About this file
This is an Owner-Contractor Agreement template issued by the Texas Military Department, the contracting agency for state and local construction projects in Texas. The agreement establishes the contractual relationship between the State of Texas, acting through the Texas Military Department, and the selected contractor for public works projects. The contract documents incorporate multiple components including the Request for Proposal, contractor's proposal, contract award, Uniform General and Supplemental General Conditions, HUB Subcontracting Plan, drawings and specifications, Statement of Work, Prevailing Wage Schedule, and any addendums or change orders. The contractor is required to furnish all labor, materials, equipment, and services necessary to complete the project in accordance with the specified drawings, plans, and scope of work. Work shall commence upon receipt of a written Notice to Proceed and must be completed within the specified calendar days unless otherwise agreed upon in writing.
The contract sum is based upon the contractor's proposal and may include a base amount plus optional line items, with any changes to the work requiring written authorization from the State Contracting Officer prior to commencement. The contractor must carry Builder's Risk insurance covering fire, extended coverage, vandalism, malicious mischief, theft, and applicable natural perils. Payments are issued by warrant from the Comptroller of Public Accounts upon submission of properly executed estimates of completed work. The agreement is effective upon execution by the last party and terminates on a specified date unless extended by amendment. Venue for any disputes is fixed in Travis County, Texas. The template is dated February 2024 and establishes the framework for the ordering and completion of changes to contract scope and cost as authorized by the State Contracting Officer.
