About this file
This document is a nondiscrimination policy exhibit from the Colorado Department of Human Services (CDHS), Office of Children, Aging, and Community Services (OCACS), applicable to vendors, contractors, and sub-recipients providing services under state contracts. The policy establishes mandatory nondiscrimination standards that all contractors and sub-recipients must follow in performance of their agreements, prohibiting discrimination based on a comprehensive list of protected characteristics including race, color, ethnic group, national origin, age, religion, mental or physical disability, sex, sexual orientation, gender identity and expression, marital status, familial status, pregnancy, veteran status, and HIV status. The document provides formal definitions of key terms including gender identity, gender expression, familial status, marital status, and sexual orientation to ensure consistent understanding and application across all funded programs and services.
All vendors and contractors agree to comply with this nondiscrimination policy in alignment with CDHS's mission to empower Coloradans to thrive, ensuring equal opportunity, civil rights, and safety for all clients served through OCACS-funded programs. Contractors must also adhere to the State of Colorado Purchase Order Terms and Conditions Section 28 and all applicable state and federal nondiscrimination laws. This policy applies to county departments of human and social services, OCYF contractors, subcontractors, grantees, and vendors receiving funding assistance to provide services or benefits to clients.

Exhibit D: OCACS Nondiscrimination Policy Page 1 of 1
In alignment with Colorado Department of Human Services’ (CDHS) mission, “Together, we empower Coloradans to thrive,” it is necessary to ensure the equal opportunity, civil rights, and safety of clients served through the Office of Children, Aging, and Community Services (OCACS) and that those that receive our funds support all of our clients.
Definitions Gender identity: An individual's innate sense of the individual's own gender, which may or may not correspond with the individual's sex assigned at birth.
Gender expression: An individual's way of reflecting and expressing the individual's gender to the outside world, typically demonstrated through appearance, dress, and behavior.
Familial status: Status that includes children under the age of 18 in the household.
Marital status (or civil status): Distinct options that describe a person's relationship with a significant other. A person's state of being single, married, separated, divorced, or widowed. A person's specified civil status might also be married if they are in a civil union or common-law marriage. The civil status of a person who is legally separated is married.
Sexual orientation: An inherent or immutable enduring emotional, romantic or sexual attraction to other people.
Sub-recipients: County departments of human/social services (county departments) and OCYF contractors, subcontractors, grantees, and vendors who receive funding assistance through OCYF in order to provide services or benefits to clients.
Vendor/Contractor agrees to act in a manner consistent with State of Colorado Purchase Order Terms and Conditions Section 28 (see https://osc.colorado.gov/spco/ccu/purchase-order-terms-conditions), all applicable nondiscrimination laws, as well as the State of Colorado Department of Human Services (“CDHS”) Office of Children, Aging, and Community Services ("OCACS") nondiscrimination terms set forth herein.
Vendor/Contractor agrees that in its performance of this agreement it shall not discriminate based on race, color, ethnic group, national origin, age, religion, mental or physical disability, sex, sexual orientation, gender identity and expression, marital status, familial status, pregnancy, veteran status, or HIV status (“protected characteristics”).
