PERFORMANCE WORK STATEMENT
1. DESCRIPTION OF SERVICES/GENERAL INFORMATION
1.1 Description of Services. The Contractor shall provide all equipment, tools, materials, transportation, personnel, labor, supervision, and management necessary to perform Portable Latrines Leasing and Cleaning services at the 150 launch facilities (LF) assigned to F.E. Warren Air Force Base (FEW), WY. Any references to FEW in this document include the 150 launch facilities (LF) assigned to F.E. Warren AFB.
1.2 Scope. The Contractor shall provide 150 portable, handicap-sized latrines (minimum 58” x 58”;
maximum 66” x 66”) with a minimum 35-gallon capacity. The latrines will need to be set up on location and provide service to the latrines every 30 days. Portable latrines must be Sand/Khaki, Grey, Brown, Green, or Blue (earth tones) in color. Set up will include shimming/leveling to an acceptable standard for use. Services shall be completed at the site of each latrine during the hours of daylight, if possible. If the scheduled service day is a holiday, the Contractor shall service all units the workday prior to, or after the scheduled service day. Performance outside of daylight hours will be at no additional cost to the Government. Services shall consist of mileage, pumping the holding tanks, washing the units inside and outside, air freshener, hand soap/sanitizer, fresh water with deodorizer, anti-freeze for winter months and furnishing a minimum of two rolls of toilet paper for each latrine.
1.3 Scheduling. Upon contract award, the Contractor shall submit a written schedule to the Contracting Officer (CO), designating the day(s) of the week the Contractor will perform services, and include a plan of how the Contractor intends to perform services of all portable latrines.
1.4 Out-of-Schedule Servicing. The Contractor shall perform out-of-schedule servicing of portable latrines within 72 hours of notification by Contracting Officer Representative (COR).
1.5 Inaccessible Toilets. The Contractor shall attempt to service each latrine. If the latrine is inaccessible due to weather or access road conditions, the Contractor will contact the COR within 24 hours or upon the next duty day. Personnel will not be sent to clear snow from around the latrine nor is a Contractor expected to clear snow from around the latrine. The Government will not be responsible if a contactor vehicle becomes stuck attempting to access impassible roads.
1.6 Transport and Disposal of Waste. The Contractor shall comply with all federal, state, and local laws, regulations, and ordinances while transporting waste for disposal. The Contractor shall dispose of all waste at an off- base permitted site.
1.7 Blown/Knocked Over Toilets. The Contractor shall secure latrines to the ground to prevent tipping, in the manner they deem necessary (exception: latrines cannot be staked into the ground). If tipping occurs, the COR will contact the Contractor to set the latrine upright. Services on the tipped unit should be within 72 hours of notification by COR. The Contractor must obtain a dig permit and coordinate with 90CES Environmental to dig deeper than 2 inches. The Contractor shall thoroughly clean any spillage resulting from blown/knocked over latrines. The Contractor shall provide any necessary personal protective clothing and equipment for Contractor personnel.
Replacement/cleanup of knocked over latrines due to Government negligence will be invoiced on line item X002 per request. If a spill occurs please contact the 90 Civil Engineer Squadron, Environmental Office, at 307-773-4356 with the details of the spill and an estimate of spill volume.
The Contractor shall transport and dispose of all waste in accordance with federal, state and local laws and regulations. The Contractor shall develop written procedures for hazardous material spill clean-up and prevention according to EPA regulations. A copy of this plan shall be submitted to the COR or CO 10 days prior to the contract start date. 90 CES/CEIE Environmental Protection Section 01 57 19.05 32 provides additional guidance on environmental requirements.
1.8 Vandalism and Personal Injury. The Contractor shall report, in writing, acts of vandalism, theft, or apparent willful act of damage of latrines to the FEW Security Forces, CO, and COR. The Contractor shall cooperate with Government personnel and provide a written statement of facts for the Security Forces, when requested. The Government will not be liable for damage associated with unauthorized use/vandalism or damage caused by weather or other natural events. The vendor is responsible for any cost incurred due to normal wear and tear of the unit.
1.9 Location of Portable Latrines. Portable latrines must be placed outside the LF on Air Force property, no closer than 10 feet to the fence (unless approved by the COR or CO) and not to extend beyond 25 feet from the fence per Appendix 2. Latrine may not interfere with gate operation or hinder vehicles entering the site or driving around the perimeter fence. Situate latrine so door faces the camera located on light pole to the maximum extent possible (see Appendix 2).
