specific documentation.

The underlying solicitation FA465427R0001 seeks comprehensive labor, materials, supervision, tools, transportation, and equipment for designing, furnishing, and installing a complete wet-pipe automatic fire suppression system in Building 450, along with associated HVAC modernization, architectural adjustments, electrical work, and plumbing tie-ins. The solicitation was issued September 2, 2026, with a mandatory site visit scheduled for September 17, 2026, at 10:00 AM Eastern Time. Technical and administrative questions were due by September 24, 2026, at 10:00 AM Eastern Time, and proposal submissions closed October 8, 2026, at 10:00 AM Eastern Time. This NAFI procurement is conducted under DAFMAN 64-119 and DoDI 4105.67, and is not subject to standard FAR requirements unless expressly referenced in the contract documents.

B450 Fire Suppression System Installation

Question 1 Is this a Tax Exempt project?

Answer: Yes, this project is tax-exempt with respect to state and local sales and use taxes. Based on the documents provided, the project is for a Nonappropriated Fund Instrumentality (NAFI) of the U.S. Government. According to the "NAF Construction Clauses.pdf" document, specifically clause NFC-29-3 "Federal, State, and Local Taxes," this contract is exempt from state and local sales and use taxes.

The clause states: "As an instrumentality of the United States, the Nonappropriated Fund is exempt from state and local sales and use taxes. The Contractor shall not include any state or local sales or use taxes in the contract price."

Typically, for NAFI contracts, the contract award document itself, which includes these clauses and clearly identifies the U.S. Government instrumentality, serves as the necessary proof for the contractor to provide to its vendors to claim tax exemption on materials purchased for the project. The vendors would then retain a copy of the contract or relevant sections for their records.

While the documents do not specify that a separate tax exemption form (like an Indiana Form ST-105) will be issued, the contractor should be able to use the official contract documentation to substantiate the tax-exempt status of the purchases.
