SECTION 01 00 00

GENERAL REQUIREMENTS

PART 1 GENERAL

1.1 PERFORMANCE OF WORK: Furnish all materials, labor, plant, tools, equipment and supervision necessary to perform work in accordance with statement of work, project drawings, project specifications, and all other applicable contract documents. Commence, prosecute, and complete the work under this contract in accordance with the task order 502

Contracting RFP Letter and MACC contract.

1.2 APPLICABLE DOCUMENTS: The Contractor shall identify and comply with all applicable federal, state, and local statutes; DoD/Air Force instructions, manuals, handbooks, regulations, guidance, and policy letters including but not limited to the most recent version of; International Building Code (IBC); Unified Facility Criteria (UFC); Uniform Plumbing Code

(UPC); Uniform Mechanical Code (UMC) National Fire Protection Association (NFPA); National Electrical Code (NEC);

American Concrete Institute building code (ACI 318); AISC Steel Construction Manual; Adoption of Architectural Barriers

Act (ABA) Guidelines for Accessibility; Specifications included with this solicitation; and including all changes and amendments in effect on the date of issuance of this DO. It is the Contractor’s responsibility to identify and comply with all applicable requirements. In addition, the Contractor shall refer to the latest version of The USAF Project Manager’s Guide to

Design and Construction (located on the AFCEE website).

1.3 SEQUENCE OF DESIGN/CONSTRUCTION: After receipt of the Contract Notice to Proceed (NTP) the Contractor shall initiate design, comply with all design submission requirements as covered under Division 01 General Requirements, and obtain Government review of each submission. Depending on the task order requirements, the Contractor may be allowed to begin construction on portions of the work for which the Government has reviewed the final design submission and has determined satisfactory for purposes of beginning construction. Task orders may require that no construction may be started, with the exception of clearing, excavation, etc, until the Government reviews the Final Design submission for the project and determines it satisfactory for purposes of beginning construction. The Contracting Officer will notify the Contractor when the design is cleared for construction. The Government will not grant any time extension for any design re-submittal required when, in the opinion of the Contracting Officer, the initial submission failed to meet the minimum quality requirements as set forth in the Contract.

If the Government allows the Contractor to proceed with limited construction based on pending minor revisions to the reviewed Final Design submission, no payment will be made for any in-place construction related to the pending revisions until they are completed, resubmitted and are satisfactory to the Government.

No payment will be made for any in- place construction until all required submittals have been made, reviewed and are satisfactory to the Government.

1.4 GOVERNMENT-FURNISHED INFORMATION, EQUIPMENT, MATERIAL, AND PROPERTY (GFI, GFE, GFM, GFP): The Government will provide information in the form of available plans, reports, maps, drawings, and designs as necessary to facilitate accomplishment of the work required in the contract Statement of Work. However, these GFIs show conditions as they existed at the completion of the most recent As-builts. The Contractor shall verify (by field investigation) information shown on the GFI’s (which is relevant to the project) for accuracy to ensure a quality project. Government

Furnished Materials (GFM) will not be furnished to the contractor as a general rule except for equipment specified elsewhere in this solicitation. However, the government reserves the right to provide GFM and/or Government Furnished Equipment (GFE) to be used on this project. In such cases these materials shall be receipted by the contractor and excluded from the price of the contract. The Government shall transport all Government furnished equipment/materials described on the contract. The contractor shall follow the instructions of the Contracting Officer's representative regarding the disposition of all government furnished property not consumed in performance of a contract.

1.5 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (OCT 1989) (ER 415-1-15) (52.0001-4038 1/96)

1.5.1 This provision specifies the procedure for determination of time extensions for unusually severe weather in accordance with the contract clause FAR 52.249-10 entitled "DEFAULT: (FIXED PRICE CONSTRUCTION)." In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe, that

01 00 00 – GENERAL REQUIREMENTS Page 2 of 20 is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the contractor.

1.5.2 The following schedule of monthly anticipated adverse weather delays due to precipitation and temperature is based on National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities. Wind is not considered in the Monthly Anticipated Adverse Weather

Calendar Day Schedule.

MONTHLY ANTICIPATED ADVERSE WEATHER DELAY

WORK DAYS BASED ON (5) DAY WORK WEEK

1.5.3 Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the contractor will record on the daily CQC report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the contractor's scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in paragraph

"b", above, the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the contract clause entitled "Default (Fixed Price

Construction)."

1.6 SEVERE WEATHER: In the event of severe weather, the Contracting Officer or Contracting Officer Representative will notify the contractor and instruct contractor to secure all materials and equipment. Notifications by the Contracting Officer are provided as a courtesy to the Contractor. Contractor shall take immediate action to tie down, remove, or secure his materials and equipment to the satisfaction of the Air Force Inspector in order to protect government property from damage. If contractor fails or refuses to secure materials and equipment as directed, Air Force personnel will accomplish the work at contractor’s expense and contractor shall be responsible for all time and material costs. Contractor shall check all job sites and storage areas within two (2) hours of a severe weather event to ensure debris is removed, fences and barricades are stood up and repaired, and sites are safe and secure.