2. SERVICES SUMMARY
The Contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. Procedures as set forth in the FAR 52.212-4 (a), Contract Terms and Conditions - Commercial Items, Inspection/Acceptance, will be used to remedy all deficiencies.

Periodic Surveillance Customer Feedback
2.1 Periodic Progress Meetings. The CO, COR, COR Supervisor, other Government personnel as appropriate, and the Contractor shall meet as needed to discuss the Contractor’s performance. The following issues shall be discussed: opportunities to improve the contract, any modifications required of the contract, unsatisfactory complaints and trends against performance objective observed, and positive performance and steps taken by the Contractor to prevent unsatisfactory occurrences in the future. The Contractor shall provide a summation of customer complaints and provide insight into any identified trends.
The minutes of these meetings will be reduced to writing, signed by the CO and any other signatures as deemed appropriate, distributed to the functional area representatives and the Contractor. Should the Contractor not concur with the minutes, the Contractor shall provide a written notification to the Contracting Office identifying areas of non-concurrence for resolution.
3. GOVERNMENT FURNISHED PROPERTY AND SERVICES
3.1 Emergency Services. There are no emergency medical services. Therefore, the contractor shall call 911 in case of medical emergencies.
3.2 Locks. The Contractor will provide padlocks/keys or combination locks and issue keys or combinations to the Government as required.
4. GENERAL INFORMATION
4.1 Contract Manager. Upon contract award, the Contractor shall designate a primary, and at least one alternate Contract Manager (CM), who will be responsible for performance of services.
The Contractor shall submit the names and telephone numbers of the primary and alternate(s) CM, in writing, to the CO. The contract manager or alternate(s) shall have full authority to act for the Contractor on all matters relating to daily operations of this contract. The CM may be a Contractor employee providing services in accordance with the contract.
4.2 Contract Manager Experience. The primary and alternate CM must have experience performing services described in this Performance Work Statement (PWS).
4.3 Contractor Employee Restrictions. The Contractor shall not employ persons for work on this contract if such employee is identified to the Contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population. In addition, contractor employees shall have a valid driver license that meets the Real ID Act requirements.
4.4 Conflict of Interest. The Contractor shall not employ any individual who is an employee of the United States Government if the employment of that individual would create a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval of the employment in accordance with Department of Defense Directive (DoDD) 5500.07-R, Standards of Conduct. In addition, the Contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air Force Industrial Labor Relations Activities.
4.5 Federal Holidays. FEW recognizes the following federal holidays. The Contractor is not required to perform services on the following federal holidays.
• New Year’s Day - 1 January
• Martin Luther King Day - 3rd Monday in January
• Washington’s Birthday - 3rd Monday in February
• Memorial Day - last Monday in May
• Juneteenth National Independence Day – 19 June
• Independence Day - 4 July
• Labor Day - 1st Monday in September
• Columbus Day - 2nd Monday in October
• Veteran’s Day - 11 November
• Thanksgiving Day - 4th Thursday in November
• Christmas Day - 25 December
4.6 FEW Official Hours of Operation. The official hours for FEW are from 7:00 a.m. to 4:30 p.m., Monday- Friday, excluding federal holidays. COR’s are usually available during these times. However, Missile Alert Facilities are manned 24 hours a day, 7 days a week, with no exceptions.
4.7 Cooperation with Other Contractor Personnel. The Government may award other contracts for additional work. The Contractor shall fully cooperate with other Contractors and Government employees and fit its own work to such other work as may be directed by the CO.
The Contractor shall not interfere with the performance of work by any other Contractor or Government employee.
4.8 Contractor Vehicles. All Contractor vehicles shall be properly registered, meet all local, state, and federal safety and emissions requirements. Each Contractor vehicle shall have the Contractor’s logo neatly exhibited on each side of the cab and the name of the Contractor’s business. Vehicles shall be in satisfactory mechanical condition and present a neat and clean appearance. Any vehicle(s) not so maintained may be ordered removed at the sole discretion of the CO until satisfactory repairs are made. Vehicle-mounted communication equipment shall conform to all applicable base and federal frequency regulations and avoid conflict with existing frequencies.
