About this file

This file is an exhibit from the Texas Department of Agriculture (TDA) related to the TAFA Financial Audit contract opportunity, specifically addressing confidential or proprietary information disclosure requirements under the Texas Public Information Act (PIA). The document serves as a mandatory submission that requires respondents to certify their position regarding confidential or proprietary information contained within their proposals. Respondents must select one of three checkbox options: declaring their entire proposal exempt from public disclosure with clear markings of confidential information, submitting their proposal with confidential information and providing a separate Public Information Act Copy, or confirming that their proposal contains no confidential or proprietary information and requires no separate PIA copy. The exhibit requires signature, printed name, authorized company representation, and date of submission from the respondent.

The document emphasizes that all information held by governmental bodies is subject to public disclosure under the PIA unless it qualifies for specific statutory exceptions, and that TDA is obligated to notify third parties if public information requests seek their information. Respondents are cautioned that blanket assertions of confidential or proprietary status may result in adverse rulings from the Office of the Texas Attorney General. This exhibit must be included as part of the complete response submission to the solicitation, with specific reference to Section II, Paragraph 5.2, A(1) and A(2) of the solicitation documents regarding submission procedures and confidentiality handling.