1.6 EMPLOYEES

1.6.1 Registration and Licensure: All work performed for or on the DOD Installations that requires a state or local license or registration for that trade in nearby cities or areas, shall be required on all Joint Base San Antonio Randolph Air

Force Base (AFB), Lackland AFB, Fort Sam Houston, Seguin Auxiliary Field and any other Department of Defense (DoD) facilities in the greater San Antonio Area projects. The work shall be accomplished by or under the direct supervision or direction of said licensed or registered individual. Contractor shall be responsible for obtaining all required licensure and permits at no additional cost to the government.

1.6.2 Superintendent: During all demolition or construction activities, contractor shall ensure all work is performed under the direct supervision of a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the contractor. If an assigned superintendent is deemed unsatisfactory due to experience or competency by the

Contracting Officer, the contractor shall replace said individual within three (3) business days at no additional cost to the government.

1.6.3 Illegal Drugs and Personal Weapons: Illegal drugs and personal weapons are prohibited at any time on any DOD

Installation. If illegal drugs and/or personal weapons are found in employees possession on DOD Installation, that individual will be reported to Security Forces, their access pass will be revoked, and they will be escorted off of the installation. State issued concealed weapons permits do not apply on Federal installations.

1.6.4 Employee Parking: This area will be within reasonable walking distance of the construction site. Contractor employee parking shall not interfere with existing and established parking requirements of the military installation.

1.7 BASE ENTRANCE AND DRIVING POLICIES - The contractor and their employees shall comply with base traffic regulations.

1.7.1 Commercial Vehicles

a. All vehicles with more than two (2) axles or vehicles with company logo must enter and depart the base through Growden Gate. Growden Gate can be accessed via U.S. 90 Access Road, then South on S. Acme

Road, and right onto Growden Road. Growden Gate is open to inbound and outbound traffic from 0430 to

2000, seven days a week, except for temporary security event closures. Special arrangements for access through the south gate shall be coordinated with the Project Manager (PM) or Project Inspector.

b. Contractor shall anticipate one (1) to two (2) hour delays for trucks at Growden Gate due to vehicle inspection requirements.

1.7.2 Contractor Privately Owned Vehicles (POVs)

a. Contractor POVs with no more than two (2) axels may access the installation from any gate that is open and/or convenient.

b. Airman’s Gate (Valley Hi), and Luke (Gateway) East Gate are open to inbound and outbound traffic 24-hours a day, seven days a week, except for temporary security event closures.

c. Growden Gate is open to inbound and outbound traffic from 0430 to 2000, seven days a week, except for temporary security event closures.

d. Luke (Gateway) West is open to traffic from 0600 to 1400 inbound only, and from 1530 to 1730 outbound only, Monday thru Friday. This gate is closed Saturday and Sunday.

e. Security Hill Gate is open to traffic from 0600 to 1400 inbound only, and from 1530 to 1730 outbound only, Monday thru Friday.

f. Selfridge East Gate open to traffic from 0600 to 1400 inbound only, and from 1530 to 1730 outbound only, Monday thru Friday.

g. Any POVs deemed unsafe by Security Forces or with expired stickers and/or paperwork will not be granted access to the installation.

1.7.3 Random Base Entry/Exit Check Points: The Installation Commander authorizes random base entry and exit point checks. Refusal to submit to these checks can result in loss of base driving privileges and debarment from the installation.

1.7.4 Driving on JBSA Lackland AFB and any other Department of Defense (DoD) facilities in the greater San Antonio

Area

a. Contractor and sub-contractor employees will comply with the base traffic code. Speed limit on Lackland AFB is 30 mph unless otherwise posted. Speed limit is 10 mph when passing troop formation. Speed limit in all housing areas is 15 mph. Speed limit in all service drives and parking lots is 5 mph. Obey the posed base speed limits. Wear seat belts on base IAW AFI 91-207.

b. Do NOT cross the RED LINE Restricted Area at any time. Use of deadly force is authorized.

c. Electronic detection devices are used for measuring speed on DOD Installations. Contractors and their employees are cautioned to obey all speed laws, parking regulations and traffic control devices. Failure to do so can result in loss of driving privileges and debarment.

d. POVs are prohibited from driving on the Airfield, taxiways and aircraft parking areas, except when specific permission has been granted by Airfield Management.

e. All personnel operating or riding in a privately owned, government or contractor vehicles are required to wear seat belts on DOD Installations. Employees will not ride upon any part of a vehicle not intended for carrying a passenger nor will they ride in or upon truck or trailer beds.

f. Use of cell phones while driving on base is prohibited, unless the device is hands free.

g. If you are involved in a traffic accident on Lackland AFB (or other DOD installations), contact Security

Forces at (210) 671-2018 (or the respective installation Security Forces). Inform Security Forces if an ambulance is needed and they will dispatch one. In minor accidents, if the vehicles create a traffic hazard, they may be moved off the roadway away from the flow of oncoming traffic.

