This is a combined synopsis/solicitation for commercial services and/or supplies prepared in accordance with the format in FAR Subpart 13.5 and FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will NOT be issued. The solicitation number for this requirement is FA2543-19- R-A001 and is hereby issued as a Request for Proposal (RFP) using subpart FAR Part 13, Simplified Acquisition Procedures.
The 460 CES/CEOES, Buckley AFB, Colorado requires a contract for the following item: A 12-month base period and four 1-year possible options (CLINS 0001 – 4120) with the possibility of a 6-month option to extend services period to perform Integrated Solid Waste Management Services. (See the attached Performance Work Statement (PWS), dated 8 August 2018 for specific details.) Any option periods will be exercised in accordance with 52.217-9, Option to Extend the Term of the Contract and 52.217-8, Option to Extend Services. A full service contract is required.
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-99 effective 16 Jul 2018, DFARS DPN 20180629 effective 29 Jun 2018 and AFFARS AFAC 2018-0525 effective 25 May 2018. The North American Industry Classification System (NAICS) code is 562111– Solid Waste Collection with a Small Business Size Standard of $38.5 Million.
This procurement is a 100% small business set aside. Women and women owned, service disabled veteran owned, and small disadvantaged businesses are strongly encouraged to submit proposals. The Government intends to issue a firm fixed price contract to the responsible Offeror whose lowest price and technically acceptable proposal conforms to the solicitation. Only technically acceptable offers will be considered.
The Government intends to evaluate offers and make award without discussions; however, this does not preclude the Government from having discussions if it is in the best interest of the Government. All interested parties must bid on all items.
Please Note: Funds are not presently available for this contract.

(a) Definitions. As used in this clause--
Covered article means any hardware, software, or service that--
(1) Is developed or provided by a covered entity;
(2) Includes any hardware, software, or service developed or provided in whole or in part by a covered entity; or
(3) Contains components using any hardware or software developed in whole or in part by a covered entity.
Covered entity means--
(1) Kaspersky Lab;
(2) Any successor entity to Kaspersky Lab;
(3) Any entity that controls, is controlled by, or is under common control with Kaspersky Lab; or
(4) Any entity of which Kaspersky Lab has a majority ownership.
(b) Prohibition. Section 1634 of Division A of the National Defense Authorization Act for Fiscal Year 2018 (Pub. L. 115-91) prohibits Government use of any covered article. The Contractor is prohibited from--
(1) Providing any covered article that the Government will use on or after October 1, 2018; and
(2) Using any covered article on or after October 1, 2018, in the development of data or deliverables first produced in the performance of the contract.
(c) Reporting requirement. (1) In the event the Contractor identifies a covered article provided to the Government during contract performance, or the Contractor is notified of such by a subcontractor at any tier or any other source, the Contractor shall report, in writing, to the Contracting Officer or, in the case of the Department of Defense, to the website at https://dibnet.dod.mil/. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil/.
(2) The Contractor shall report the following information pursuant to paragraph (c)(1) of this clause:
(i) Within 1 business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; brand; model number (Original Equipment Manufacturer (OEM) number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the report pursuant to paragraph (c)(1) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of a covered article, any reasons that led to the use or submission of the covered article, and any additional efforts that will be incorporated to prevent future use or submission of covered articles.
(d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items.

FAR 52.209-11 Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that—

(a) North American Industry Classification System (NAICS) code and small business size standard.
The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is
4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest;
accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

