H-001 PERFORMANCE AND PAYMENT BOND REQUIREMENTS
(IAW FAR 28.101-2 and FAR 28.102-3)
PROPOSAL BOND: The offeror shall submit a Proposal Bond (Standard Form 24) with good and sufficient surety or sureties acceptable to the Government. Proposal Bond, in the amount of twenty percent (20%) of the proposed price. The Proposal Bond penal amount shall be expressed in dollars and cents.
The contractor shall submit a Performance Bond (Standard Form 25) and a Payment Bond (Standard Form 25-A) with good and sufficient surety and sureties to the Government within 15 days of award. The penal sum of such bonds will be as follows:
PERFORMANCE BOND: The penal sum of the performance bonds shall equal $1 million or 100% of the total active task orders, whichever is greater
PAYMENT BOND: The penal sum of the payment bonds shall equal $1 million or 100% of the total active task orders, whichever is greater

| The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the date specified in each task order. The time stated for completion shall include final cleanup of the premises. |

| (a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $254.00 for each calendar day of delay until the work is completed or accepted. |
| (b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause. |

M001. BASIS FOR CONTRACT AWARD: This is a competitive best value source selection in which competing offerors' past performance history will be evaluated on a basis significantly more important than cost or price considerations. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. All offers shall be treated equally except for their prices and performance records. (Failure to meet a requirement may result in the removal from competition or an offer may not be considered). Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
Price Evaluation A. Initially offers shall be ranked according to total price proposed for (CLINs 1001, 2001, 3001, 4001, and 5001). An offeror’s proposed prices will be determined by multiplying the quantities identified in Section B by the proposed unit price for each Contract Line Item Number or Subcontract Line Item Number to confirm the extended amount for each. The extended amounts will be added together to determine the Price Schedule Total for CLIN 1001. The offeror shall submit an escalation rate for each option year in order to calculate a total price.
Pre-Proposal Conference The total price (for evaluation purposes) will be calculated as follows:
Total Price = Base Year + Option Year 1 + Option Year 2 + Option Year 3 + Option Year 4
Base Year (1001) = Price Schedule total Option Year 1 (2001) = Price Schedule total multiplied by escalation rate Option Year 2 (3001) = Option Year 1 multiplied by escalation rate Option Year 3 (4001) = Option Year 2 multiplied by escalation rate Option Year 4 (5001) = Option Year 3 multiplied by escalation rate

Offerors whose total evaluated price is unreasonable (in accordance with FAR 15.404 and FAR 31.201-3), unbalanced (in accordance with FAR 15.404-1), or unaffordable (not within any budgetary information included in the solicitation) may not be considered for award.
Performance Confidence Assessment The contracting officer shall seek relevant performance information on the lowest priced offeror based on (1) the past efforts provided by the offeror and (2) data independently obtained from other Government and commercial sources. The Government may complete Past Performance Questionnaires (after receipt of proposals) with references provided by the offeror or found through other sources.
C. Relevant performance includes performance of efforts involving the repair and maintenance of high voltage electrical distribution systems that are similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The Government reserves the right to seek information on higher priced offerors if none of the lower priced offerors receive a Substantial Confidence performance assessment. The purpose of the past performance evaluation is to allow the Government to assess the offeror’s ability to perform the effort described in this RFP, based on the offeror’s demonstrated past performance. The assessment process will result in an overall performance confidence assessment of Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, or Unknown Confidence, as defined in DoD Source Selection Procedures, Table 5. Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will not be considered as highly as past performance information for the principal offeror. Offerors with no relevant past performance history shall receive the rating "Unknown Confidence," meaning the rating is treated neither favorably nor unfavorably (neutral).
D. In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this RFP.
E. If the lowest priced offeror is judged to have a “Substantial Confidence” performance confidence assessment, that offer represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that offeror without further consideration of any other offers.
F. If the lowest priced offeror is not judged to have a “Substantial Confidence” performance confidence assessment, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have a “Substantial Confidence” performance assessment or until all offerors are evaluated. The Source Selection Authority shall then make an integrated assessment best value award decision. Award may be made to a higher priced offeror based on the best value assessment of the SSA.
G. Offerors are cautioned to submit sufficient information and in the format specified in Section L. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revision.
H. The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision.
