About this file
This document is a Request for Proposals (RFP) issued by the University of Texas at Austin for General Construction Job Order Contracting Services (JOC) - Indefinite Delivery/Indefinite Quantity (IDIQ) for the McDonald Observatory (MCD). The University is seeking JOC contractors to provide materials, installation, repairs and other services associated with general construction projects of all types at all locations/buildings at MCD for a period of one year with the option to renew for up to four possible one-year renewal terms. Typical projects may include renovation of existing structures, concrete work, site work, upgrades to mechanical and electrical systems, fire protection, life safety and utility infrastructure systems. A mandatory pre-proposal meeting and at least one mandatory site visit are required for all proposers.
Pricing for job orders under the JOC program will be based on a Uniform Price Guide and any Non-Pre-priced Items, which cannot exceed 10% of the overall job order value. The University has determined that subcontracting opportunities are probable, so a HUB Subcontracting Plan is a required element of the proposal. The University may select multiple contractors for award, with a total cumulative contract value not to exceed $5,000,000 unless approved by the University of Texas System Board of Regents.

1.3.1 JOC Background
1.3.1.1 The University has maintained a JOC Program since December 1999.
Since the establishment of the program, JOCs have performed thousands of work orders, developing the program from one master contract worth thousands of dollars to multiple master contracts for various trades worth millions of dollars in services provided.
The JOC Program is typically for routine smaller projects, and work performed under the JOC Program is typically not a part of a larger project. The JOC Program is not an estimating service but is intended to contract with experienced general contractors with a minimum of five years of experience, to partner with the University.
CAM CP577221 24JOC3700 07162024 RFP - 7
1.3.1.2 The University established the current general construction JOC IDIQ at MCD in 2015. During the terms of the various MSI JOC contracts, the University issued projects totaling over $3,000,000, approximately $375,000 per year. Single projects, assigned as Job Orders, have varied in size from approximately $2300 to just under $200,000, with an average contract amount of around $165,000.00, since the start of the program. The University expects an increase in the volume and values of project assignments over the next several years.

CAM CP577221 24JOC3700 07162024 RFP - 11
2.1.7 Entire Agreement
2.1.7.1 This RFP and any resulting Contract, for all intents and purposes, are intended as the complete and exclusive statement of the agreement between University and the successful Respondent(s) and supersede all prior or contemporaneous agreements, negotiations, course of prior dealings, or oral representations relating to the subject matter hereof.
2.1.7.2 The terms and conditions of any job order, agreements, amendments, modifications, or other documents submitted by either party which conflict with, or in any way purport to amend or add to any of the terms and conditions of the Contract are specifically objected to by the other party and shall be of no force or effect, nor shall govern in any way the subject matter hereof, unless set forth in writing and signed by both parties.
2.1.7.3 No Reimbursement for Costs: Respondent acknowledges and accepts that any costs incurred from the Respondent’s participation in this RFP process shall be at the sole risk and responsibility of the respondent. Respondents submit Proposals at their own risk and expense.
2.1.7.4 Eligible Respondents: Only individual firms or lawfully formed business organizations may apply. (This does not preclude a Respondent from using consultants.) Owner will contract only with the individual firm or formal organization that submits a Proposal.
2.1.7.5 Section Headings: All section headings are for convenience of reference only and are not intended to define or limit the scope of any provision of this RFP.
2.2 Evaluation/Contract Award Process
An award to one or more Respondents for the services specified herein will be made following a procedure using Competitive Sealed Proposals.
2.2.1 Proposals will be opened publicly to identify the names of Respondents. Other contents of the Proposals will be afforded security sufficient to preclude disclosure of the contents of the Proposal prior to award. Within 45 days after the date of opening the Proposals, the University will evaluate and rank each Proposal with respect to the selection criteria contained in this RFP. After opening and ranking, an award may be made on the basis of the Proposals initially submitted without discussion, clarification or modification; or the University may discuss with the selected Respondent(s) offers for cost reduction and other elements of the Respondent’s Proposal.
The public opening will be held virtually via Zoom at 3:00 PM CST on 9/11/2024:

