About this file

This is a Performance and Payment Bond document issued to the County of Volusia, Florida for the Tomoka Farms Road Landfill Leachate Evaporation System Demonstration Project (County Contract No. C2101). The project involves furnishing and installing leachate evaporation systems in two existing leachate storage ponds at the Tomoka Farms Road Landfill located at 1990 Tomoka Farms Road, Port Orange, Florida 32128. The evaporation systems are designed to achieve an average evaporation rate of 100,000 gallons per day during a 6-month performance period. The systems may be installed as a temporary short-term lease or permanent lease-to-own arrangement depending on performance and County requirements. The contractor must submit an approved evaporation system performance measurement, monitoring, and reporting plan within 30 days of the Notice to Proceed. The County will provide access to pond inflow pipe locations and available records to support contractor preparation and implementation of the monitoring plan.

The bond secures the contractor's obligations to perform all work as specified in the contract documents, make prompt payments to all claimants supplying labor, materials, and supplies, and guarantee all work and materials for the time period specified in the contract. The surety bond amount is to be inserted upon execution of the agreement. The bond conditions require compliance with Florida Statutes Section 255.05 regarding claimant notice and time limitations, and Section 725.06(2) regarding indemnification and hold harmless provisions. Any changes to contract documents do not affect the surety's obligations, and the surety waives notice of such changes, time extensions, alterations, or additions to contract terms or specifications.
