About this file
This is a Questions and Answers document clarifying requirements for a laser system procurement.
The government requires delivery of the laser system within 60 calendar days after contract award with no flexibility at this time. However, the government acknowledges it may adjust the Statement of Need if an insufficient number of vendors can meet the 60-day timeline; currently, any proposed delivery exceeding 60 days renders the quote technically unacceptable. The laser system must comply with specifications in the Statement of Need and Federal Acquisition Regulation clause 252.204-7018, which implements Section 889 of the National Defense Authorization Act (2019) prohibiting procurement of certain telecommunications equipment and services from specified Chinese companies. While vendors are not required to submit documentation of laser sources and data communication boards used in manufacturing, all proposed products will be reviewed for compliance with these restrictions. The maximum system dimensions are 28 inches wide by 16 inches deep by 23.5 inches high, and the working area must accommodate parts up to 10 inches wide by 15 inches deep by 6 inches high.

Questions and Answers
1. Is there any flexibility in the 60-calendar-day delivery requirement given current lead times for this equipment?
At this time, the requirement is to have the system delivered 60 days after award.
2. If an offeror’s proposed delivery falls outside 60 days but is the most current lead time available for compliant equipment, should that be noted as an exception in the quote, or will it render the quote technically unacceptable?
If there is not an adequate number of vendors that provide a quotation within the
60-day delivery timeline, we will look into adjusting the Statement of Need to accommodate lead times.
Based on the current Statement of Need requirements, any lead time over 60 days will be deemed unacceptable.
3. Section 889 of the National Defense Authorization Act (NDAA) (2019) prohibits federal agencies and contractors from using or procuring certain telecommunications equipment and services from specific Chinese companies.
We consider fiber laser sources and certain data communication boards, used in the manufacturing of laser systems, telecommunications equipment. Will you be requiring that the vendor provide documentation on what laser sources and communication devices they are using to meet this requirement? In the past we have seen several companies selling lower cost Chinese Fiber sources and data communication boards to keep their costs down.
The laser must comply with specifications outlined in the Statement of Need and clause 252.204-7018. The solicitation does not require documentation, however, all proposed products will be reviewed for compliance.
4. We have some confusion in regards to the dimensions listed in 2.1.1.D. Item D states the dimensions of 28” W x 16” D x 23.5” H. Is this the minimum or maximum size of the laser system or the working area of the system?
The dimensions listed would be the maximum size of the system. The working area of the system needs to accommodate a part size of up to 10” W X 15” D X
6” H.
