JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

BRAND NAME

(>MicroPurchase Threshold but not exceeding the SAT)

1. Identification of Requiring Activity and Contracting Activity.

The requiring activity is Naval War College (NWC), Newport, RI; the contracting activity is

NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Dept., Regional Directorate –

Mechanicsburg Office

2. Nature and description of contract action. The acquisition of the supplies described below is an exception to the fair opportunity process to be awarded as a new contract. The placement of a firm-fixed- price contract is anticipated.

The action is considered a new requirement.

3. Limited to the following source(s). The proposed acquisition is to purchase video teleconferencing equipment. The Naval War College (NWC) requires the procurement of Polycom Video Teleconferencing equipment. The required equipment represents the minimum requirements of the government.

The required delivery date will be 30 days after award of a contract.

4. Identification of the justification rationale. The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding the MPT issued under a multiple award contract is 10 U.S.C. 3406(c)(5), as implemented by FAR

16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the MPT, but not exceeding the simplified acquisition threshold, is:

5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.

The US Naval War College (NWC), stationed aboard Naval Station Newport, Newport RI requires Polycom Video Teleconferencing equipment consisting of JITC approved, TAA compliant base units, 4k video CODECs, cameras, remotes, receivers and microphone arrays for use in secure environments.

Currently, NWC utilizes Polycom video teleconferencing systems in their classified conference rooms and auditoriums. This will be a one-for-one life-cycle maintenance replacement of what is currently in place. The control system programming and custom user interfaces already exist using the Polycom system. No other manufacturer can provide components that utilize the

Any change in product would require a system redesign at a significant cost and impact on schedule, as well as require additional training to the programmers and the staff for operational familiarization.

6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.
