About this file
This is a Request for Proposals (RFP) issued by the Texas Historical Commission (THC) for a Geophysical Survey Specialist to conduct underwater archaeological investigations at Pass Cavallo near Matagorda, Texas. The project aims to search for the encampment and abandoned shipwrecks associated with Louis Michel Aury's occupation in 1817, with the survey covering 4,113 acres under Texas Antiquities Permit No. 32185. The survey will be conducted in two stages: a traditional remote-sensing survey using the agency's 25-ft. SeaArk VC Commander Anomaly II and a micro-shallow water survey using an autonomous survey vessel. The RFP was issued on October 20, 2025, with proposals due on November 21, 2025, at 2:00 P.M. Central Time. The contract term is from December 10, 2025, to August 31, 2027, with the possibility of a six-month extension.
The project is partially funded by a National Park Service (NPS) grant, with a total budget to be determined through the bidding process. Respondents must submit a comprehensive proposal including a project approach narrative, experience and qualifications, references, and a detailed price schedule. The evaluation will be based on three criteria: the respondent's approach to providing services (40%), experience and qualifications (40%), and price schedule (20%). The selected contractor will be responsible for field data acquisition, processing and interpretation of remote-sensing data, and preparation of technical reports. The THC requires the selected specialist to meet minimum professional qualifications for an underwater archaeologist and preferably have previous experience conducting underwater archaeological investigations at Pass Cavallo.

(Marine Survey Services)
SECTION I
GENERAL INFORMATION
1.1 PROJECT SCOPE.
The Texas Historical Commission (THC) is preparing to conduct archeological investigations at Pass
Cavallo to search for the encampment and abandoned shipwrecks associated with Louis Michel Aury’s occupation of Matagorda in May and June of 1817. With Galveston Island, Matagorda served as the revolutionary headquarters of the Republic of Mexico from 1816–1817, with Aury as governor, during the Mexican War for Independence. The underwater archeological survey of 4,113 acres, under Texas
Antiquities Permit No. 32185, will be accomplished as two stages: a traditional remote-sensing survey with the agency’s 25-ft. SeaArk VC Commander Anomaly II and as a micro-shallow water survey using an autonomous survey vessel (ASV). This request for proposal (RFP) covers the traditional underwater archeological survey for which the THC Marine Archeology Program is seeking a remote-sensing survey specialist to assist with the data acquisition on board Anomaly II. This task includes post-processing and interpretation of field data.
This project is made possible, in part, through grant support from National Park Service (NPS).
1.2 CONTRACT TERM.
The requested services requested shall commence December 10, 2025, or the last signature date, whichever is later, and ending August 31, 2027, or two years from the last signature date, whichever is later. The contract term may be extended by the parties for six (6) months, only by written amendment.
1.3 COMPENSATION.
A. Basis of Payment. The basis of payment and reimbursement of costs is set forth in Exhibit E, Price Schedule. Acceptance by THC of deliverables specified in the contract is a condition of payment.
B. Invoices. The Respondent shall request payment by submitting the original of an itemized invoice in a form acceptable to THC. The invoice shall be supported by documentation required for the basis of payment listed in Exhibit E, Price Schedule. The Respondent may submit an invoice no more frequently than monthly and no later than ninety calendar days after completing deliverables specified in the contract. Each invoice shall show the contract number, the total amount earned to the date of submission, and the amount due as of the date of the invoice.
C. Withholding Payments. If payment is withheld, THC shall notify the Respondent and specify conditions that would allow THC to release the payment. THC reserves the right to withhold payment:
(1) If a dispute over the work or costs is not resolved within thirty (30) days;
(2) pending verification that work is satisfactory;
(3) if the Respondent becomes a delinquent obligor under Family Code, §231.006;
(4) if the required work product is not received; or
(5) if the State Comptroller of Public Accounts will not issue a warrant to the Respondent.
D. Sub Providers and Suppliers List. The Respondent must provide THC with a list of all sub-providers and suppliers that submitted quotes or proposals for subcontracts. This list shall include sub-providers’ and suppliers' names, addresses, and telephone numbers.
E. Funds Availability. This contract is contingent upon the continued availability of funding. If funds become unavailable through lack of appropriations, legislative budget cuts, amendment of the
Appropriations Act, state agency consolidations, or any other disruption of current appropriations, provisions of the Termination Article in the THC General Terms and Conditions shall apply.
F. Debt to the State. If the State Comptroller of Public Accounts is prohibited from issuing a warrant to the Respondent because of a debt owed to the State, the State shall apply all payments due the Respondent to the debt until the debt is paid in full.
G. No Guarantee of Volume. THC does not guarantee any specific amount of compensation, volume, minimum, or maximum amount of services under this solicitation and resulting contract.

