The purpose of this amendment is to make the following changes:
A. The Solicitation due time is changed from 12AM to 12PM on 14 February 2013.
B. Mobilization can begin on 1 April and actual perfomance of the Base Year will begin on 1 May 2013 and run through 31 March 2014 for the CLINS indicated in the Summary of Changes.
C. Attachment 2 dated 6 Febuary 2013 is hereby revised and ia attached.
D. The addendums to clauses 52.212-1 and 52.212-2 are hereby revised to change the requirement for a certified arborist and utility arborist and to incorporate a new table with definitions of "acceptable" and "unacceptable" for technical evaluation ratings.
E. All other terms and conditions remain the same.

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (FEB 2012)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
(ii) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph (i)(1)(i) of this provision.
Additional copies will be issued for a fee.

(4) Nongovernment (voluntary) standards must be obtained from the organization responsible for their preparation, publication, or maintenance.
(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,000, and offers of $3,000 or less if the solicitation requires the Contractor to be registered in the Central Contractor Registration (CCR) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address.
The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. An offeror within the United States may contact Dun and Bradstreet by calling 1- 866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. (k) Central Contractor Registration. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. (l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

INSTRUCTION TO OFFERORS—COMMERCIAL ITEMS
Addendum to 52.212-1(c), Period for Acceptance of Offers. The paragraph is tailored as follows: The offeror agrees to hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers.
ADDENDA TO 52.212-1 PROPOSAL PREPARATION INSTRUCTIONS
NOTE: All proposal preparation cost will be the sole responsibility of the offeror. The Government will not reimburse any firm for their proposal preparation cost.
A. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.
Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications. Failure to meet a requirement may result in an offer being ineligible for award. The response shall consist of three (3) separately bound parts, Part I - Price Proposal (Bid Schedule), Part II – Technical Volume, and Part III- Past Performance Information.
B. Specific Instructions:
1. PART I – PRICE PROPOSAL
a. Complete the SF 1449, blocks 12, 17a, 30 (a), (b) and (c). An official having the authority to bind your company contractually must sign and date the SF 1449 Block 30b. Submit original and two (2) copies of this part. One copy of the SF 1449 must bear an original, authorized signature. In doing so, the Offeror accedes to the contract terms and conditions as written in the RFP. All sections of the RFP, excluding Instructions to Offerors and Evaluation Procedures Sections, constitute the model contract.
b. Complete all CLINS/SLINS in the SF 1449 Continuation Sheet Schedule, to include all option periods. To comply with an AF template for this service, many CLINs are marked as “Not Separately Priced” (NSP) or “Reserved”. Do not include any pricing information on these CLINs. The CLINs that will not include any pricing are 0001, 0002, 0002AC, 0002AH, 0007, 0008, 0009, 0012, 0013, 0013AC, 0013AH, 0015, 0016, 0017, 0018, 1001, 1002, 1002AC, 1002AH, 1003, 1007, 1008, 1012, 1013, 1013AC, 1013AH, 1015, 1016, 1017, 1018, 2001, 2002, 2002AC, 2002AH, 2003, 2007, 2008, 2009, 2012, 2013, 2013AC, 2013AH, 2015, 2016, 2017, 2018, 3001, 3002, 3002AC, 3002AH, 3003, 3007, 3008, 3009, 3012, 3013, 3013AC, 3013AH, 3015, 3016, 3017, 3018, 4001, 4002, 4002AC, 4002AH, 4003, 4007, 4008, 4009, 4012, 4013, 4013AC, 4013AH, 4015, 4016, 4017, 4018. Complete Attachment 2, Bid Schedule, this shall at least be submitted electronically in Microsoft Excel format. The extended amount must equal the whole dollar unit price multiplied by the number of units. The proposal must be submitted for a base period plus four (4) option periods. Unit prices shall prevail in the event of a mathematical error when calculating the extended price. Unit pricing from the SF 1449 Schedule shall prevail over a mathematical error in the Attachment 2 spreadsheet.
c. Complete the necessary fill-ins and certifications in provisions. The provisions FAR 52.212-3 shall be returned along with the proposal.
d. Acknowledge any and all amendments to the solicitation.
e. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information other than cost or pricing data to support a determination of price reasonableness.