1.8 SECURITY REQUIREMENTS FOR CONSTRUCTION CONTRACTS

1.8.1 CONTRACTOR IDENTIFICATION: All contactor and sub-contractor personnel shall display or wear a clearly visible form of Government base issued identification pass and the Contractor’s company name. To obtain a Government, base issued, identification pass, Contractor shall coordinate with the Contracting Officer and Project Manager. In addition, company names may be displayed as name on hat, hardhats, and apparel or company generated ID badges. Contractor shall assure sub-contractors and their personnel comply with this requirement. Refer to AFFARS 5352.242-9000, Contract Access to

Air Force Installations. All contractor personnel must acquire and wear security badges when working on runways and aprons at Lackland AFB.

1.8.2 CONTRACTOR ACCESS TO AIR FORCE INSTALLATIONS: As prescribed by the AFFARS 5352.242-9000, Contractor access to Air Force installations, the contractor shall comply with the following requirements:

1.8.2.1 The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges while visiting or performing work on the installation.

1.8.2.2 The contractor shall submit a written request on company letterhead (or e-mail correspondence) to the PM (with copy to Contract Administrator), with the following required information: contract number, project number, project title, location of work site, work schedule, start and stop dates, and names of contractor employees needing access to the base; including full legal name, date of birth, SSAN, state issued I.D. Card/Driver’s License #, name of sub-contractor if not employed directly by contractor, and length of time required for pass (Government will furnish template to be used in submitting temporary and/or long term pass request). The contractor’s request for visitor passes must be submitted to the PM at least three (3) working days prior to date pass is to be issued for pass up to 30 days, or at least ten (10) working days prior to date pass is to be issues for long term passes over 30 days. Once approved, Contractors arrive at the Airman’s (Valley High) entrance gate Visitor Control

Center, Building 9504, and will present government (state or federal) issued ID before being issued a pass to enter the installation. At the time of issuance, a Wants and Warrants check is conducted for every contractor. Any personnel with active warrants will be detained and the San Antonio Police Department will be contacted. Personnel employed by the contractor must get a pass for their privately owned vehicles with proof of following:

a. State Driver License or state issued I.D. Card

b. Liability Insurance

c. Vehicle Registration

d. State Inspection Sticker (If Required)

1.8.2.3 Upon completion or termination of the contract or expiration of the identification passes, contractors shall ensure that all base identification passes issued to contractor employees are returned to the issuing office. If a contractor employee has been terminated, the pass will need to be retrieved and returned to Security Forces (SF) so that employee does not have base access. If the pass is not retrieved then SF will need to be notified so base access is not allowed. Upon completion of the contract return all issued installation access passes to the issuing authority.

1.8.2.4 Failure to comply with these requirements may result in withholding of final payment.

1.8.3 PASS AND IDENTIFICATION ITEMS: The contractor shall ensure the following pass and identification items required for contract performance are obtained for employees and non-government owned vehicles:

a. Installation Access Pass (IAP) (DBIDS), Visitor/Vehicle Pass (AFI 31-204).

b. Joint Base San Antonio (JBSA) Access Pass- US Government Contractor (Non-CAC) Card (DBIDS), Civilian

Identification Card (AETCI 36-3001)

c. DoD Common Access Card (CAC), (AFI 36-3026), used for contracts for more than one year and requirement exists for access to the government computer systems and software. CAC applications are accomplished by Trusted

Agents via the Contractor Verification System (CVS).

1.8.4 SUITABILITY INVESTIGATING: Contractor personnel shall successfully complete, as a minimum, a National

Agency Check with Inquiries (NACI), before operating government furnished workstations that have access to Air Force e-mail systems. The contractor shall comply with the DoD 5200.2-R, Personnel Security Program, AFI AFI33-100, User

Responsibilities and Guidance for Information Systems, and AFI 33-200, Information Assurance (IA) Management, requirements. NACI investigations requests are initiated using the Standard Form (SF) 85P and are submitted to the installation Information Protection Office through the Unit Security Manager. NACI investigations are different from the wants and warrants checks, and are provided by the government at no additional cost to the contractor.

1.8.5 ESCORTS: All contractor personnel must be escorted at all times in a restricted area by an escort furnished by the

Government. Work requiring escorts shall be scheduled 15 calendar days prior to starting work unless the Contracting Officer waives this requirement. All contractor personnel working in controlled areas must have been trained and granted access IAW

12 FTWI 13-213 or be escorted by someone who has access.

1.8.6 UNESCORTED ENTRY TO RESTRICTED AREAS: When work under this contract requires unescorted entry to restricted areas, the contractor shall comply with AFI 31-101, Integrated Defense, Personnel Security Program Management, as applicable. Contractor personnel shall be the subject of a favorably completed NACI investigation to qualify for unescorted entry to a restricted area. In addition, the Air Force shall submit NACI investigations for contractor employees at no additional cost to the contractor.

