(1) Offerors are responsible for submitting offers and any modifications or revisions to the Government office designated in the solicitation by the time specified in the solicitation.
(2) Any offer, modification, or revision received after the time specified for receipt of offers is “late” and will not be considered unless it is received before award is made and the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition. However, a late modification of an otherwise successful offer that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted.
(3) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

52.212-2 Evaluation—Commercial Products and Commercial Services. EVALUATION—
COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (DEVIATION DATE)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers for the Sludge Removal Services requirement:
Factor 1 – Past Performance:
• Complete the Attachment #7 Past Performance Information (PPI) Sheet. Provide three (3) past performance examples of recent and relevant work. Recent is defined as work performed within the past five (5) years. Relevant is defined as work involving maintenance on SLUDGE services that are in need of service on Scott AFB.
• Complete a Past Performance Information Sheet (PPIS), which should include:
• Customer name and contact information
• Dollar value of the work performed
• Contract number (if applicable)
• Period of performance
• Brief description of the work performed
• Customer assessment of performance (e.g., CPARS rating, letter of recommendation, and point of contact willing to be interviewed)
• In addition to the PPIs, offerors may submit no more than one (1) page of additional information for each of the three (3) past performance examples submitted.
Factor 2 – Technical: Measures of merit for this factor are met when an offeror's technical approach provides the following essential elements:
• Technical Plan: Offerors shall submit a detailed technical plan describing their technical methodology/approach to performing all requirements of the SOW for Sludge Removal.
• Offerors shall not simply copy and paste the information directly in the Statement of Work, but rather shall provide their proposed solution for accomplishing the required service.
• Technical proposal should utilize Times New Roman font, 12 pt font sizing, with standard single spacing. Maximum length of the technical proposal will be 15 pages. If Technical proposal is over 15 pages, please contact the CS and CO.
• Additional information required within Technical Proposal (from SOW):
- Personnel Qualifications: In accordance with SOW 1.1). Provide documentation demonstrating your Regulatory Compliance & Permitting Plan.
Please submit copies of the relevant certifications.
- Land Application: Land Sourcing & Site Authorization. In accordance with SOW 1.1 Describe your experience with not just hauling sludge, but actively securing agricultural land for application. Highlight projects where you successfully matched anaerobic liquid sludge (biosolids).
- Magnitude (High Volume Management): In accordance with SOW 1.1. Your references must prove you can handle 600,000 gallons annually.
- COMPEXITY: In accordance with SOW 1.1 (IEPA/EPA Compliance): You must demonstrate strict adherence to EPA CFR Part 503 (Biosolids Rule) and Illinois EPA (IEPA) regulations. This can include agronomic rate calculations, soil testing, pathogen/vector attraction reduction, and weather-dependent scheduling (e.g., managing storage when land is frozen or saturated).
Factor 3 – Price: The Initial Total Evaluated Price (I-TEP) will be calculated as the sum of the Offeror’s proposed prices for the base period and four 12-month option periods.
• The offeror shall submit pricing to support the completeness and reasonableness of their proposed prices for all contract line-item numbers (CLINS). The pricing information submitted shall fully support the SOW requirements for each year specified. Information shall be segregated by the performance periods and the total price for each CLIN as specified in the solicitation. Information shall also show the consolidated total price for performance. This factor shall be completed in the Pricing Worksheet included in the solicitation package.
• The extended amounts must equal the whole dollar unit price multiplied by the number of units (i.e., gallons). All units and total dollar amounts provided shall be rounded to the nearest dollar.
Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
Addendum to RFO 52.212-2
This is a best value source selection utilizing the subjective trade-off process to determine the offeror who gives the Air Force the greatest confidence it will best meet, or exceed, the requirements as stated in this solicitation. Award will be made to the offeror who is deemed responsible in accordance with the RFO, as supplemented, whose quote conforms to the solicitation's requirements (to include all stated terms, conditions, representations, certifications, and all other information required by RFO 52.212-1 and is judged, based on an integrated assessment of Past Performance, Technical, and Price, to represent the best value to the Government.