2.2.2 The University may provide all Respondents within the competitive range the opportunity to discuss and revise their Proposal. Further action on Proposals not in the competitive range may be deferred pending award but the University reserves the right to include additional Proposals in the competitive range if deemed in the best interest of the University. The University may not disclose any information derived from the Proposals submitted from competing offers in conducting such discussions. The University reserves the right to award a Contract for all or any portion of the requirements proposed in response to this RFP; award multiple Contracts; or to reject any and all Proposals if deemed to be in the best interests of the University. If so, the University reserves the right to re-solicit for new Proposals, or to reject any and all Proposals if deemed to be in the best interests of the University and to temporarily or permanently abandon the procurement. If the University awards a Contract, it will award the Contract to the Respondent(s) most advantageous to the University and offering the best value, considering price and the evaluation factors set forth in this RFP, focusing on contractual arrangements offering the maximum benefit to the University in terms of total overall cost and project management expertise; the University will document the basis for award.
Applicable discounts for educational, state, and local government entities must be incorporated into all Proposals. Award will not be based solely on the lowest pricing/coefficient multiplier proposed if that overall Proposal is not in the best interest of the University.
2.2.3 The University reserves the right to award Contracts to multiple Respondents based upon initial Proposals received, without discussion of such offers. Therefore, Proposals should contain the Respondent’s most favorable terms from a price/delivery and technical/management standpoint. As technical/management Proposals become more equivalent, cost consideration may become more significant and a determining factor for award. Any award price must be determined to be fair and reasonable.
2.2.4 Technical/Management Proposal (Maximum 49% of final score)
Responses will be evaluated by University staff based on the following factors:
2.2.4.1 Management Factors
Respondent’s management approach shall include a description of the company’s organization as a part of the responses to Section 8.
2.2.4.2 Technical Factors
The technical approach must address all questions in Section 8 including the nature of the requirement as understood by Respondent, recognition of critical areas of the requirement and proposed methods of accomplishing the requirement.
CAM CP577221 24JOC3700 07162024 RFP - 13
2.2.5 Price/Delivery Proposal (Maximum 51% of final score)
For purposes of evaluation pricing and delivery information submitted in response to Section 7, the University makes the following assumptions:
a) Although there may be projects where work is required outside of normal business hours, almost all of the work will be done during normal working hours.
For purposes of evaluation, 90% of the work will be done during normal working hours and the remaining 10% will be done outside of normal working hours.
b) A price analysis will be completed to determine price reasonableness. If adequate competition is not obtained, a detailed cost analysis may be performed to evaluate the reasonableness of the pricing proposed.
c) All work in development of the Respondent’s coefficient MUST be fully detailed, including supporting documentation and rationale utilized in computing profit and Coefficients as a part of the response for Section 7.
Supporting documentation shall include rates, bases and methods of computation. This information is required for evaluation of the Coefficient proposed in response to Section 7 only. The proposed coefficient must represent all allowable costs.
2.2.6 Technical/management Proposals will be evaluated using weighted scoring criteria.
To be considered responsive, Respondent must specifically address each of the evaluation factors detailed in this RFP, including citing specific data as necessary to provide sufficient information to the evaluation committee for consideration.
Respondents must clearly demonstrate an understanding of the services required.
2.2.7 Technical/management Proposals must be sufficiently comprehensive to allow evaluation without additional explanation or information as the University may deem Proposals acceptable or unacceptable based solely on the response submitted.
However, the University reserves the right to request additional information to clarify or supplement the original Proposal as submitted.
2.2.8 Consideration may be given to any additional information and comments that increase the benefit to the University. Upon completion of the initial review and evaluation of the Proposals, selected Respondents may be asked to participate in interviews/presentations.
2.2.9 Respondent's Acceptance of Evaluation Methodology
By submitting a response to this RFP, the Respondent accepts the evaluation process, and acknowledges and accepts that determination of the “best value” Respondent will require subjective judgments by the Owner.
2.3 Inquiries, Clarifications and Interpretations
Responses to inquiries, clarifications and/or interpretations of this RFP that materially affect or change its requirements will be issued by the University in writing by addendum and posted publicly. All such addenda issued by the University prior to the time that Proposals are received shall be considered part of the RFP. Respondent must consider and acknowledge receipt of addenda in their Proposal. Respondent is responsible for obtaining information regarding addenda in a timely manner. Firms receiving this RFP other than directly from the University are responsible for notifying the University of receipt of the RFP package and providing a name and email address. All addenda shall be posted on the
