About this file

This is an Exhibit N form from the Texas Department of Agriculture regarding confidential or proprietary information disclosures under the Texas Public Information Act (PIA). The document establishes the framework for respondents to the "Public Outreach and Marketing Services - Don't Pack a Pest Media Campaign" solicitation to declare whether their proposals contain confidential or proprietary information subject to PIA protections. The exhibit requires respondents to select one of three checkbox options: designating their entire proposal as exempt from disclosure with clear markings identifying confidential or proprietary information; submitting a proposal with confidential information alongside a separate public-information-compliant version; or certifying that their proposal contains no confidential or proprietary information and requires no separate public version. The form must be completed and submitted as part of the response, with authorized company representatives required to sign and date the document.

The exhibit emphasizes that blanket assertions of confidentiality without specific language identification may result in adverse rulings from the Office of the Texas Attorney General. Respondents are instructed to provide notice to TDA if they claim confidential or proprietary status, as the agency is obligated under PIA to notify third parties when public information requests are received seeking their information. This form serves as a critical compliance mechanism ensuring that proprietary business information submitted in response to the solicitation receives appropriate legal protection while maintaining transparency requirements mandated by Texas public information law.