The Government will conduct a price analysis to determine whether proposed prices are fair, reasonable, and balanced. The Government seeks to award the offeror who gives the Air Force the greatest confidence that it will best meet, or exceed, the requirements. This may result in an award to a higher rated, higher priced offeror, where the decision is consistent with the evaluation factors, and the requirement owner and Contracting Officer reasonably determine that the superior past performance outweighs the cost difference. The Contracting Officer will base the award decision on an integrated assessment of quotes against the criteria in the solicitation (as described below). While the Government's evaluation team will strive for maximum objectivity, the trade-off process, by its nature, is subjective; and therefore, professional judgment is implicit throughout the entire process.
Strengths Exceedances
The Government intends, if it is in its best interest, to incorporate into the resulting contract, all beneficial aspects of the awardee’s quote and all above-threshold (minimum) attributes, performance levels, or capabilities for which evaluation credit was given.
By submission of your quote, the offeror agrees to all solicitation requirements including terms and conditions and representations and certifications. The offeror shall clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The Government reserves the right to cancel this solicitation, with no obligation to the offeror.
The evaluation will utilize a phased approach consisting of three phases: Past Performance, Technical, and Price. If an offeror receives a rating of Limited or No Reliability for Past Performance in Phase 1, their proposal may not be evaluated further in Phases 2 and 3, depending on the Government’s evaluation of whether or not the weakness is outweighed by other strengths. If an offeror receives a rating of Unacceptable for Technical in Phase 2, their quote will not be evaluated further in Phase 3.
A. Past Performance:
The Government will evaluate the offeror’s Past Performance to determine whether the offeror’s past performance is recent and relevant to this requirement as defined in RFO 52.212-1. The Government will also evaluate how well the offeror performed on prior contracts/projects. In addition to the submitted Past Performance Information Sheets, the government reserves the right to use other sources of past performance information in determining a reliability rating. These sources include but are not limited to: CPARS, internet searches, Better Business Bureau, Google and other online reviews, etc.
Step 1: Recency Assessment:
The Government will first review the past performance information sheets provided by the vendor and those found in other sources (e.g., CPARS) to determine if they are recent. A past performance reference is considered recent if the work was performed within five (5) years prior to the issuance date of this RFQ. References that are not recent will not be evaluated further.
Step 2: Relevancy Assessment:
For all recent past performance references, the Government will assess their relevance to the work required by the SOW. The Government will consider the scope, magnitude, and complexity of the prior work specifically as it relates to Sludge Removal Service. A relevancy rating of Highly Relevant, Relevant, or Not Relevant will be assigned.
- Highly Relevant: The work performed was virtually the same as the SOW requirements for Sludge Removal Services.
- Relevant: The work performed was similar to the SOW requirements for Sludge Removal Services.
- Not Relevant: The work was not similar to the SOW requirements for Sludge Removal Services.
Step 3: Performance Quality and Reliability Assessment:
The Government will evaluate the quality of performance on contracts deemed recent and relevant to assign an overall confidence rating as defined below:
a. Highly Confidence - Based on the vendor’s performance quality on recent and relevant efforts, the Government has a high degree of confidence that the vendor will successfully perform the required effort. The vendor's record indicates performance was of high quality.
b. Adequate Confidence - Based on the vendor’s performance quality on recent and relevant efforts, the Government has a reasonable expectation that the vendor will successfully perform the required effort. The vendor's record indicates performance was of acceptable quality.
c. Neutral Confidence - No recent and relevant performance record is available for review, or the record is so sparse that no meaningful confidence assessment can be made. This rating is not viewed favorably or unfavorably.
d. Low Confidence - Based on the vendor’s performance quality on recent and relevant efforts, the Government has a low expectation that the vendor will be able to successfully perform the required effort. The record may indicate performance issues on one or more contracts.
B. Technical:
The Government will evaluate the Technical Proposal on an Acceptable/Unacceptable basis, assigning a rating of Acceptable or Unacceptable, as defined below.
Acceptable: The submitted proposal is compliant with RFQ and SOW requirements.
Unacceptable: The submitted proposal is non-compliant with RFQ and SOW requirements, rendering it ineligible for award due to the presence of deficiencies.
C. Price:
The Government will evaluate the price proposal submitted in response to this solicitation, reviewing the price proposal to ensure that the proposed price is complete, reasonable, and balanced as defined below. The Government reserves the right to reject an offer if the Contracting Officer determines that the proposed price does not meet the criteria of completeness, reasonableness, and balance.