SECTION II
STATEMENT OF WORK
2.1 SERVICE REQUIREMENTS. Services shall include the requirements contained in this RFP.
Services set forth that contain the words "must" or "shall" are mandatory and must be provided as specified with no alteration, modification, or exception. Services set forth that contain the words "may" or "can" allow Respondents to offer alternatives to the manner in which the commodities/services are provided. The requested services and corresponding deliverables are detailed in the subsections below.
2.2 PROJECT OBJECTIVES. The primary objective of the overall project is to discover the shipwrecks and settlement(s) associated with Aury’s tenure at Matagorda, however, other unrelated archeological sites may be discovered during the course of fieldwork. Pass Cavallo is the historical commercial entrance to Matagorda Bay, prior to the creation of the Matagorda Ship Channel through Matagorda
Peninsula in 1966. The historical inlet has not been subject to large-scale modification and has a high potential to contain undiscovered underwater archeological sites. According to THC data, nearly a hundred reported, unverified shipwrecks are in the vicinity of the project area.
The traditional remote-sensing survey onboard Anomaly II will employ a Geometrics G-882 marine magnetometer and EdgeTech 4125 dual frequency side-scan sonar for data acquisition. The purpose of the investigation is to detect remote-sensing targets representative of submerged cultural resources.
The survey will be conducted in accordance with agency requirements presented in the Texas
Administrative Code, Title 13, Part 2, Rule §28.6. The survey will be at 20-m survey intervals with significant remote-sensing targets under consideration also being subject to close-order refinement survey. As part of the fieldwork, specific previously detected shipwrecks and significant remote-sensing targets from earlier archeological studies that are in the vicinity of the project area will be re-examined. All magnetic data will be processed and presented as contour isolines in accordance with state survey standards (13 TAC §28.9). The data will be evaluated using standard underwater archeology interpretative models, including the North-Alignment Model. Magnetic targets verified as shipwreck archeological sites will be included in the proprietary database developed in conjunction with the north alignment model.
The remote-sensing specialist will assist in mobilization and deployment of the survey vessel and equipment. The Respondent’s duties will include assisting in supervision of field data acquisition and post fieldwork data processing with a specific focus on magnetic data. As a project objective is to incorporate verified shipwreck archeological sites into the North-Alignment Model database, the
Respondent must have access to this propriety study and product. The Respondent must meet the minimum professional qualifications for an underwater archeologist presented in 13 TAC
§26.4. It is preferred that the Respondent has previous experience conducting underwater archeological investigations at Pass Cavallo.
2.3 REPORTING AND DELIVERABLES.
The Respondent will assist in fieldwork activities and report preparation. Responsibilities include field data acquisition, processing and interpretation of remote-sensing data, and preparation of data figures and summary information for the required technical report.

Services are expected to take place between the period covering December 10, 2025, through August
31, 2027. An initial meeting or conference call to agree on the work schedule and approach must be scheduled to occur within (2) two weeks of the last signature date of the contract. Services shall be performed under the coordination of THC’s Archeology Division.
Benchmarks shall be established based on the Respondent’s project information provided in their proposal, which must include a timeline/schedule of work that outlines how and when Respondent proposes to complete the project.
It is the awarded Respondent’s sole responsibility to ensure that all status reports are delivered to the proper recipient(s) at the proper time. Documents will be considered delivered only when received by THC’s designated Project Manager. Services are deemed completed when THC has reviewed the reports, all requested revisions have been addressed, and THC has given final, written approval of all services required by the contract.
2.4 SUBCONTRACTORS. Subcontractors providing services under the Contract shall meet the same requirements and level of experience as required of Respondent. No subcontract under the Contract shall relieve Respondent of responsibility for ensuring the requested services are provided.
Respondents planning to subcontract all or a portion of the work to be performed shall identify the proposed subcontractors and the proposal shall include a letter from each proposed subcontractor, agreeing to work on the team.
2.5 HUB SUBCONTRACTING. In accordance with the Texas Government Code, Sections 2161.181-
182 and Title 34, Chapter 20, Subchapter B, §20.10- §20.28 of the Texas Administrative Code
(TAC), the Texas Historical Commission (THC) shall make a good faith effort to utilize Historically
Underutilized Businesses (HUBs) in contracts for construction services, including professional and consulting services; and commodities contracts. The purpose of the HUB Program is to promote full and equal business opportunities for all businesses in State contracting in accordance with the THC projected goals:
•11.2 percent for heavy construction other than building contracts, •21.1 percent for all building construction, including general contractors and operative builders’ contracts, •32.9 percent for all special trade construction contracts, •23.7 percent for professional services contracts, •26.0 percent for all other services contracts, and
•21.1 percent for commodities contracts.
This solicitation has not been identified as one that does not require a HUB subcontracting plan.
However, if you plan on using subcontractors during this contract, you must complete, and submit a
HUB subcontracting plan. You may request the HUB Subcontracting Plan from the listed purchasing contact in this solicitation.
If you have any questions, please contact the THC HUB Coordinator, Carol Egele at responses@thc.texas.gov.
2.6 PERFORMANCE TRACKING. THC will monitor the performance of the Contract issued under this RFP. All services under the Contract shall be performed at an acceptable quality level. All deliverables will be submitted in accordance with the timeline agreed upon at contract signing.
Performance tracking methods may include, but are not limited to, meetings and documentation requirements deemed necessary by the agency to assess progress of the contractor toward meeting the identified goals and outcomes established in response to assessments of unsatisfactory performance in accordance with this procedure.
2.7 REMEDIES, TIME DELAYS, SUSPENSION, AND SANCTIONS FOR FAILURE TO
PERFORM:
Suspension
If this Contract is suspended by THC prior to its expiration date, the reasonable monetary value of services properly performed by Contractor pursuant to this Contract prior to suspension shall be determined by THC and paid to Contractor as soon as reasonably possible. THC shall not be required to pay any standby hourly rates during a suspension of work.
Sanctions
If the Successful Respondent fails to provide the goods or services contracted for according to the provisions of the Contract, or fails to comply with any terms or conditions of the Contract, THC may, upon written notice of default to the Successful Respondent, terminate all or any part of the Contract.
Termination is not an exclusive remedy, but will be in addition to any other rights and remedies as provided in equity, by law or under the Contract. THC may exercise any other right, remedy, or privilege which may be available to it under applicable law of the state and any other applicable law or may proceed by appropriate court action to enforce the provisions of the Contract. The exercise of any of the foregoing remedies will not constitute a termination of the Contract unless THC notifies the Successful Respondent in writing prior to the exercise of such remedy. The Successful
Respondent shall be liable for all costs and expenses, including court costs and attorneys’ fees, incurred by THC with respect to the enforcement of any of the remedies listed herein.
