6) The RFP solicitation documents provided must be used and filled out completely with no alterations or amendments not already provided by the TMD. The proposal cannot be altered or amended after submission.
7) The TMD may reject proposals that do not comply with requirements in the RFP solicitation and state and federal laws. The TMD may accept or reject all or any part of any response, waive procedures for submitting responses, waive formalities and/or minor technicalities, and award by base or any combination of options, if applicable, whichever best serves the interests of the TMD. The TMD may also cancel this procurement and withdraw this RFP solicitation at any time before a contract is signed by the TMD. The TMD will be the sole judge of the TMD's best interests. The TMD may award one or more contracts for all or part of the Work.
8) Facsimile and email submittals are not acceptable responses to the RFP.
SECTION VI – EVALUATION AND AWARD
1) The intent of the TMD is to award a contract to the vendor whose proposal is considered to provide 'best value' to the state. When considering 'best value' and award, the Owner reserves the right to set a minimum requirement regarding the criteria listed below.
2) An evaluation committee will be established to evaluate submittals. The committee will include employees of the TMD and may include other impartial individuals who are not TMD employees. By submitting qualifications in response to this RFP, Respondent accepts the solicitation and evaluation process and acknowledges and accepts that scoring of the qualifications may involve some subjective judgments by the evaluation committee. The evaluation committee will evaluate and score each submittal based on the following criteria:
3) Section I General Requirements: This Section is Pass or Fail.
a. Criteria Weight
i) Section II: Respondent's Ability To Provide General Construction Services 4%
ii) Section III: Respondent’s Experience With Projects Equivalent Size And Scope to this RFP 18%
iii) Section IV: Proposed Team's Experience With Projects Equivalent Size And Scope to this RFP 10%
iv) Section V: Respondent's Proposed Project Execution Plan For This RFP 8%
v) Section VI: Respondent's Safety Program And Record 5%
vi) Section VII: Respondent's Project Management Plan, Coordination, Quality Control Measures, And Project Closeout 5%
vii) Section VIII: Attachment A – Contractor's Proposal Form, 1.

viii) Subcontracting Plan Pass/Fail

4) The evaluation committee may conduct an interview of the finalist(s) to make a determination for award recommendation. The following will be expected during an interview:
a. One hour is allocated for the interview.
b. Attendance by Respondent's team members assigned to the Project to represent themselves as to their relevant experience and proposed involvement in the Project.
Representation by the Project Manager and the Superintendent is a critical interview component.
c. The TMD will provide Agenda questions with weighted scores for the interview, requiring an elaboration of company-relevant experience and qualifications, proposed methodology, and quality and safety programs. The TMD will then rank the interview scores separately from the original evaluation scores to make a determination for award recommendation.
5) Giving priority in the order of the ranking determined by the scores, the TMD will undertake to negotiate an agreement with the Respondent, which is evaluated as the highest scoring and deemed the best value to the State. The TMD will determine if price negotiations are necessary and may negotiate final pricing per TGC, Chapter 2269, Subchapter D, §2269.155 (b), (c). A contract may be awarded without negotiations if it is in the best interest of the State. The evaluation committee will evaluate the finalists and make a recommendation for the award. If an agreement cannot be negotiated, the negotiations will be formally terminated, and the TMD will attempt to negotiate an agreement with the next Respondent in order of scoring until an agreement is reached or the list is exhausted, upon which the solicitation will be canceled and may be re-issued.
6) In evaluating proposals to determine the best value for the State of Texas, the Respondent's past performance will be measured on pass/fail criteria, in compliance with applicable provisions of Texas Gov't Code §§ 2155.074, 2155.075, 2156.007, 2157.003, and
2157.125. The following examples of poor past performance may affect a potential Contract award and will be considered during the evaluation of proposals:
a. A score of less than a C or Legacy Unsatisfactory in the Vendor Performance Tracking System;
b. Currently under a Corrective Action Plan through the Comptroller of Public Accounts (CPA) or TMD;
c. Having repeated negative Vendor Performance Reports for the same reason;
d. Having a record of repeated non-responsiveness to Vendor Performance issues or
e. Having purchase orders that have been canceled in the previous 12 months for non-performance (late delivery, etc.).
Contractor performance information is located on CPA's website at:
http://www.txsmartbuy.gov/vpts
7) TMD may conduct reference checks with other entities regarding past performance. In addition to evaluating performance through the Vendor Performance Tracking System, TMD may examine other sources of vendor performance, including, but not limited to, notices of termination, cure notices, assessments of liquidated damages, litigation, audit reports, and non-renewals of contracts. Such sources of vendor performance may include any governmental entity, whether an agency or political subdivision of the State of Texas, another state, or the Federal government. Further, TMD may initiate such examinations of vendor performance based on media reports. Any such investigations will be at the sole discretion of the TMD, and any negative findings, as determined by the TMD, may result in non-award to Respondent.
8) Respondent understands that all obligations of the TMD under the RFP are contingent on the availability of state and federal funds. If such funds are not appropriated or become unavailable, the TMD may terminate the Contract. TMD reserves the right to award all, none, or any sequence of options contingent upon the availability of funds.
9) A response to this RFP is an offer to contract with the TMD based on the terms, conditions, drawings/plans, and specifications contained in the RFP. Proposals do not become contracts until they are accepted by the TMD and after a written formal Notice of Award
(NOA).
10) The NOA will consist of the following documentation that the Respondent may or may not be required to complete.
a. Owner-Contractor Agreement.
b. Tax Exemption Certificate.
c. Certification Regarding Lobbying (if an award is over $100K)

11) The performance of the successful Respondent, which resulted in an awarded contract, will be monitored and reported through the Comptroller's Vendor Reporting Tracking System as described in 34 Texas Administrative Code §20.115.
