About this file

This is an Execution of Offer form for the Texas Department of Transportation (TxDOT) related to Request for Offer (RFO) No. 601440000048940 for Weather Station Systems. The document serves as the binding certification and signature page that respondents must complete and submit with their proposal response. By executing this form, the respondent attests to the accuracy and completeness of all submitted information, certifies compliance with state and federal procurement regulations, and confirms that no improper inducements have been offered to public servants. The form requires the authorized company representative to provide contact information, employer identification numbers, and payment authorization details if invoicing or payment will be processed through an entity different from the primary respondent.

The Execution of Offer form establishes critical compliance requirements and certifications that respondents must satisfy to be considered for award. Respondents must certify their eligibility to participate, confirm they have not been debarred or suspended by any governmental entity, and verify compliance with anti-trust laws, terrorism financing restrictions, and federal screening databases including the System for Award Management (SAM) and the Office of Foreign Assets Control (OFAC) list. Additionally, respondents must confirm they do not employ recent former executives of TxDOT or other state agencies with undisclosed interests in the offer, and they must acknowledge that any payments received will be applied toward outstanding state debts including delinquent taxes and child support. The form includes optional preference selections aligned with Texas Administrative Code Rule 34TAC 20.306, allowing respondents to claim eligibility for tie-breaking preferences related to Texas-produced goods, agricultural products, service-disabled veteran businesses, environmental standards, recycled materials, and energy efficiency. Failure to return the completed Execution of Offer will result in the response being deemed non-responsive.
