About this file
This is Addendum No. 2 to a Request for Qualifications and Proposals (RFQ/P) issued by The Texas State University System on behalf of Sul Ross State University for Construction Manager-at-Risk (CMR) services for the Multi-Purpose Building One project in Eagle Pass, Texas. The addendum, issued May 13, 2026, addresses clarifications regarding General Conditions pricing and construction phase fee calculations submitted by prospective respondents. The original RFQ/P was posted April 21, 2026, with Addendum No. 1 posted May 8, 2026. Respondents were required to submit qualifications and proposals by May 20, 2026, at 2:00 p.m. to Sam Houston State University's Procurement & Business Services office in Huntsville, Texas. The project encompasses pre-construction phase services, construction phase services, and warranty support for a three-story, 40,000 gross square foot building on a newly acquired 43-acre campus site with associated infrastructure. The contract term extends from notice to proceed for construction on March 29, 2027, through substantial completion by October 13, 2028, with a project duration of 564 days.
The addendum clarifies that respondents must price General Conditions line items based on assumptions and historical data, with the understanding that these costs will be reevaluated once the design is finalized. Respondents are required to submit a not-to-exceed General Conditions cost amount expressed as a percentage and equivalent dollar amount of the anticipated Guaranteed Maximum Price (GMP), along with a Construction Phase Fee expressed as a percentage pursuant to Article 14 of the Agreement. The total Construction Cost Limitation for the project is $35,500,000, representing the owner's current target GMP. Liquidated damages are assessed at $2,000 per calendar day. All submissions require compliance with prevailing wage rate compliance, workers' compensation insurance, non-discrimination provisions, cybersecurity training, and various Texas Government Code certifications. The owner reserves the right to select up to five respondents for interviews to confirm qualifications and proposals or to make a best value selection without conducting interviews, with anticipated selection by June 25, 2026.

I. GENERAL:
A. Below are the questions that were presented along with answers to each in relation to this RFQ:
1. Question: Attachment 1 to the RFP requires items listed below to be priced in the General Conditions which cannot be fully quantified until a design is developed. Should these items be removed from list of required general conditions items, or are we to price these items based on assumptions and historical data and then reevaluate this pricing when a design is produced?
a. Dumpsters & Trash Chutes (quantity of dumpsters can vary based on material selections for the project)
b. Temporary fencing – (dependent on final extents of grading, utilities and site improvements)
c. Daily Construction Clean Up (this could vary based on material selections for the project)
d. Site erosion control (BMP) - (oversight and monitoring can be quantified but quantities and type of BMP erosion control systems is dependent on final extents of grading, utilities and site improvements)
Answer: Attachment 1 to the RFP is a listing of “Allowable General Conditions
Line Items” with a qualifying statement that “Not all items are needed for all projects.” As stated in the Exhibit, it is also intended to identify those “…costs are not allowed in the Cost of the Work category.” Also see Paragraph 13.1 that further explains General Conditions Costs.
Under the “Respondent’s Pricing and Delivery Proposal” (Paragraph 4.4), and
Paragraph 4.4.4 “Respondent’s Not-to-Exceed General Conditions Costs”, the
Respondent is asked to identify a General Conditions not-to-exceed percentage amount and equivalent dollar amount to address the Respondent's perceived financial exposure to these types of costs and obligations. The dollar amount and associated percentage presented by the Respondent will be used to evaluate the pricing and delivery proposal per Paragraph 4.2 of the RFP. If successful, the
Respondent will be held to these not-to-exceed General Conditions values as the
Guaranteed Maximum Price proposal is presented, evaluated, and negotiated with the Owner – refer to Article 7 of the template Agreement.
2. Question: The “Respondent’s Pricing & Delivery Form” requests a construction phase fee as a percentage of the GMP (CCL). The sample contract from the TxSU website, in section 24.3.1, states that fee will be calculated based on a percentage of the sum of the Cost of Work and General Conditions (not the total
CCL). Should the proposal form be modified so that fee percentage is calculated as it is defined in the contract, or will the contract be modified prior to execution to express fee as a percentage of the CCL?
Answer: In responding to the RFP and completing the Respondent’s Pricing and
Delivery Proposal (Paragraph 4.4), the Respondent shall abide by the calculation method stated under Paragraph 4.4.3 “Using the Anticipated GMP identified above, the Respondent shall identify a Construction Phase Fee percentage, pursuant to Article 14 of the Agreement:”