f. Schedule B will be reviewed for responsiveness. All remaining responsive proposals will be ranked in order by price. Unrealistically low price or cost estimates, initially or subsequently, may be grounds for eliminating a proposal from competition. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. Examples of such techniques include, but are not limited to the following: Price analysis: The process of examining and evaluating a proposed price without evaluating its separate cost elements and proposed profit. Comparison of proposed prices received in response to the solicitation.
Normally, adequate price competition establishes price reasonableness. Comparison of previously proposed prices and previous Government contract prices with current proposed prices for the same or similar effort.
2. PART II – TECHNICAL VOLUME The offeror must identify a plan that at least contains the following information:
a. Provide a plan to obtain and maintain all necessary equipment to fulfill PWS requirements
(quantity/type of equipment). Indicate the number and size/capacity of tractors-mowers, finish mowers (ZTR-type), trimmer/edgers/blowers to be employed in each of the service areas (Improved, Semi-Improved, BASH Semi-Improved).
b. Provide a plan to meet performance requirements to the minimum contract standards for mowing, to include Certifications outlined in the solicitation. Certifications Required: Pesticide applicators must have a state license in the categories for which applying pesticides per the PWS. Contractor must provide a plan to staff a state certified arborist and utility arborist. If tree maintenance is sub-contracted, the sub-contractor must be a state certified arborist and/or state licensed utility arborist.
c. Provide the method for hiring and retaining skilled manpower. Indicate the number of personnel projected for employment during the growing and non-growing seasons. How will personnel be allocated among the various tasks required of this contract? Indicate if any personnel will be “dual hatted” and how their duties will be split and still achieve contract objectives. Note: At least 50% of the cost of contract performance incurred for personnel shall be expended for employees of the concern, IAW FAR 52.219-14 Limitations on Subcontracting.
d. Provide a Staffing Plan. Indicate the number of personnel projected for employment during the growing and non-growing seasons. How will personnel be allocated among the various tasks required of this contract? Indicate if any personnel will be “dual hatted” and how their duties will be split and still achieve contract objectives. Note: At least 50% of the cost of contract performance incurred for personnel shall be expended for employees of the concern, IAW FAR 52.219-14 Limitations on Subcontracting.
e. Provide a Mobilization Plan that will outline how long the contractor will take to assemble and coordinate all personnel and equipment to perform requirements as outlined in PWS.
3. PART III – PAST PERFORMANCE INFORMATION – Limited to no more than 2 pages per contract listed. Only references for the same or similar type contract desired. Submit original plus one copy.
a. Quality and Satisfaction Rating for Contracts Completed in the Past Three Years: Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.)
which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.
b. Performance Questionnaires. (See Attachment 4), in addition to para a above, the government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this RFP. The government will use information submitted by the offeror and other sources such as other Federal Government offices and commercial sources, to assess performance. Provide a list of no more than five (5) of the most relevant contracts performed for Federal agencies and commercial customers within the last three (3) years. Past Performance includes contract efforts that are currently being performed. Relevant contracts include work of a nature, magnitude and scope similar to that required for this contract within the past three years from date of solicitation. Relevant past performance information will consist of contracts/projects where at least 200 acres “Improved” grounds was maintained/mowed, with a minimum of one contract/project entailing at least 500 acres “Improved” grounds maintained/mowed. One of the questionnaires must reflect at least 500 acres “Semi-Improved” grounds maintained/mowed. Each past performance submission will be given an overall past performance relevancy rating of; Very Relevant, Relevant, Somewhat Relevant, or Not Relevant.

