All companies must be registered in the System for Award Management at https://www.sam.gov/portal/public/SAM/ to be considered for award. The Government will not provide contract financing for this acquisition. Invoice instructions shall be provided at the time of the award.
(ix) FAR Provision 52.212-2, Evaluation -- Commercial Products and Commercial Services applies to this acquisition with the following Addenda:
(a) The Government will award a contract resulting from this RFQ to the responsible vendor whose quote conforming to the RFQ will be most advantageous to the Government, price and other factors considered.
(b) The following factors shall be used to evaluate quotes, listed in order of importance:
1. Price
2. Technical Acceptability
3. Past Performance
(c) Price - The Government will evaluate quotes by adding the total price of all option CLINs for all options to the total price for the base requirement to determine the total evaluated price (Base + 4 option years). Quotes will then be ranked from the lowest to highest based on total evaluated price.
The Government reserves the right to determine a quote is unacceptable if the option pricing is found to be significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(d) Technical Acceptability -Following the price evaluation, the Government will begin assessing technical acceptability, starting with the lowest-priced quote. The Government will review the submitted Proof of National Environmental Laboratory Accreditation Program certification for validity and currency. If the lowest priced vendor’s NELAP certification is valid and current (i.e., technically acceptable), the evaluation will continue with a review of that vendor’s past performance.
If the lowest priced vendor is found technically unacceptable, the Government will evaluate the next lowest priced vendor, and so on, until a vendor is determined to be technically acceptable, or all vendors have been evaluated.
(e) Past Performance - Once technical acceptability is confirmed, the Government will begin evaluating past performance, starting with the lowest priced technically acceptable vendor. Evaluation of the vendor’s past performance is subjective and will result in a rating of Substantial, Satisfactory, Neutral, Limited, or No Confidence (see table below). Vendors without recent and relevant past performance relating to this requirement will receive a rating of Neutral Confidence.
Rating Description Substantial Confidence
Based on the vendor’s recent/relevant performance record, the Government has a high expectation the vendor will successfully perform the requirement.
Satisfactory Confidence
Based on the vendor’s recent/relevant performance record, the Government has a reasonable expectation the vendor will successfully perform the https://www.sam.gov/portal/public/SAM/ http://farsite.hill.af.mil/reghtml/regs/far2afmcfars/fardfars/far/52_000.htm#P1130_159445 requirement.
Neutral Confidence
No recent/relevant performance record is available or the vendor’s performance record is so sparse, no meaningful confidence assessment rating can be reasonably assigned. The vendor may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence
Based on the vendor’s recent/relevant performance record, the Government has a low expectation the vendor will successfully perform the requirement.
No Confidence Based on the vendor’s recent/relevant performance record, the Government has no expectation the vendor will successfully perform the requirement.
The Government will evaluate past performance for recency and relevancy. Recency is defined as performance of similar services within the past three (3) years from the RFQ. Relevancy is defined as performance of similar services of the same magnitude and scope as those described in the RFQ’s Statement of Work.
(f) If the lowest priced quote is determined to be technically acceptable (i.e., the submitted National Environmental Laboratory Accreditation Program (NELAP) certification is valid and current) and receives a Substantial Performance Confidence rating, that quote represents the best value, and an award will be made to that vendor without further consideration of other quotes. If the lowest priced quote is either technically unacceptable or does not receive a Substantial Confidence rating, the Government will proceed to evaluate the next lowest priced quote in the same manner. This process will continue until a vendor is identified who meets the requirements for technical acceptability and receives a Substantial Confidence rating or all vendors are evaluated. The Government will then determine whether the lowest priced of the quotations having the highest past performance rating represents the best value when compared to any lower priced quotation. The Government reserves the right to award to an other than Substantial Performance Confidence Rated vendor and reserves the right to award to other than the lowest priced vendor.
(g) Vendors are encouraged to submit quotes that reflect their best terms, as the Government intends to award a contract without interchanges. However, the Government reserves the right to conduct interchanges with one, some, all, or none of the vendors if it is determined to be in the Government’s best interest.
(End of Provision)
(x) The clause FAR 52.212-4, Contract Terms and Conditions -- Commercial Products and Commercial Services applies to this acquisition.
Note: The vendor acknowledges that should the quote terms and conditions and/or agreement conflict with mandatory provisions of the Federal Acquisition Regulation (FAR) and other Federal law applicable to commercial acquisitions, to the extent of such conflict the FAR and Federal law govern and conflicting vendor terms and conditions and/or agreement are unenforceable and are not considered incorporated into any resultant contract.
(xi) The Contracting Officer has determined the additional provisions and clauses included below apply to this acquisition.
(xii) This is not a Defense Priorities and Allocations System (DPAS) rated acquisition.