ADDENDUM TO FAR PROVISION 52.212-1, INSTRUCTIONS TO OFFERORS –
COMMERCIAL ITEMS (Oct 2016)
(A) GENERAL
The following instructions are provided to ensure the submission of information necessary to properly evaluate the offeror’s proposal. Submit a complete proposal as detailed in this section and FAR 52.212-2, Evaluation— Commercial Items. Include only information relevant to this requirement. Failure to properly provide all information required by this solicitation may result in an invalid proposal. To accomplish a fair and reasonable pricing determination, the offeror must comply with the requirements of FAR Part 12. The SOLICITATION constitutes the model contract.
(B) FORMAT
1. Provide proposal on company letterhead or a SF 1449 with all appropriate blocks completed.
2. Include the Company’s Name & Address. Also include the name, address, and telephone number and email address of the offeror.
3. Indicate the Solicitation Number – “FA2543-19-R-A001”
4. Indicate the day/time specified in the solicitation for receipt of offers “5 September 2018 by
1400 (MST)”.
5. Provide the offeror’s DUN and Cage Codes.
6. Provide offeror’s Socio-economic Set-Aside – Example Small Disadvantaged, Veteran Owned etc. designation.
7. Indicate any terms of an express warranty.

13. Offeror is to review provision FAR 52.212-3, Offeror Representations and Certifications –

Only paragraph (b) of that provision must be returned if the offeror has completed the annual representations (reps) and certifications (certs) electronically at https://www.acquisition.gov. If the offeror has not completed the annual online reps and certs, then the offeror shall complete paragraphs (c) through (m) of this provision. The offeror shall provide either the paragraph (b) information or the (c) through (m) information along with the proposal.
14. Acknowledge any Solicitation Amendments issued. If the solicitation is amended, the offeror is responsible to acknowledge receipt of the Amendment prior to the hour and date specified in the Amendment. Failure to acknowledge receipt of the Amendment may result in rejection of your offer. Instructions on how to acknowledge receipt of the Amendment are contained in the Amendment.
15. Include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

