The document outlines mandatory requirements for contractors regarding data ownership, usage, disclosure, classification, protection, encryption, quality, availability, architecture, storage, disaster recovery, sharing, transition, and artificial intelligence use. All data produced, created, obtained, or maintained as part of the IT System shall be the property of the Department and may not be disclosed, sold, or used for purposes outside the contract without express written Department consent. The contractor must comply with Texas Government Code requirements for data classification and retention, implement security controls proportionate to data sensitivity based on NIST 800-53 standards, and adhere to applicable regulations including FERPA, HIPAA, PCI DSS, CJIS, GDPR, and Texas biometric standards.

The contractor must ensure data encryption both in transit and at rest, maintain data quality through established management processes, provide data availability within Department-specified timelines at no cost to the Department, and if applicable, maintain TX-RAMP Level certification for cloud services. Data storage must remain within the continental United States unless expressly authorized otherwise, with disclosure of cloud service providers and data center locations required. Upon contract termination, the contractor must transfer all data to the Department using secure methods within the Department's specified timeframe. Critically, the contractor is prohibited from using Artificial Intelligence in contract performance without prior written Department consent and must disclose any AI components used, ensuring compliance with all Department AI policies and procedures.
