About this file

This file contains federal acquisition regulation clauses addressing the prohibition on covered defense telecommunications equipment and services in Department of Defense (DoD) contracts.

The document establishes three primary regulatory provisions: 252.204-7016 requires offerors to represent whether they provide covered defense telecommunications equipment or services; 252.204-7017 imposes additional disclosure requirements for offerors who do provide such equipment or services, including detailed descriptions of all covered items with manufacturer information, explanations of proposed use, and identification of service providers or equipment producers; and 252.204-7018 is the substantive prohibition clause applicable to contractors. Covered defense telecommunications equipment includes products from Huawei Technologies Company, ZTE Corporation, or their subsidiaries and affiliates, as well as equipment or services from entities reasonably believed to be owned, controlled by, or connected to the governments of the People's Republic of China or the Russian Federation. The prohibition applies to equipment, systems, or services supporting DoD covered missions—specifically nuclear deterrence (including nuclear command, control, and communications) and homeland defense (including ballistic missile defense)—when such covered telecommunications equipment or services function as substantial or essential components or critical technology. Critical technology encompasses items on the United States Munitions List, Commerce Control List, nuclear-related equipment and materials, select agents and toxins, and emerging and foundational technologies. Contractors must review the System for Award Management (SAM) exclusion list and report any identified covered defense telecommunications equipment or services to https://dibnet.dod.mil within three business days, with comprehensive mitigation information due within 30 business days. The clause requires flowdown to all subcontracts and applies unless a waiver is granted under Defense Federal Acquisition Regulation Supplement 204.2104.