1.8.7 LISTING OF EMPLOYEES: The contractor shall maintain a current listing of employees. The list shall include employee's name, social security number, and date of investigation if service work involves unescorted entry to Air Force restricted or other sensitive areas designated by the installation commander. The list shall be validated and signed by the company Facility Security Officer (FSO) and provided to the contracting officer prior to the contract start date. Updated listings shall be provided when an employee's status or information changes.

1.8.8 FREEDOM OF INFORMATION ACT PROGRAM (FOIA): The contractor shall comply with DoD Regulation

5400.7-R/Air Force Supplement, DoD Freedom of Information Act Program, requirements. The regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding For Official

Use Only (FOUO) material. The contractor shall comply with AFI 33-332, Privacy Act Program, when collecting and maintaining information protected by the Privacy Act of 1974 authorized by Title 10, United States Code, Section 8013. The contractor shall remove or destroy official records only in accordance with AFMAN 33-363, Management of Records, or other directives authorized in AFI 33-322, Records Management Program.

1.8.9 REPORTING REQUIREMENTS: The contractor shall comply with AFI 71-101, Volume- 1, Criminal

Investigations, and Volume-2, Protective Service Matters, requirements. Contractor personnel shall report to an appropriate authority, any information or circumstances of which they are aware may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. Contractor employees shall be briefed by their immediate supervisor upon initial on-base assignment and as required thereafter.

1.8.10 PERSONNEL SECURITY: Contractor personnel requiring unescorted entry to controlled or restricted areas designated by the installation commander shall comply with base access requirements. These requirements are contained in

AFI 31-101, for installation access and AFI 31-501, for suitability determinations. Airfield Controlled area access is IAW 12

FTWI 13-213.

1.8.11 ADDITIONAL SECURITY REQUIRMENTS: In accordance with DoD 5200.1-R and AFI 31-401, the contractor shall comply with AFI33-100, User Responsibilities and Guidance for Information Systems ; AFI 33-200, Information

Assurance (IA) Management; applicable AFKAGs, AFIs, and AFSSIs for Communication Security (COMSEC); and AFI 10-

701, Operations Security (OPSEC). The contractor will comply with DoD Standard 22/Force Protection Condition Measures, DoD Standard 25/Level I-AT Awareness Training, and associated tasking contained in AFI 10-245, Antiterrorism (AT) standards. Level I AT Awareness training is available for contractor personnel and can be requested by informing the PM.

1.8.12 PHYSICAL SECURITY: Areas controlled by contractor employees shall comply with base Operations

Plans/instructions for FPCON procedures, Random Antiterrorism Measures (RAMS) and local search/identification requirements. The contractor shall safeguard all government property, including controlled forms, provided for contractor use.

At the close of each work period, government training equipment, ground aerospace vehicles, facilities, support equipment, and other valuable materials shall be secured. During increased FPCONs, contractors may have limited access to the installation and should expect entrance delays.

1.8.13 ENTRY PROCEDURES TO CONTROLLED/RESTRICTED AREAS: The contractor shall comply and implement local base procedures for entry to Air Force controlled and restricted areas.

1.8.14 LOST KEYS: Lost keys shall be reported immediately to the contracting officer. The government replaces lost keys or performs re-keying. The total cost of lost keys, re-keying or lock replacement shall be deducted from the monthly payment due the contractor.

1.8.15 GOVERNMENT AUTHORIZATION: The contractor shall ensure its employees do not allow government issued keys to be used by personnel other than current authorized contractor employees. Contractor employees shall not use keys to open work areas for personnel other than contractor employees engaged in performance of their duties, unless authorized by the

1.8.16 LOCK COMBINATIONS: The contractor shall establish procedures in local OIs ensuring lock combinations are not revealed to unauthorized persons and ensure the procedures are implemented.

1.9 UTILITIES

1.9.1 PAYMENT FOR UTILITY SERVICES: Unless otherwise required by the task order, water, gas, and electricity on

Army posts are normally available from Government-owned and operated systems and will be charged to the Contractor at rates as provided in Contract Clause 52.236-14 AVAILABILITY AND USE OF UTILITY SERVICES. On Air Force bases, these utilities are normally furnished without charge.

1.9.2 COORDINATION: For Contractor Telephone Service, the Contractor shall coordinate with ITBC and the local phone company for contractor telephone service during construction.

1.9.3 OUTAGES: Coordinate all utility outages through the Contracting Officer or his representative. Utility outages shall be defined as a stoppage in electric power, gas, potable water, chilled or hot water, sewer, steam, telephone, fiber, Energy

Monitoring and Control System (EMCS), or any other similar utility whether serving all or a part of a single facility or of several facilities. All utility outages shall be coordinated through the CO and the PM. The Contractor shall obtain a blank

OUTAGE REQUEST form from the PM. Notice of the necessity for an outage shall be provided to the CO and PM, in writing, not less than fifteen (15) working days prior to the time of the required outage and written approval for the outage by the CO.

