About this file
This document is an Exemption from Competitive Procurement form submitted by Pierce County, Washington's Emergency Management Division to justify a sole source procurement for software migration services. The requestor, Cale Keim, is seeking approval to contract with ESI Acquisition (Juvare) for support and migration of the county's current WebEOC production database to a cloud-hosted environment. Pierce County determined that competitive bidding would place the county at a disadvantage due to the proprietary nature of the WebEOC software and the vendor's exclusive developer status. The exemption request identifies both a Special Facility exemption type and a Sole Source secondary exemption, as ESI Acquisition is the sole owner and developer of the WebEOC branded software with exclusive licensing rights. The form was approved by Ellen Lenk, Division Director, on July 6, 2026, and requires posting in OpenGov for 10 business days prior to contract execution.
The estimated cost for this procurement is $141,549.32, with no federal funding involved. Pierce County DEM's existing operations already utilize WebEOC software, and the county determined that no adequate alternatives or alternative sources exist for the software migration, as ESI Acquisition maintains exclusive control over the application's development and licensing. Documentation supporting the sole source status, including vendor quotes and a sole source letter from ESI Acquisition, has been submitted as part of the exemption request package. The procurement is subject to standard county procedures requiring entry into the WD system with the approved exemption form upon final approval, following the mandated 10 business day public posting period.