18. Provide a letter of authorization for the Contracting Officer to verify the offeror’s financial responsibility. Include financial institution’s name, address, primary point of contact, and phone numbers for financial institutions.
19. Provide the offer on company letterhead, address all items under paragraph (B) Format and (C) Specific Instructions. Have an authorized company party sign and date the offer.
(C) SPECIFIC INSTRUCTIONS
PRICE PROPOSAL
a. The pricing proposal must be submitted for a base year plus four (4) twelve (12) month option periods and a six-month Option to Extend Service period.
b. The Government expects the contractor to develop technical solutions, techniques, policies and processes that will result in cost reducing efficiencies throughout the life of this contract. The contractor’s price proposal shall reflect those cost saving initiatives in each subsequent option period. (If it is not possible to show a decrease in each proceeding option period, provide justification of why it is not possible.)
c. Firm-fixed priced CLINs 0001 through 4120 – All UNIT ITEM and EXTENDED PRICES shall be rounded to the nearest whole cent.
d. To support the price provided for the firm-fixed price CLINs, provide a separate Price Breakdown explanation in sufficient detail to show the cost elements that make up the total proposed CLIN pricing. Submit the price breakdowns to include direct labor hourly wage rates broken down into fringe benefits rates, Workman’s Compensation, FICA, other applicable direct/indirect costs, overhead, G&A and profit.
e. The EXTENDED PRICE amount must equal the whole dollar UNIT PRICE multiplied by the number of units. All calculations shall be validated.
f. Add the EXTENDED PRICES together for each period and complete the space for a final TOTAL PRICE that is also in whole dollars.
g. Note: CLINs 5001 - 5120 are included in accordance with FAR 52.217-8 Option to Extend Services. DO NOT SUBMIT PRICING FOR CLINs 5001 - 5120. These CLINs are provided to cover the extension of services option period. This section puts you on notice that the Government has included in the contract the above clause to extend services at the same price as the last performance period plus any applicable wage determination increase. The Government will evaluate price reasonableness on this CLIN for award by placing one-half of the total cumulative price for CLINs 4001 - 4120, in the AMOUNT section of CLINs 5001 - 5120. In accordance with FAR 52.217-8, if utilized, these CLINs will be exercised under the same terms and conditions that the contract is in at the time of exercise. Although the Government will evaluate the offer by utilizing the last option period prices, it reserves the right to exercise this option IAW FAR 52.217-8.
TECHNICAL PROPOSAL – Limited to no more than 20 pages. The technical proposal shall address the offeror’s ability to meet the requirement set forth in this solicitation. The Government will evaluate the technical proposal and assign a rating of acceptable or unacceptable. The technical proposal shall address the https://www.sam.gov/ following (3) factors:
1. Technical Capability: The offeror shall submit integrated solid waste management and recycling capability to include the collection and disposal of integrated solid waste and recycling waste. The offeror shall provide a yes/no response to the following questions along with a brief description to demonstrate expertise in refuse, recycling and solid waste. Technical Capability shall not exceed 10 pages, letter-size 8.5 by 11, 1” margins, 12 pt. Font, Times New Roman.
a. Does the offeror have at least 5 years of trash and recycling collection management experience? If yes, provide a brief listing of type of experience involving management.
b. Does the offeror have solid waste management experience? If not, explain how you intend to meet and perform this requirement.
c. Does the offeror have experience hauling refuse and recyclables in large volume? Submit an outline of level of volume experience.
d. Does the offeror have experience operating and maintaining a recycling collection point? If not, explain how you intend to meet and perform this requirement.
2. Management Approach: The offeror shall include emergency services, quality assurance, training and equipment use and operation as specified in the PWS. The offeror shall provide a management plan proposing a staffing approach that adequately provides personnel to have the qualifications IAW the PWS to include retention and replacement of personnel and organizational structure.
Management Approach shall not exceed 10 pages, letter-size 8.5 by 11, 1” margins, 12 pt. Font, Times New Roman.
The offeror shall submit a realistic manpower schedule by year that adequately depicts sufficient numbers of personnel by labor classifications/skills to fulfill the proposed PWS. Sufficient details shall be provided to support manpower requirements for each specific workload area, including full-time, part-time, temporaries, cross-utilization, and any subcontractor effort. If any of the effort during the life of the contract is to be subcontracted, the offeror must clearly identify in the manning table how subcontractor labor force will be utilized and to what extent subcontractor effort is required and or relied upon in accomplishing all the requirements of the PWS. 3. Quality Control and Service Interruptions Approach: Demonstrate preliminary quality control approach to ensure all services listed on the Service Summary (SS) are performed and inspected in accordance with the standards of the PWS. The final quality control plan will be submitted within
(10) days of award of the contract. Quality Control Approach shall not exceed 8 pages, letter-size
8.5 by 11, 1” margins, 12 pt. Font, Times New Roman.
PAST PERFORMANCE INFORMATION – Limited to no more than 20 pages. Only references for same or similar type contracts desired.
a. Past Performance: The Government will evaluate the quality and extent of offeror’s experience deemed relevant and recent to the requirments of this RFP. The Government will use information submitted by the offeror and other sources such as other Federal Government offices and commercial sources, and may contact all sources by any means (phone, e-mail, mail etc.) to assess experience.
Provide a list of the most relevant contracts performed for Federal agencies and commercial customers within the last three years from the issue date of this solicitation.
Recent past performance is defined as past performance on contracts within the last three years from the issue date of this solicitation.
Relevant contracts include all refuse related projects, ranging between $200,000.00 to $500,000.00 per year, performed within the last three years prior to the issue date of this solicitation.
Relevance will be determined based in part of the specific work the contractor has proposed to perform on this RFP. In the past performance information provided, directly show direct link between the work performed and the work the contractor has proposed to perform on this effort.
Describe management experience that demonstrates ability to manage refuse collection services estimated to range between $200,000.00 to $500,000.00 per year. The evaluation of past performance will take into account past performance information regarding any relevant past performance information pertaining to subcontractors, teaming partners, key personnel and predecessor companies, who have relevant and recent experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition as determined by the Contracting Officer. Furnish the following information for each contract referenced:
