About this file

This is an Artificial Intelligence (AI) Solicitation attachment from the Texas Department of Transportation (TxDOT) establishing requirements for vendors delivering technology solutions and services. The solicitation mandates that vendors provide comprehensive documentation of all AI systems—both proprietary and publicly available—that may be utilized in contract performance. Vendors must detail specific AI actions and outputs, describe the functionality's recommendations and decision-making processes, explain integration within proposed solutions, clarify whether AI use is optional or mandatory, and disclose human-in-the-loop involvement. Additionally, vendors must specify data types being utilized, classify and categorize such data, and document all data handling procedures including transfers outside TxDOT, use in model training, and other processing activities.

The solicitation establishes strict compliance and notification requirements for vendors throughout the contract term. Vendors must provide measures to mitigate biases and hallucinations within AI models, assess algorithm and model reliability, and outline strategies for handling unexpected inputs and edge cases. Any introduction of new AI functionality or modifications to existing AI systems requires minimum 45-day advance notification to TxDOT for compliance review against TxDOT's policy for Acceptable Artificial Intelligence. TxDOT reserves the right to terminate the contract without penalty if any AI functionality fails to comply with agency policy. The solicitation includes detailed definitions of AI, AI systems, Human-in-the-Loop decision-making, Information Resources Technologies, and TxDOT Data to establish a common understanding of scope and requirements.

AƩachment A – ArƟficial Intelligence (AI) SolicitaƟon No. 601310000098017

1 – 2

1. Artificial Intelligence (AI):

1.1. Vendor must provide a detailed explanation of all AI, whether proprietary or publicly available, that may be used in the delivery of technology solutions and/or services.

This explanation must include, but is not limited to, the following:

1.1.1. The specific actions and outputs generated by the AI (decisions/output).

1.1.2. A description of what the AI functionality recommends, decides, documents, reports, or affects when deployed.

1.1.3. An overview of how the AI functionality is utilized within the solution.

1.1.4. Clarification on whether the AI functionality is optional or mandatory.

1.1.5. Information on the presence of Human-in-the-loop (HITL) involvement.

1.1.6. The types of data being utilized by the AI.

1.1.7. The classification and categorization of the data being used.

1.1.8. Details on the handling of data, including if it is being transferred outside of TxDOT, used to train an AI model, etc.

1.1.9. Measures taken to mitigate biases and hallucinations within the AI model.

1.1.10. An assessment of the reliability of the AI algorithms and models deployed.

1.1.11. Strategies for handling unexpected inputs and edge cases.

1.2. During the term of the contract, if any changes occur where new AI will be introduced, or the AI functionality originally submitted by the vendor will change. The vendor must send notification a minimum of 45 days prior to implementing any changes to existing or new AI functionality to TxDOT for review by TxDOT to ensure compliance with TxDOT’s policy for Acceptable Artificial Intelligence. TxDOT reserves right to cancel the contract without penalty if any AI functionality will not comply with TxDOT’s policy for Acceptable Artificial Intelligence.

1.3. AI is defined as:

1.3.1. Artificial Intelligence (AI) – A machine-based system that can, for a given set of human-defined objectives, make predictions, recommendations, or decisions influencing real or virtual environments.

2 – 2

1.3.2. Artificial Intelligence (AI) System– Any application that contains an AI component regardless of size or usage.

1.3.3. Information Resources Technologies (IRT) – Data processing and telecommunications hardware, software, services, supplies, personnel, facility resources, maintenance, and training. [Source: Texas Government Code, Chapter 2054.003]

1.3.4. Human-in-the-Loop (HITL) decision making - Human-in-the-loop decision making involves a human decision-maker working in tandem with AI to improve decision making outcomes. In HITL systems, the AI system provides input, recommendations, or predictions that the human decision-maker evaluates and approves or rejects.

1.3.5. TxDOT Data – As defined by TxDOT Data Classification Policy, is information that is written, produced, collected, assembled, or maintained under a law or ordinance or in connection with the transaction of official business:

1.3.5.1. by TxDOT;

1.3.5.2. for TxDOT where TxDOT owns the information, has the right of access to the information, or spends or contributes public money for the purpose of writing, producing, collecting assembling, or maintaining the information; or

1.3.5.3. By an officer or employee of TxDOT in the officer or employee’s official capacity and pertains to official business of the government body.

1.3.5.4. has context menu.