The Contracting Office will grant final written approval for the outage. All utility outages shall be scheduled during non-working hours, or on weekends to have minimal disruption to occupied areas. Coordinate all work to ensure that the outage will be of minimum duration. If the Government cancels an approved scheduled utility outage, the Contractor will reschedule another outage at least 24 hours in advance and will not claim for equitable adjustment or increased costs of performance as a result of any unforeseen cancellation. Once a utility outage is arranged and work starts, continue working until the utility is restored.

All work shall be coordinated and arranged to ensure that the outage shall be of minimum duration. Additionally all materials needed for the outage shall be on site and all required labor shall be scheduled in order to prevent any delays beyond the approved outage period. In the event a scheduled outage is canceled by the Government, notification shall be given to the contractor at least twenty four (24) hours in advance of the time for the outage to start and the contractor waives his right to any claim for equitable adjustment or increased cost of performance under this contract as a result of this cancellation.

Rescheduling of a cancelled outage must be coordinated with written notification as described above. Once a utility outage is arranged and work begun, work must go on until the affected utilities are restored to the affected facility.

1.10 EXCAVATION PERMIT (DIGGING PERMIT): The contractor shall complete a Digging Permit before starting any excavation work on base. Excavated material is the property of the contractor and shall be removed from the base. Only soil that is to be reused, as fill at the project site, may remain at the construction area. The PM shall assist the contractor in obtaining the excavation permits. The contractor shall provide drawings and details showing exact location and description of the type of excavation to be accomplished. Should any one of the coordination points indicate an additional underground utility or structure over and above those shown on the contract drawing either by sketch on the contractor's drawing by field pointing or by flagging, the contractor shall be responsible for protection of each of the items indicated. Should damage occur to any of the items indicated by the contractor, contract drawings or coordinating agency to the permit, the contractor shall be responsible for prompt repair of the damage to return the item to its original workable condition.

The Contractor shall obtain a blank AF Form 103, BASE CIVIL ENGINEERING WORK CLEARANCE REQUEST (often called a digging permit) from the PM. The Contractor shall contact 502 CES/CEOI, at (210) 671-3533 to schedule a digging permit approval (AF Form 103) to perform any digging on Lackland AFB. Digging permits shall be requested at least 10 working days in advance.

The CE work order controller will assign a Job Order Number and schedule a time for the base agencies to meet at the job site with the Contractor’s job superintendent. The Contractor shall contact Dig Test at 1-800-344-8377, Time Warner Cable 210-

352-4672, 502 Communication Squadron and AT&T 1-800-828-5127. AT&T utilities are only located in housing areas; base communications is located everywhere else. After each government agency, to include Time Warner Cable and AT&T, has signed the AF Form 103, the Contractor shall deliver the form to the PM for final approval signatures. The PM will return a copy of the completed AF Form 103 to the contractor.

It shall be the responsibility of the contractor to document and preserve markings until they are no longer needed. The government will not be responsible for re-marking an area already covered by an existing digging permit.

The AF Form 103 must be updated every 30 days. It is the contractor’s responsibility to ensure the AF Form 103 is kept up to date. It is the Contractor’s responsibility to resubmit the form to 502 CES/CEPM for update approval signatures. The PM will return a copy of the updated AF Form 103 to the contractor. A copy of the approved digging permit shall be available on site any time excavation is in progress.

All excavations other than building foundations must have site restoration (sod, hydro-mulch, pavement or other scheduled restoration), completed within 14 calendar days (excluding approved rain delay days) after excavation has been initiated.

1.11 WATER CONSERVATION: Conserve water to the greatest extent possible.

1.11.1 WATER RESTRICTION: If JBSA - Lackland implements water usage restrictions, the contractor is required to comply with these restrictions, at no additional cost to the government. In the event the contractor cannot comply with water usage restrictions and still meets other contract requirements (particularly when installing sod or hydro-mulching), then he can request permission from the Contracting Officer for relief from the restrictions.

1.11.2 WAIVERS: Submit request for waivers to water conservation restrictions in writing. The Contracting Officer will consider such cases on an individual basis and grant waivers only in extreme cases. Submit detailed requests with appropriate manufacturer’s/supplier’s data to show unavoidable noncompliance with the water usage restrictions. In the event a restriction is conditionally waived, use only the minimum amount of water necessary to comply with contract requirements.

1.12 QUALITY CONTROL: The contractor shall be required to institute a comprehensive Quality Control Program in order to insure that all materials and workmanship are in strict accordance with the provisions of the specifications, codes, and drawings. The contractor bears full responsibility for quality control in all aspects of projects, from design through project completion.

1.12.1 The Contractor shall maintain adequate Quality Control capabilities regardless of the volume of workload. The

Contractor shall provide a Quality Control Plan (QCP) that describes the Contractor’s quality control program(s)/process(es).

