FAR52.212-1 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (Jan 2017)

Addendum to 52.212-1(c), Period for Acceptance of Offers. The paragraph is tailored as follows: "The offeror agrees to hold the prices in its offer firm for calendar days from the date specified for receipt of offers."120

ADDENDUM TO 52.212-1, PROPOSAL PREPARATIONINSTRUCTION

A. To assure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirements of this solicitation. The response shall consist of two (2) separate parts; - Part I Price Proposal and - Present/Past Performance Information.Part II

B. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the contracting officer will review this determination and if, in the contracting officer's opinion, an adequate price competition exists no additional data will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit data other than certified cost or pricing data to the extent necessary for the contracting officer to determine the reasonableness and balance of the price.

Specific Instructions:

1. PART I -PRICE PROPOSAL - Submit original and one (1) copy

(a)Complete blocks 12, 17a, and 30a, b, and c of the SF1449. In doing so, the offeror accedes to the contract terms and conditions as written in the SOLICITATION, with attachments. The SOLICITATION constitutes the model contract. Pursuant to FAR 52.204-7(d), "Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://ww.sam.gov for information on registration."

(b) Insert proposed unit and extended prices in the Pricing Schedule. The extended amount must equal the whole dollar unit price multiplied by the number of units. The proposal(s) must be submitted for a 12-month base year plus four 12-month option years. Note: The unit price can be no more than two (2) decimal places out. The contracting system will automatically calculate the total price to two decimal places.

(c) Complete attachment A18 Excel Pricing Schedule Spreadsheet.

(d) Complete attachment A19 Excel Pricing List for CLINs X016, X020 and X022.

(e)Complete these necessary fill-ins and certifications in the provisions. The provision FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, shall be returned along with the proposal. Note: Pursuant to FAR52.204-7(e) System For Award Management.

(f)Provide proof of HUBZone certification.

(g)Provide an email address for any correspondence.

2. PARTII - PRESENT/PAST PERFORMANCE INFORMATION - Only references for recent and relevant present/past efforts are desired.

If electronic, send only 1 copy.

The government will evaluate the quality and extent of offeror's performance deemed recent and relevant to the requirements of this solicitation.

Recent present/past performance is defined as performance within the last five (5)years and relevant performance is defined as grounds maintenance services that are similar to or greater in scope, magnitude, and complexity than the effort described in the Performance Work Statement. The government will use information submitted by the offeror and other sources such as other Federal government offices and commercial sources, to assess performance.

(a) : Provide any information currently available (letters, metrics, Quality and Satisfaction Rating for Contracts Completed in the Past 5 Years customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed service for recent and relevant present/past efforts/contracts (similar in scope and magnitude of effort and complexities this solicitation requires). In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.

(b) : The government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements Performance Questionnaire of this RFP. The government will use information submitted by the offeror and any other sources of information available to the government to assess present/past performance. Offeror shall coordinate with the activity submitting the rating. No more than five (5) questionnaires covering the most relevant contracts performed for Federal agencies and commercial customers within the last five (5) years will be accepted. The evaluation of present /past performance information take into account present/past performance information regarding predecessor companies, key personnel who have will recent, relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the acquisition. Furnish the following information for each contract provided in the questionnaire:

(i)Company/Division name

(ii)Product/Service

(iii)Contracting Agency/Customer

(iv)Contract Number

(v)Contract Dollar Value

(vi)Period of Performance

(vii)Verified, up-to-date name, address, and telephone number of the contracting officer

(viii)Comments regarding compliance with contract terms and conditions

(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions

NOTE:PRESENT/PAST PERFORMANCE QUESTIONNAIRES WILL NOT BE ACCEPTED FROM THE OFFEROR;THEY MUST BE SUBMITTED BY THE RATER. IT IS THE RESPONSIBILITY OF THE OFFEROR TOENSURE PRESENT/PAST PERFORMANCE

QUESTIONNAIRES ARE SUBMITTED TO THE GOVERNMENT.

If a teaming arrangement is contemplated, provide complete information as to the arrangement, including any relevant and recent present/past performance information on previous teaming arrangements with same partner. If this is a first time joint effort, each party to the arrangement must provide a list of no more than five (5) of the most relevant contracts performed for Federal agencies and commercial customers within the last five (5) years.

JOINTVENTURE AGREEMENTS - Joint venture agreements must be received by the Small Business Administration (SBA) prior to proposal due date and approved before award of any resultant contract. If you are contemplating a joint venture on this project, you must advise your assigned SBA Business Opportunity Specialist(BOS) as soon as possible. It is also recommended that the agreement be submitted as soon as practicable to ensure compliance with established regulations. Any corrections and/or changes needed can be made only when your BOS has adequate time for a thorough review before the proposal due date. NOCORRECTIONS AND/OR CHANGES ARE ALLOWED AFTER TIME OF SUBMISSION OF

PROPOSAL.

(c) : Present/Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the Subcontractor Consent subcontractor's consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their present/past performance information to the prime contractor.