4) to its chosen references. c. Offerors are cautioned that the Government will use information provided by the offerors and information obtained by other sources in the development of the performance confidence assessment.
d. Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
e. Documents submitted in response to this RFP must be fully responsive to and consistent with the following:
1. Requirements of the RFP (i.e., Attachment 1, Performance Work Statement (PWS), Attachment 2, Bid Schedule, and government standards and regulations pertaining to the PWS.)
2. Evaluation Factors for Award.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Completed Schedule B, technical volume (10 Pages, maximum) and a maximum of 5 Past Performance Questionnaires (limited to 9 pages per questionnaire), as outlined in Attachment 4. All non-responsive proposals will not be evaluated. Responsive proposals will be evaluated by the SSET, starting with the lowest price offeror.
The SSET will review responsive proposals and provide a rating of “Acceptable” or “Unacceptable” for the technical proposal.
The responsive proposal must obtain at least an overall rating of Substantial Confidence for past performance to be considered for award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to FAR 52.212-2:
BASIS FOR CONTRACT AWARD: This is a competitive best value source selection in which competing offerors' past performance and technical volume will be evaluated as approximately equal to cost or price. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications. The Government intends to award one contract to the offeror deemed responsible in accordance with Federal Acquisition Regulation (FAR), as supplemented, whose proposal conforms to the Request for Proposals (RFP) requirements including all stated terms, conditions, representations, certifications, and all other information required by the RFP and is judged, based on the evaluation criteria, to represent the best value to the Government.
The Government seeks to award to the offeror who in the Government’s estimation, provides the greatest overall benefit in response to the requirements. This may result in an award to a higher rated, higher priced offeror where the decision is consistent with the evaluation criteria. Offerors may be given the opportunity to clarify certain aspects of their written proposals (e.g., defining the relevance of the offeror’s technical information and adverse past performance information to which an offeror has not previously had an opportunity to respond) or to resolve minor clerical errors. Any such exchange between the offeror and the Government will be for clarification only and will not constitute discussions within the meaning of FAR 15.306(a).
While the Government’s evaluation team will strive for maximum objectivity, the selection process, by its nature, is subjective and, therefore, professional judgment is implicit throughout the entire process. The Government intends to evaluate proposals and make award without discussions (except clarifications as described in FAR 15.306(a)) however, IAW FAR 15.306(a) & (b) prior to establishing the competitive range of proposals for this acquisition, the contracting officer may conduct discussions, request clarifications, and/or have communications with offerors to determine technical acceptability of their proposal IAW the solicitation requirements. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a technical, performance, and price standpoint.
All offerors’ proposals will be evaluated first for price followed by technical acceptability followed by a past performance evaluation. The evaluation process shall proceed as follows:
A. Prices will be evaluated for fair and reasonableness. IAW FAR 15.404-1(g), all CLIN prices will also be evaluated to determine if any prices are unbalanced. Unrealistically low price or cost estimates, initially or subsequently, may be grounds for eliminating a proposal from competition. The Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. All responsive proposals will be ranked in order by price including option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in the SF1449 Schedule by the unit price for each item to confirm the extended amount for each. The extended amounts will be added together for the base period and all option periods for a total contract price. Unit prices shall prevail in the event the extended price is calculated incorrectly. In the event the Government extends services under the authority of FAR 52.217-8, Option to Extend Services, unit pricing for the last option period exercised proceeding the extension shall remain in effect. These prices are already determined to have been evaluated at time of contract award.
1) Total evaluated amount for Base Period and Option Periods: Extended amounts for all CLINS are added together for a total for that specific period.
2) Total of All Years: (Total Evaluated Amount for Base Period) + (Total Evaluated Amount for Option
Period 1) + (Total Evaluated Amount for Option Period 2) + (Total Evaluated Amount for Option Period
3) + (Total Evaluated Amount for Option Period 4) = Total Evaluated Amount.
B. An evaluation of technical acceptability of each offeror's proposal shall be made. IAW FAR 15.306(a) & (b) prior to establishing the competitive range of proposals for this acquisition, the contracting officer may conduct discussions, request clarifications, and/or have communications with offerors to determine technical acceptability of their proposal IAW the solicitation requirements. The basis for evaluation of technical proposals is described below.
Only those offerors determined to be technically acceptable, either initially, or as a result of discussion, clarifications, and/or communications, will be considered for further evaluation and award.
Technical Acceptable/Unacceptable Ratings

Relevant contracts - Relevant past performance information will consist of contracts/projects where at least 200 acres “Improved” grounds was maintained/mowed, with a minimum of one contract/project entailing at least 500 acres “Improved” grounds maintained/mowed. The government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive a Substantial Confidence performance assessment rating. The purpose of the past performance evaluation is to allow the government to assess the offeror’s ability to perform the effort described in the solicitation, based on the offeror’s demonstrated present and past performance. The assessment process will result in an overall performance confidence assessment rating of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Unknown Confidence as defined in Air Force FAR Supplement 5315.101-1, MP5315.305.
Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will not be considered as highly as past performance information for the principal offeror. Past performance regarding minor members of joint ventures or teaming arrangements will be considered as highly as the majority member of those arrangements.