This plan should be broad enough to address all aspects of quality control, including responsibility for surveillance of work by subcontractors and in-house quality control inspectors.

1.12.2 The plan shall detail the process for acceptance, rejection, documentation and resolution of deficiencies for work performed (by in-house work force or subcontractors), trend analysis, corrective action to identify poor performance (by any work staff), and the plan to interface with Government inspectors. This plan shall become a compliance document upon contract award. This plan shall include the amount of work to be inspected by the contractor and the frequency of inspections, with a minimum of once per day per job. This plan shall remain in effect for the life of the contract. The government reserves the right to request any necessary changes to the QCP during the life of the contract.

1.12.3 Within 14 days after of contract award, and prior to commencement of work on the first delivery order issued, the contractor shall submit a Contract Quality Control Plan (QCP) acceptable to the government. This QCP shall address all phases of the Contractor’s design and construction process to ensure all components of work meet required standards. A special QCP may be required for certain delivery orders at the discretion of the government.

1.12.4 The QCP specifically and exclusively relates to the acceptable completion of work and subsequent government inspections and approvals. It is the Contractor’s responsibility to provide, inspect, and document the level of quality that has been established by the minimum standards of the SOW.

1.12.5 Quality Control Manager (QCM): The QCM shall direct the execution of the Contractor’s QCP with responsibility for administration of the plan and inspection of work. The QCM, or an alternate QCM, as pre-identified by the contractor’s

Project Manager, shall be available during normal duty hours within 30 minutes after notification to meet with the Contracting

Officer (CO) at a location selected by the CO.

1.12.6 Progress Meetings: Progress meetings shall be conducted once every two (2) weeks, at minimum, and shall be attended by representatives from the Contracting Office, the Base Civil Engineering Office, and the Contractor. The

Contracting Officer will electronically distribute the weekly meeting minutes to the Contractor and the Contractor shall be acknowledged with one (1) work day of receipt on items the contractor may disagree on. The disagreed on items from the weekly meeting minutes shall be responded in writing to the Contracting Officer listing the basis for disagreement.

1.12.7 Key Control: The contractor shall establish and implement key control procedures in the Quality Control Plan to ensure keys issued to the contractor by the government are properly safeguarded and not used by unauthorized personnel. The contractor shall not duplicate keys issued by the government.

1.13 INSPECTION AND ACCEPTANCE: Inspection and final acceptance will be made as the contractor completes all work covered by the contract, each delivery order, and all work associated with a complete entity within a contract. The contractor shall request pre-final and final inspections 48 hours in advance in writing through the Contracting Officer.

1.13.1 Inspections shall be staggered such that two inspections will not occur at the same time.

1.13.2 Incomplete work will not be accepted for final inspection. The Contracting Officer or the Contracting Officer's representative reserves the right to cancel an inspection for an unreasonable number of deficiencies or if a major entity of work remains incomplete. Request rescheduled inspections 48 hours in advance.

1.13.3 After completion of all pre-final/final inspections, a list of the noted deficiencies will be provided to the contractor.

1.14 SALVAGE MATERIAL AND EQUIPMENT: Items indicated in the contract to be salvaged shall remain the property of the Government. The salvaged property shall be segregated, itemized, delivered, and off-loaded at the Government designated storage area located on base. Contractor shall be responsible for storage and protection of salvaged materials and equipment until disposition by the Contracting Officer.

1.15 UNAUTHORIZED RECONNAISSANCE: The Contractor shall inform all personnel working under his/her jurisdiction (including subcontractor and visiting supplier personnel) that access to areas outside of the immediate work area

(excluding on base eating establishments, direct haul and access routes, Contracting and Civil Engineering offices, and points of supply and storage) is prohibited. Circulation of said personnel shall be limited to official business only. Persons engaged in unauthorized reconnaissance of other Contractor's or Government activity shall be referred to the Contracting Officer for disposition. Infractions involving possible compromise of national security will be turned over to the Office of Special

Investigation (OSI) for disposition.

1.16 PROTECTION OF CONTRACTOR PROPERTY: Security Forces patrols will periodically check Contractor equipment. This service is a courtesy, but the government is not responsible for lost or stolen property. Contractor shall secure all property during lunch and at close of work daily. No private security guards will be permitted. Direct questions about securing property or to report thefts or vandalism, contact Security Forces at (210) 671-2018.

1.17 EXERCISES: DOD Installations conduct regular exercises to ensure readiness in the event there is a terrorist attack or natural disaster. Exercises may last up to four (4) hours at a time. Contractor shall be prepared to participate in exercises if required. Participation may include stopping work, denied access to the base, moving vehicles away from buildings or participating in stringent identification and/or vehicle inspection. Contractor shall participate as required at no additional cost to the government. Contract work that is time-sensitive (e.g. pouring concrete) shall not be affected by exercises. In the event there is a conflict, contractor shall contact the Contracting Officer or Project Manager immediately to resolve the issue.