4.9 Safety Requirements. The Contractor shall comply with all applicable laws and safety regulations. Compliance with OSHA and other applicable laws and regulations for the protection of Contractor employees is exclusively the obligation of the Contractor. The Government will assume no liability or responsibility for the Contractor’s compliance or non-compliance with such responsibilities. The Contractor shall provide all personal protective clothing and equipment for Contractor employees.
4.10 Fire Prevention and Safety Standards. Contractor employees shall comply with the Occupational Safety and Health Administration (OSHA), National Fire Protection Association (NFPA), and Air Force Occupational Safety, Fire, and Health Standards.
4.10.1. Environmental Specification. Take special measures to prevent oils or other hazardous substances from entering the ground, drainage areas, or local bodies of water. Surround all temporary fuel oil, petroleum, or liquid chemical storage containers greater than or equal to 55 gallons with secondary containment of sufficient size and strength to contain the contents of the tanks and freeboard precipitation (2 inches (2”) per 24-hour period) in the event of content leakage or spillage. Contractors must have adequate spill control materials on site to prevent contamination of stormwater drains and wetlands.
4.10.2. Environmental Specification. Any spill from stationary storage sources or mobile sources (e.g., loaders, tractor, equipment) that exceeds 25 gallons must immediately be reported to CEIEC, contained and or cleaned up in an expeditious manner. Spills that are beyond the contractor’s capability to immediately remediate, must be reported to the base fire department for response.
14.5.1. Spills and Spill Response Procedures. For spills beyond the capabilities of contractor personnel or if it has impacted a storm drain or waterway, call the Base Fire Dept at 911 and 90CES Environmental 307-773--2415.
4.11 Safety Data Sheet. Upon contract award, the Contractor shall submit a Safety Data Sheet (SDS) to the CO and COR for all chemicals used in servicing the portable toilets.
4.12 Continuation of Essential DoD Contractor Services During Crisis. This requirement has been determined as an essential and does require continued support during a crisis as defined in DoDI 3020.37, E2.1.1 and E2.1.3.
5. SECURITY REQUIREMENTS.
5.1 Controlled Unclassified Information (CUI). IAW DoDI 5200.48, Controlled Unclassified Information, and AFGM 2020-16-01, Memorandum for Controlled Unclassified Information (CUI) the Air Force will use a phased approach to implementing CUI requirements. All DAF information will be protected IAW the requirements under the Basic level of safeguards and dissemination unless specifically identified otherwise in a law, regulation, or government-wide policy.
5.2 Reporting Requirements. Contractor employees shall immediately report to an appropriate Government authority any information or circumstances of which they are aware that may pose a threat to the security of Department of Defense personnel, Contractor personnel, resources, and classified or unclassified defense information.
5.3 Key Control. The Contractor will provide padlocks and keys for each latrine and issue keys to the Government. The Contractor shall establish and implement methods of ensuring all keys issued to the Government are not lost or misplaced and are not used by unauthorized persons.
The A. The Contractor shall immediately report any occurrences of lost or duplicated keys to the COR and 90 SFG.
B. In the event keys, other than master keys, are lost or duplicated, the Contractor may be required, upon written direction of the CO, to re-key or replace the affected lock or locks without cost to the Government.
5.4 Restricted/Controlled Access Areas. Contractor personnel shall avoid restricted and controlled areas unless work is to be accomplished in those locations and the necessary coordination has been made. Strict security and personnel access control is maintained in these areas. The area within the fence adjacent to the latrines are restricted/controlled areas and entry is prohibited and not expected. Contractor must contact the appropriate Security Control Center upon arrival to service toilets.
6. Operational Security (OPSEC). The contractor shall adhere to the following minimum requirements in support of this requirement:
6.1. Contractor personnel shall not discuss government operations in public or over unprotected or unencrypted communications. Controlled unclassified (CUI) may only be transmitted as directed in this PWS.
6.1.1. The Contractor shall not post to company websites, publications, newsletters, or other media any images, data or information that reveal sensitive government operations, personnel, equipment, and/or classified or controlled unclassified information. When in doubt, company press releases related to this contract should be coordinated through the COR and CO, as applicable.
