About this file

This document is the Terms and Conditions for a Texas Department of Criminal Justice (TDCJ) state contract solicitation. The document outlines the comprehensive bidding requirements, specifications, and contractual obligations that apply to all vendors seeking to contract with TDCJ. Bidders must comply with all applicable rules, regulations, and statutes of the State of Texas, and bids must be submitted on the prescribed form with proper time-stamping and identification requirements. The state reserves the right to make awards on the basis of low line-item bids, low total of items, or low total of all items in any combination that serves the best interest of the state. All goods must be new unless otherwise specified, and items must meet applicable OSHA standards and regulations. Delivery shall occur during normal working hours unless prior approval is obtained, and the state will conduct inspections and testing of all goods at the supplier's place of business. The state reserves rights to reject bids, extend timelines up to three months at its sole discretion, and waive minor technicalities. Award policy shall be based on prices, bidders' previous record of performance and service, quality and conformance to specifications, and other best value factors as indicated.

Payment shall be made thirty calendar days after the invoice is received, provided the invoice is accurate, and all goods and services are completed as specified. Vendors must maintain a Vendor Maintenance Direct Deposit and Substitute W-9 Form for electronic funds transfer and submit invoices separately for each shipment per location. The state requires compliance with numerous certifications including E-Verify verification for employee eligibility, suspension and debarment certifications, child support compliance, conflict of interest disclosures, and various Government Code sections addressing non-discrimination, accessibility standards, and prohibitions on contracts with entities engaged in boycotts or human rights violations. Vendors assume responsibility for indemnification of the state against liability claims and intellectual property infringement. The document specifies that recycled products must be identified as such, material safety data sheets are required when applicable, and disputes shall be resolved according to Texas Administrative Code procedures. Funds are contingent upon appropriation by the legislature, and TDCJ reserves the right to terminate contracts if insufficient funds become available after the current fiscal year.
