This is a Draft Statement of Work (SOW) for the Colorado Department of Public Health and Environment (CDPHE) regarding the operation and maintenance of the North Clear Creek Water Treatment Plant (NCCWTP). The contract requires the contractor to operate the NCCWTP at design capacity of up to 600 gallons per minute, treating acid mine drainage from three sources: Gregory Incline, National Tunnel, and Gregory Gulch. Primary responsibilities include implementing a kick-off meeting within 60 days of contract execution, operating the treatment facility safely and cost-efficiently, maintaining all equipment and structures on the approximately one-acre site, conducting monitoring and sampling according to discharge limits and frequencies specified in attachments, and maintaining comprehensive operational records. The contractor must submit multiple deliverables: an Operation and Maintenance Management Plan (OMMP) within 30 days, a Health and Safety Plan (HSP) within 45 days, a Sampling and Analysis Plan/Quality Assurance Project Plan (SAP/QAPP) within 60 days, an Emergency Action Plan (EAP) within 30 days, monthly reports within 21 days of month-end, and an annual report by September 15 each year. The contract involves transitioning the facility from the Long-Term Remedial Action phase to the Operations and Maintenance phase under CERCLA.
The SOW requires the contractor to maintain minimum staffing of eight hours per day with on-call response during non-staffed hours and maintain a three-day supply of treatment chemicals on-site. Staffing must include a Class B certified (Class A preferred) lead operator with minimum two years' experience working at similarly-sized facilities, a certified industrial hygienist to review the HSP with minimum two years' experience, a Quality Assurance/Quality Control Officer with one year of similar experience, and qualified laboratory personnel. All staff must maintain current OSHA HAZWOPER training. The contractor is responsible for all waste disposal in compliance with local, state, and federal regulations, release of hazardous substances caused by negligent or unlawful contractor actions, and adherence to EPA discharge standards and monitoring requirements per 40 CFR 136. CDPHE retains approval authority over staff changes, work schedules, and all major deliverables, with a 21-day review period and optional 14-day revision period for submitted documents. The SOW does not identify pricing terms, set-asides, contract amounts, funding sources, or specific contract term duration in the provided document.