2 SAFETY

2.1 GENERAL REQUIREMENTS

2.1.1 Provide a Site Safety and Health Officer (SSHO) at the work site at all times to perform safety and occupational health management, surveillance, inspections, and safety enforcement for the Contractor. The Contractor QC can be SSHO on this project.

2.1.2 The contractor shall submit a site specific Accident Prevention Plan (APP) for government approval to the Contracting

Officer at least 14 calendar days prior to commencing work. Work cannot proceed without an approved APP. All changes to the approved APP shall be made with the knowledge and concurrence of the Contracting Officer and 502 CES PM. At minimum, the APP shall discuss the following topics:

2.1.3 Contractor and their employees shall provide a safe and healthful workplace for employees while performing contract work. Contractor accidents involving injury to Air Force personnel or damage to government property shall be reported to the

Project Manager, Contracting Officer, the 502 ABW Ground Safety Office at (210) 671-3969, and any provision outlined in the

Federal Acquisition Regulation (FAR) Clause 52.236-13, Accident Reporting.

2.1.4 Contractor shall at all times during the life term of this contract, maintain, keep current, and make available upon request by the Contracting Officer, a Material Safety Data Sheet (MSDS) that list all items currently being stored by the

Contractor or his/her sub-contractor on this installation, that includes but not necessary limited to any Ozone Depleting

Chemicals, any items that are listed as being a Hazard under SECTIONS 013535, 014100, and 028000, any paint, and/or chemicals of any nature.

2.1.5 Contractor and their employees are subject to no-notice inspections by the Occupational Safety and Health Act

(OSHA) Programs and Department of Labor inspectors. Contractor and their employees shall comply with applicable guidance set forth by law. Contractor to comply with the general safety requirements IAW DOL regulations, OSHA, as well as applicable AFOSH standards and AFRs. These standards and AFRs are available in the 502 TRW/SEG, Ground Safety Office, Building 2484 and include but are not limited to:

2.2 SITE CONTROL: Contractor shall provide positive control of all construction sites. Contractor shall ensure all individuals entering construction site are wearing appropriate Personal Protective Equipment (PPE). Contractor shall direct any individuals accessing construction site without PPE to leave site immediately. Contractor shall report names of any individuals refusing to leave site to Contracting Officer and the Project Manager.

2.3 FIRE REGULATIONS AND PREVENTION PRACTICES: Contractor shall comply with fire prevention practices as set forth by the National Fire Protection Association (NFPA), other recognized fire prevention agencies, and base regulations.

2.4 EXPLOSIVE OPERATED HANDTOOLS: If explosive operated hand tools are used, notify 502 ABW Ground

Safety Office at (210) 671-3969. The Contractor shall comply with OSHA Standard 1910.215 (c) when utilizing explosive operated hand tools. Explosive cartridges shall be stored in metal containers and shall be limited to a one (1) day supply.

Contractor shall provide adequate controls to prevent loss and/or theft of cartridges used and stored on the installation.

2.5 WELDING: Welding/Burn Permits and Welders Certifications are required whenever the use of a torch or flame for welding or cutting is required. Contractor to obtain a welding permit issued by the JBSA Lackland Fire Department.

2.6 RADIOACTIVE MATERIALS: Use of radioisotopes or radiation producing equipment (density gauging, NDE weld testing, etc.) requires a Nuclear Regulatory Commission (NRC) Radioactive Material License, with all documentation submitted and approved prior to bringing the material on base. To obtain authorization contact the Base Radiation Safety

Officer (BRSO), at 559 AMDS/SGPB, Bioenvironmental Engineering Office, Building 5595, phone 671-7061.

2.6.1 The Contractor shall also comply with all requirements of AFI 40-201, Lackland AFB Supplement 1, AFI 40-201, and

AFI 48-148 which can be reviewed in the Base Bioenvironmental Engineering Office.

2.6.2 Contractor shall forward application to the BRSO 30 days prior to commencing operations using radioactive materials.

2.6.3 Contractors possessing Agreement State Licenses must also submit an NRC Form 241 to NRC in compliance with 10

CFR 150.20. Contractors requiring more than 180 calendar days per calendar year of operation must possess an NRC license.

Request shall include the following:

a. Description of proposed activities on NRC Form 241.

b. Procedures established to ensure radiological health and safety of all personnel.

c. Name of responsible Contractor representative.

d. Current copy of application NRC or Agreement State License. The license must specifically state the installation by name or approval for temporary job sites anywhere in the United States where the NRC or Agreement State maintains jurisdiction.

e. The part of the Air Force contract describing work to be done at the base and the inclusive dates of such work

f. An acknowledgement that the BRSO can make periodic checks to ensure the Contractor is following applicable radiological health and safety practices.