6.1.2. Because observation of events, operations, physical changes, etc. may reveal National Security information, specific restrictions are needed to preclude unintentional release of this information to unauthorized parties. Unauthorized disclosure and transfer of National Security Information is punishable under 18 USC § 793. Therefore, contractor personnel shall not disclose to unauthorized third parties, post to unofficial sites (including Social Networking sites) any images, data/information, or observed events that reveal sensitive government operations, personnel, equipment, including, but not limited to:
6.1.3. Government issued badges, identification shall be removed and/or concealed from plain sight when off base and shall not be left in vehicles or unprotected areas. Badges and passes may not be duplicated, copied, or loaned to others. Lost or stolen identification badges, vehicle passes etc. will be immediately reported to the COR, CO, and/or Installation Security Office.
6.1.4. Practice OPSEC and implement countermeasures to protect critical information (CI) and other sensitive unclassified information, if applicable. Protection of CI will include the adherence to and execution of countermeasures which the contractor initiates or as provided by the COR/CO, for CI on or related to this PWS.
7. Anti-Terrorism
7.1. Notification: If the Contractor (contract employees/subcontractors) identify any suspicious activity, they shall contact the Base Defense Operations Center (BDOC) at 307-773-3501 (On-installation)/Missile Security Control (MSC) at 307-773-2701 (Off-installation) and notify the CO and
COR.
8. Green Procurement Program (GPP). In performance of this contract, contractors shall use Environmental Protection Agency (EPA) designated recycled content products, Information Technology (IT) Energy Star products/appliances, Federal Energy Management Program (FEMP) Designated Energy Efficient Low Stand By Power products/appliances, U.S. Department of Agriculture (USDA) Bio based/Bio preferred products, Environmentally preferable products, Electronic Product Environmental Assessment Tool (EPEAT) registered products, Water Sense or other water efficient products, non- or Low Ozone depleting substances under the Significant New Alternatives Policy (SNAP), non or Low toxic or hazardous constituents (e.g. non-VOC paint) and any other environmentally sustainable product/method, to the greatest extent possible.
9. Safety Requirements.
9.1. In performing work under this contract, the contractor shall:
9.1.1. Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
9.1.2. Record and report promptly (within one hour), to the Contracting Officer or designated COR, all available facts relating to each instance of damage to Government property or injury to either contractor or Government personnel.
9.1.3. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the CO.
10. Environmental Controls.
10.1. Compliance with Laws and Regulations. The contractor shall be knowledgeable of and comply with all applicable Interstate, federal, state, and local laws, regulations, and requirements regarding environmental protection, to include Section 01 57 19.05 32, Environmental Protection.
In the event environmental laws/regulations change during the term of this contract, the contractor is required to comply as such laws come into effect. If there is an increase or decrease in cost because of the change, the contractor shall inform the CO pursuant to notice requirements and negotiate a modification to the contract.
10.2. Notification of Environmental Spills. If the contractor spills or releases any substance contained in 40 CFR 302 into the environment, the contractor or its agent shall immediately report the incident to the F.E. Warren AFB Fire Dept at 911 (landline) or 307-773-2931 (cell phone). The liability for the spill or release of such substance(s) rests solely with the contractor and its agent.
10.3. Hazardous Material (HM). If hazardous materials will be used in the execution of this contract, the contractor shall comply with all federal, state, and local regulations concerning the use, storage, and reporting of HM in accordance with AFMAN 32-7002, Environmental Compliance and Pollution Prevention. The contractor shall be required to obtain authorization per the Installation Hazardous Materials Management Program before ordering or purchasing any hazardous product and may not bring a HM onto F.E. Warren AFB property, nor use a HM, until the contractor receives all required authorizations. This authorization process may take up to three weeks. The contractor shall provide the information listed in Attachment 1 of Section 01 57 19.05 32 to request authorization for all hazardous materials proposed for use on FE Warren AFB or the missile field.
11. Safety Requirements.
11.1. In performing work under this contract, the contractor shall:
11.1.1. Conform to the safety requirements contained in the contract for all activities related to the accomplishment of the work.
11.1.2. Record and report promptly (within one hour), to the Contracting Officer or designated COR, all available facts relating to each instance of damage to Government property or injury to either contractor or Government personnel.
11.1.3. In the event of an accident/mishap, take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, and preserve evidence until released by the accident/mishap investigative authority through the CO.
