B.2.0. In order to be considered for award, each offeror must submit coefficients (multipliers) for each SLIN in accordance with Attachment 1, Price Schedule. The Government uses these multipliers to determine the price of work for each task on individual task orders. The prices established in the eGordian database will be multiplied by the coefficient to arrive at the actual price for a unit of work. The coefficients shall be represented as "net" (e.g., 1.0), a "decrease from" (e.g., 0.95), or an "increase to" (e.g., 1.05) the prices listed in the Unit Price Book (UPB).
Non-prepriced Items (NPIs) shall be at cost and will be multiplied times the coefficient to allow for all General & Administrative (G&A) expenses and Profit. The total direct unit cost established in the UPB database is multiplied by the coefficients to arrive at the actual price for a unit of work. The sum of all line item bare costs from the UPB multiplied by the applicable coefficient (SLINS AA, AB, AC, or AD) shall be the total price for a task order.
B.3.0. Working Hours: If the Government directs a work schedule during non-standard hours, then the coefficients entered for SLINs AB and AD, as appropriate, shall be applied against those items of work, which will be performed during the non-standard hours. The price for the remaining items of work is calculated using the coefficients entered for SLINs AA and AC, as appropriate. See B.3.1 and B.3.2 for definitions of standard and non-standard working hours.
B.3.1. Standard Working Hours (also referred to as Normal Duty Hours): The Contractor shall normally perform tasks during the standard working period of 7:30 a.m. to 4:30 p.m., Monday through Friday, excluding federal holidays and Family Days. The Contractor may elect, at his option and at no additional cost to the Government, to work hours other than standard working hours provided that (a) the request is submitted in writing at least three (3) full work days in advance of the desired date, and (b) the Contracting Officer approves the request. Non-standard hours worked at the convenience of the Contractor and with the approval of the Contracting Officer will be at a standard hours coefficient.
B.3.2. Non-Standard Working Hours: Non-standard working hours are defined as the period from 4:30 p.m. to 7:30 a.m., Monday through Friday, as well as weekends and federal holidays. Items of work to be accomplished during non-standard hours shall be clearly identified in contractor technical/cost proposals, including justification for the request. Non-standard hours, worked without the express approval of the Contracting Officer, will be at the coefficient for standard hours. Non-Standard work hours requested by the Government will be stated on the Request for Proposal. Task Orders subject to an accelerated construction schedule may also have the non-standard working hours coefficient applied to the Task Order (TO) items.
B.4.0. All components of price shall be included in the offeror’s coefficient, and shall be fully supported as no allowance for omitted cost will be made later. The offeror’s coefficients shall be all inclusive to include, but not be limited to, the following costs:
- General and Administrative and other Overhead
- Profit and risk
- Bond premiums
- Social security contributions
- Insurance Costs
- Employee Payroll Taxes
- Insurance and Fringe Benefits

B.6.0. The contractor, at no cost to the Government, shall update the eGordian® database yearly as soon as the annual update becomes available but no later than 15 February of the given year. The new pricing will go into effect at the beginning of the exercised option period incorporated into the contract by the modification exercising the Government’s right to purchase additional contract periods under the contract. This update shall provide the only economic price adjustment under the contract.
B.7.0. Minimal Design: The government will not require designs in excess of a conventional design developed to a 35% stage for renovation and repair projects unless structural members are required to show sufficient detail to establish that the proposed structure can be constructed and manned safely without damage to personnel and/or property. Design documentation shall include (at the CO’s discretion) shop drawings and sufficient calculations to support the adequacy of equipment/materials proposed for the project and the proposed assembly of structural components. The drawings must have sufficient detail to enable both the Contractor and the Government to accomplish independent estimates. For the purpose of this requirement, the term drawings includes actual shop drawings, diagrams, layouts, schematics, descriptive literature, illustrations, schedules, performance and test data, and similar materials furnished by the Contractor to explain in detail specific portions of the work required by the contract.
B.8.0. SEED PROJECT (ATTACHMENTS 4, 5, AND 6).
The use of eGordian® is required for preparing and submitting the seed project and specifically, the project cost estimate. See Section L, Para 2.2.2. of this solicitation for further instructions.
B.9.0. NON APPROPRIATED FUNDS (NAF) GENERAL PROVISIONS (ATTACHMENT 7)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount which equals the combined average hourly rates of the Contracting Officer, Contract Administrator, Contract Managers, Contract Inspectors, and the Staff Judge Advocate responsible for reviewing the action; this average will be chargeable for the first day of delay only, subsequent days will be charged at a rate excluding the Staff Judge Advocate position. In the event the delay will result in substantial charges to the Government, (e.g. lodging, flying operations, etc.,) the additional damage limitations will be calculated and added into the appropriate Delivery/Task Order. Each Delivery/Task Order will have independent liquidated damages assigned depending on applicability, location and magnitude of work.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.
(b) Maximum order. The Contractor is not obligated to honor:
(1) Any order for a single item in excess of $1,000,000.00;
(2) Any order for a combination of items in excess of $1,000,000.00; or
(3) A series of orders from the same ordering office within ten (10) days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.
(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within five (5) days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-22 INDEFINITE QUANTITY. (OCT 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum". (d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after the completion date of the last task order.
52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor prior to 15 days before the contract expires; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, Ushall not exceed 5 years.
52.219-18 NOTIFICATION OF COMPETITION LIMITED TO ELIGIBLE 8(A) CONCERNS (JUN 2003)

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JULY 2013)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:
The Contractor represents that it ( ) is, ( ) is not a small business concern under NAICS Code 236220 - assigned to contract number FA4621-15-R-0002 .

(b) The Contractor, on completion of this contract, shall--

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