(d)Documents submitted in response to this solicitation must be fully responsive to and consistent with the following:

1.Requirements of the solicitation and Performance Work Statement (PWS), and government standards and regulations pertaining to the PWS.

a) A site visit will be conducted at Joint Base McGuire Dix Lakehurst with the meeting location on 26 July, 2023 at Bldg 3104, JBMDL, NJ for the purpose of answering questions regarding this solicitation. 08641 at 7:30AM EST If you are planning to attend, please ensure to pack a lunch.

(b) Submit the full names of all attendees, social security numbers, driver license numbers with state of issue, and date of birth to lisa.goodwin.2@us.

af.mil prior to Contractors are limited to two (2) attendees per company. Please also provide a contact number of the 25 July, 2023 by 1200.

individual(s) attending the site visit in the event of a change in meeting location or time. This information must be provided in advance in order to ensure access to the military base/conference site and adequate seating for the conference attendees.

(c)Offerors are requested to submit questions to the point of contact noted above. Information provided at this conference shall not qualify the terms and conditions of the solicitation and specifications. Terms of the solicitation and specifications remain unchanged unless the solicitation is amended inwriting. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of solicitation amendments shall apply.

ADDENDUMTO FAR 52.212-2

BASIS FORAWARD CONTRACT AWARD

This is a competitive best value source selection in which competing offerors' past performance history will be evaluated on a basis where past . By submission of its offer in accordance with the performance is rated significantly more important than price when being evaluated instructions provided in clause FAR 52.212-1, Instructions To Offerors, the offeror accedes to the terms and conditions of this model contract. All such offers shall be treated equally except for their prices and performance records. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

A .Initially, offers shall be ranked according to price, including option prices, as listed in attachment A18 Pricing Schedule; and attachment A19 Excel Pricing List for CLINs X016, X020 and X022.

B. An offeror's proposed prices will be determined by multiplying the quantities identified in the pricing schedule by the proposed unit price for each Contract Line Item Number (CLIN) or Subcontract Line Item Number (SLIN) to confirm the extended amount for each. Any indication of performance risk based upon the pricing structure will be noted. Proposal evaluation will then proceed according to this addendum. Offerors whose total evaluated price is unreasonable (in accordance with FAR 15.404 and FAR 31.201-3), or unbalanced (in accordance with FAR 15.404-1), may not be considered for award. Proposal evaluation will then proceed according to this addendum.

(i) The government will evaluate the affordability of each offeror's price proposal by comparing the total proposed price as well as the price of the significant cost drivers to the independent government estimate and budgetary information. The evaluation shall be made on the basis of a separate comparison for each fiscal year of the contract as well as a comparison between the total proposed prices and the total budgetary information.

(ii) The total evaluated price will be derived by multiplying the estimated quantity times the unit price for the CLINs/SLINs. CLINs X001 through X015, X017 through X019, X021 and X023, with corresponding SLINs, shall be evaluated at 100% of the proposed price through the completion of attachment A18 Pricing Schedule. CLINs X016, X020 and X022, with corresponding SLINs, will be calculated automatically by completing attachment A19 Excel Pricing List for CLINs X016, X020 and X022.

C. Next, the contracting officer shall seek recent and relevant performance information from all offerors based on (1) the present/past references provided by the offeror and (2) data independently obtained from other government and commercial sources.

D. Relevant present/past performance includes performance of efforts similar or greater in scope, magnitude and complexity than the effort described in this solicitation. Recent present/past performance includes performance within the last five (5) years. The purpose of the present/past performance evaluation is to allow the government to assess the offeror's probability of meeting the solicitation requirements based on the offeror's demonstrated present/past performance. The assessment process will result in an overall performance confidence assessment rating of Substantial Confidence, or as defined in the DoD Source Selection Procedures. Present/Past Satisfactory Confidence, Limited Confidence, No Confidence, Neutral Confidence performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will be rated as highly as present/past performance information for the principal offeror. Offerors with no recent/relevant performance history or if the offeror's performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned shall receive the rating "Neutral Confidence", meaning the rating is treated neither favorably nor unfavorably.

E. In evaluating present/past performance, the government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this solicitation as defined in the DoD Source Selection Procedures.

"Relevant" rating, Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

"Not Relevant" rating, Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

F. If the lowest priced evaluated offer is judged to have a "Substantial Confidence" performance confidence assessment, that offer represents the best value for the government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.

G. If the lowest priced offeror is not judged to have a "Substantial Confidence" performance confidence assessment, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have a "Substantial Confidence" performance confidence assessment, or until allow offerors are evaluated. The Source Selection Authority shall then make an integrated assessment best value award decision.

H .Offerors are cautioned to submit sufficient information and in the format specified in Addendum to 52.212-1, Instruction to Offerors to permit a meaningful assessment of present/past performance. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of present/past performance information) or respond to adverse present/past performance information to which the offeror has not previously had an opportunity to respond. Adverse present/past performance is defined as present/past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without discussions nor the opportunity for proposal revision.