Completeness: The offeror's price and other supporting information will be evaluated to ensure continuity and traceability of prices to the proposed technical plan and between initial quotes and any revisions thereto. The review will determine the adequacy of the offeror's quote in addressing and fulfilling the solicitation requirements.
Reasonableness: The price proposal will be reviewed to determine the reasonableness of price and the offeror's understanding of and ability to perform the requirement.
Balance: RFO 15.404-6 unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. All separately priced line items will be analyzed to determine if the prices are unbalanced. The offer may be rejected if the CO determines the lack of balance poses an unacceptable risk to the Government.
The Initial Total Evaluated Price (I-TEP) will be calculated as the sum of the Offeror’s proposed prices for the base period and four 12-month option periods. Evaluation of options and the Extension of Services (EOS) shall not obligate the Government to exercise such options. A six-month Extension of Services IAW RFO 52.217-8, “Option to Extend Services” will be utilized if necessary. The six-month EOS is not to be considered part of option period pricing and will be a separate option exercised if it is utilized. After any interchanges or quote revisions, if necessary, the Government will evaluate the Final TEP (F-TEP). Under this factor, the Government will evaluate the Offeror’s TEP based on the following:
General Considerations:
The quote must comply in all material respects with the requirements of law, regulations, and conditions set forth in the solicitation. To be eligible for award, the offeror must be determined responsible as defined in RFO 9.104-1.
A written notice of award or acceptance of an offer, mailed, or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Award will be made IAW the procedures specified in the Simplified Acquisition Proposal Request (SAPR). The Government will award a single contract resulting from the solicitation using the procedures in the Basis of Award section of this clause. In the event adequate price competition is not received, the Contracting Officer will use one or more of the price analysis techniques described at RFO 15.404-1(b)(2) to ensure the price to the Government is fair and reasonable.
Basis of Award:
Award will be made on a best value tradeoff basis. Award will be made IAW the procedures specified in this Request for Quote (RFQ). A contract may be awarded to the offeror who is deemed responsible IAW RFO Subpart 9.1, as supplemented, whose quote conforms to the solicitation requirements and is judged to represent the best value to the Government. The Government will determine prices fair and reasonable through the use of competition. In the event adequate price competition is not received, the Contracting Officer will use one or more of the price analysis techniques described at RFO 15.404- 1(b)(2) to ensure the price to the Government for the initial task order is fair and reasonable.
The Government will evaluate quotes using the following phases:
Phase 1. Past Performance Evaluation: Past performance will be graded on the Performance Quality and Confidence criteria described in the addendum to RFO 52.212-2.
Phase 2. Technical Evaluation: Technical will be reviewed second and evaluated on an acceptable/unacceptable basis per the criteria described in the addendum to RFO 52.212-1 and RFO 52.212-2. If Technical is deemed Unacceptable and not easily made acceptable, price will not be reviewed and the proposal will be ineligible for award due to an Unacceptable rating.
Phase 3. Price Evaluation: Price will be evaluated for reasonableness, completeness, and balance as described in the addendum to RFO 52.212-1 and RFO 52.212-2.
Note: Past performance is more important than Technical (with Acceptable rating) and Price.
The Government reserves the right to award to a higher rated, higher priced offeror where the decision is consistent with the evaluation factors outlined in the solicitation and the Government reasonably determines that the superior past performance of the higher priced offeror outweighs the cost difference. In the event multiple offerors receive equal past performance and technical ratings, price will be the determining factor.
The Government reserves the right to conduct interchanges with offerors. These interchanges may be used to clarify aspects of quotes, resolve minor deficiencies, or allow offerors to revise their quotes (including price). The Government is not obligated to conduct interchanges with all offerors and may award without conducting interchanges.
This acquisition does not require certified cost or pricing data. However, if deemed necessary, the contracting officer may request other than certified cost and pricing data to make a price fair and reasonable determination. To avoid delays, the offeror is encouraged to submit documentation deemed appropriate to support the proposed solution and pricing.
Organizational Conflict of Interest (OCI): At the time of submitting a quote, the offeror must state affirmatively whether or not it has OCI issues and must submit an OCI Identification and Mitigation Plan with the quote if OCI issues exist. The Government-accepted OCI Identification and Mitigation Plan shall be incorporated by reference into a resultant Contract. If no OCI exists, the offeror shall provide a statement stating no OCI exists.
