About this file
This document is a Service Level Agreement (SLA) for Human Resources, Payroll, Time, Labor, and Leave Services for the State of Texas Health and Human Services (HHS) agencies, including the Department of State Health Services (DSHS), Department of Family and Protective Services (DFPS), and Cancer Prevention and Research Institute of Texas (CPRIT). The SLA establishes 87 distinct performance standards and service level components that the contractor must meet across multiple operational areas including audits and compliance, reporting, call center operations, human resources and recruitment functions, payroll processing, benefits administration, system availability, security management, and disaster recovery procedures. Performance benchmarks vary by service component, ranging from 95 to 100 percent achievement targets with timeframes spanning from same-day responses to annual submissions. The contractor is required to submit numerous plans and reports on specified schedules, including Quality Management Plans, Security Management Plans, Disaster Recovery and Business Continuity Plans, Integration Management Plans, Change Management Plans, and Transition Plans, most due within 30 calendar days of contract execution or the effective date.
Liquidated damages are assessed for each service level failure, with individual penalties ranging from $200 to $51,000 per incident depending on the specific performance standard, measured incrementally by business day or percentage point deviations below benchmarks on a monthly, annual, or as-needed basis. The cumulative total of liquidated damages that may be assessed for failure to meet required service levels is capped at $500,000 per calendar quarter. Critical operational areas carry substantial penalties, including $20,000 per payroll document for on-cycle payroll production failures and $50,000 per business day for implementation failures during the transition phase. The SLA specifies detailed accuracy and timeliness requirements for payroll-related functions, federal and state reporting obligations (941s, W-2s, 1095-Cs, unemployment reports), benefits processing, temporary assignments, and system performance metrics including call handling and interactive voice response system availability at 99.9 percent uptime standards.