3 SITE SPECIFIC REQUIREMENTS

3.1 PROJECT SCOPE: All work shall be in conformance with the Government Statement of Work (SOW), specifications and sketches/drawings including the furnishing of all materials, labor, plant, tools, transportation, equipment, services

(including engineering/technical design support) and incidentals necessary thereto.

3.2 JOB SITE VERIFICATION: The contractor shall visit the job site to verify location, conditions and dimensions prior to starting work. The government agrees to provide access to all available and relevant drawings the Contractor may need to develop a delivery order cost proposal. This solicitation provides one (1) copy of record drawing that is relevant to the work required. The integrity of these drawings is not guaranteed and the contractor must field verify all items on the drawings prior to preparing their cost proposal.

The existing dimensions and locations shown on the applicable drawings are for approximation purposes only. Failure to verify the dimensions, conditions, and locations shall be at the contractor's risk and shall not relieve the Contractor from accomplishing the work required by the contract, at the price awarded by the Government. The Government does not guarantee the accuracy or adequacy of existing government drawings (as-builts drawings, facility, utility, etc.). It is the

Contractor's responsibility to verify all as-built conditions prior to submission of a cost proposal and/or issuance of each delivery order. Failure to do so shall not relieve the Contractor of responsibility for his design, and shall not constitute a basis for reimbursement for cost increases resulting from inaccuracies of government provided drawings. Note: Any differing site conditions (FAR 36.502), based on reasonable inspection as prescribed in FAR 36.503 and as determined by the contracting officer will be addressed individually and any warranted modifications issued accordingly.

3.3 RECORDING AND PRESERVING HISTORICAL AND ARCHEOLOGICAL FINDS: All items having any apparent historical or archeological interest that are discovered in the course of any construction activities shall be carefully preserved. The Contractor shall leave the archeological find undisturbed and shall immediately report the find to the

Contracting Officer so that the proper authorities may be notified.

3.4 TOILET FACILITIES: Toilet facilities are not available for use by Contractor personnel. The Contractor shall aquire and maintain portable toilet facilities as directed by the Contracting Officer. This item shall be included as a separate line item for each appropriate delivery order.

3.5 COORDINATION WITH GOVERNMENT ACTIVITIES: The Contractor shall adhere to the requirements of each individual Using Activity or organization. Any infringement on the normal working conditions (i.e. working on Airfield) shall be coordinated with the user at least 24 hours in advance.

If it becomes necessary to interrupt the using agency's work activities in buildings and/or areas for construction purposes, permission to do so must be requested in writing to the Contracting Officer five (5) working days in advance. Written requests

01 00 00 – GENERAL REQUIREMENTS Page 11 of 20 for street closings shall be submitted to the Contracting Officer for approval fourteen (14) working days prior to closing of the street. The Contracting Officer shall coordinate requests through the Project Manager.

3.6 GOVERNMENT LIABILITY: The government will not be liable for any loss or damage to the contractor’s property, including stock or for expense incidental to such loss or damage.

3.7 REMOVAL AND REPLACEMENT RESPONSIBILITY: The contractor shall be responsible for the replacement or repair of all existing finished surfaces, utilities, equipment, landscapes, grounds, and structures or parts thereof that the contractor has damaged, removed, or cut into in order to perform work specified. (Reference Section I, FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements)

3.8 INSPECTIONS: Interim Inspections/Tests: The contractor shall notify the Contracting Officer and the Project

Manager a minimum of least 1 working day (not less than 24 Hours) in advance via electronic message thru the Contracting

Officer. Interim inspections shall include be not limited to the following: framing; concrete, paving, plumbing, ceiling, electrical, re-enforce steel, HVAC, air balance, etc. Per FAR 52.246-2, the Contracting Officer may charge the Contractor for any additional cost of inspection or test when prior rejection makes re-inspection or retest necessary. This cost shall include the man-hours of Government personnel present to re-inspect.

3.9 PRE-FINAL INSPECTION: The Contractor shall conduct a pre-final walk through inspection and publish the pre-final inspection findings in a pre-final inspection report. Commissioning needs to be completed prior to the pre-final inspection taking place.

3.10 FINAL INSPECTION: The Contractor shall conduct a final inspection and publish the findings in a final inspection report in accordance with the format specified at the pre-construction conference and the RFP. The inspection shall concentrate on the items identified at the pre-final inspection and recorded in the pre-final inspection report. The final inspection report shall: (1) certify that all items of the design have been implemented and that the construction is complete, and

(2) include a record of “signed and sealed” as-built drawings and specifications verifying that all development standards have been met. At the final inspection, the Contractor shall present a completed DD Form 1354, Transfer and Acceptance of Real

Property to the Base Civil Engineer (BCE) or other appropriate organization for signature and acceptance.

3.11 DELIVERY AND WARRANTY: The Contractor shall complete all inspection and commissioning requirements prior to pre- final inspection. The warranty shall be issued in accordance with FAR 52.246-21 (Warranty of Construction).

Extended warranties offered by the Contractor and its subcontractors or suppliers may be accepted at the Government’s discretion.
