About this file

This document contains a request for a one-year extension to the programmatic biological opinion for maintenance dredging of the Sacramento and Stockton Deep Water Ship Channels by the U.S. Army Corps of Engineers Sacramento District. The U.S. Fish and Wildlife Service has granted the extension and concurred that it is unlikely to result in additional take of delta smelt beyond what was originally analyzed, provided there are no changes to project operations and all conservation measures continue to be implemented. The extension is being requested to allow dredging to continue while the Corps prepares modifications to the action for consultation, including potentially extending the work window permanently, utilizing alternative dredging methods, designating additional placement sites, and associated conservation measures.

The related federal contract opportunity is a full and open competition solicitation by the U.S. Army Corps of Engineers San Francisco District for annual maintenance dredging of the San Joaquin River and Port of Stockton Deep Water Ship Channel to specific depths, plus overdepth allowances, and transport of dredged materials to upland sites. Bids are due on May 23, 2022. The estimated cost range is between $5-10 million. Plans and specifications will be posted to SAM.gov and all amendments must be monitored there, requiring prospective bidders to register on the site.

Hello David and to those it may concern, The Service has received your request for a one year extension to the Sacramento and Stockton Deep Water Ship Channel (DWSC) Maintenance Dredging and Bank Stabilization. The Service understands that the Corps making this extension request as the Corps is preparing a new Biological Assessment with the intention of reinitiating consultation at the end of the year (2022) for future maintenance dredging operations. After reviewing the request and the past five years of monitoring reports, the Service concurs that granting the one year extension is not likely to result in additional take of delta smelt beyond what was originally analyzed in the Programmatic Biological Opinion (PBO) for the project as long there are no changes to the original project operations description and the Corps continues to follow the terms and conditions of the PBO including implementation of all conservation measures.

The Service is also informing the Corps that extensions past November 30 may not be granted this year as the Service is planning on conducting experimental releases of hatchery born delta smelt into the Sacramento DWSC in December to augment the declining population of delta smelt. If the Corps were to conduct maintenance dredging in the Sacramento DWSC at the time of the experimental release, it is anticipated that this would likely increase the chances of the Corps meeting or exceeding the exempted take for the project. Extensions past November 30 in the Stockton DWSC would depend on location and water conditions at the time of the request.

As always, if you have any other questions or comments, please feel free to contact us and the Service is more than willing to provide assistance.

Hello Kim and Brian, Please see attached letters regarding our one year extension request to the programmatic biological opinion (PBO) for the Sacramento-Stockton O&M Dredging Project.

The purpose of the requested extension is to allow dredging operations to continue while the Corps consolidates anticipated proposed modifications to the action that may cause effects to listed species or designated critical habitats not analyzed in the existing PBO and would require re-initiation per 50 CFR § 402.16. Modifications proposed to the project description may include a permanent extension to the work window, alternative dredging methods, additional dredged material placement sites, and associated conservation measures. The Corps is currently conducting analyses and drafting documents for public and agency review. The Corps anticipates requesting re-initiation of formal consultation in the fourth quarter of fiscal year 2022.

Please let me know if you have questions or concerns.
