Brookhaven Science Associates (BSA)
Statement of Work
Mercury Contaminated Sand & Debris Disposal, Railroad Logistics and Transportation
March 20, 2024 Rev. O
Waste Management (WM) Quality Level A2
I. Scope of Work The Contractor shall provide disposal, railroad logistics and transportation for mercury contaminated sand and debris from Brookhaven National Laboratory (BNL) in Upton, NY to Veolia located in Gum Springs, AR (https://www.veolianorthamerica.com/contact-us/find-office/gum-springs-arkansas). The scope of the Contractor's work shall include the following:
a. The Contractor shall have the ability to provide an indemnification letter to New York &
Atlantic Railway, if requested. BNL will also provide an indemnification letter to New York & Atlantic Railway by the Department of Energy on behalf of BNL.
b. All short line fees required to perform this scope in its entirety shall be included in the
Contractor’s price.
c. Upon notification from BSA's Technical Representative, mobilize private high sided gondola railcars with hard covers and TYPE IP-1 10 mil zippered liner. Mobilization for railcars shall include delivery of the railcars to the BNL rail spur within two (2) weeks of receipt of notification from BSA. The BNL rail spur is located adjacent to and accessible from Long Island Railroad (LIRR) tracks. (Attachment 1)
d. Follow and abide by the BNL-LIRR Protocol for movement of railcars. (Attachment 2)
Delivery of cars shall be coordinated with the LIRR and BNL. Historically deliveries have been after hours or on weekends.
e. Provide a "dedicated" Logistics Coordinator/Project Manager to coordinate all transport related activities for the project including the railcar billing, daily activity reports, and shipment status reports as requested by BNL/BSA.
f. Railcars shall be to be delivered to the site on or before September 15, 2024.
g. Prepare disposal shipping documents and process them into compliant railroad waybills. The vendor will interface with railroad operators and regulatory agencies to insure compliant shipments.
h. Preparation of the manifest for the shipment.
i. Provide seven (7) consecutive business days of time at the BNL site and seven (7) consecutive business days of time at Veolia’s Gum Springs site for railcars at no cost to BSA prior to the start of a daily demurrage charge.

j. Vendor to provide daily per gondola pricing for demurrage as Option 1 to BNL in the event it is needed.
k. Ensure railcar loading complies with center of gravity and all other Federal Railroad
Administration (FRA) loading requirements.
l. Inspect the incoming rail shipments at a point no further than 100 miles from the designated disposal site. This inspection shall address the integrity of the packaging, placarding, labeling of packages, and postings on the railcars. There will be a maximum of 15 cars per train.
m. Coordinate with the disposal facility for pickup of the High Sided Gondola Railcars after gondolas have been emptied.
n. Demobilization of high sided gondola railcars at the conclusion of the shipping campaign.
Notify the BSA Technical Representative when demobilization is complete.
o. Direct landfill non-RCRA regulated contaminated sand at Veolia Gum Springs.
p. Stabilize RCRA regulated contaminated sand at Veolia Gum Springs. (Option 2)
q. Provide certificates of disposal and completed manifest to BNL within 14 days of container delivery.
r. Contractor to provide Vac Truck service to remediate any liquid mercury pools discovered during excavation. (Option 3)
s. Contractor to provide truck, operator, and helpers to operate the truck and unload into BNL provided drums. The waste drums will be transported by Waste Management to Building 855 for storage and future shipment and disposal by Veolia. (Option 4)
II. Equipment Requirements
a. All railcars provided by the Contractor shall be properly registered, reflectorized and inspected in compliance with Federal Railroad Regulations and shall pass inspection by federal railroad inspectors and other railroad safety organizations. Any equipment to be used must be in working order, free of debris and residual material from prior loads.
Railcars with debris may be rejected at the discretion of BNL/BSA.
b. Furnish gondola railcar hardtop covers to prevent rainwater intrusion during transport.
c. BSA will inspect all equipment upon delivery to BNL. If rejected by BSA for material defects or debris in the railcar, the rejected equipment shall be removed from the BNL site by the Contractor and new equipment delivered at no additional cost to BSA. (Refer to section IV for more details)
III. Work to be performed by BSA
a. Managing the railcars while on-site at BNL. Packaging, loading, and securing of the railcars for transport.
b. All packaged components will be size-reduced to meet the disposal site criteria and the packaging specifications and packaged in soft-sided packaging (supersacks).
c. Waste will be loaded inside gondolas such that it does not move causing breaching in containers during normal transportation.
d. Weights shall be provided of supersack bags that will be placed in each gondola (package configuration).
e. Material loaded into the gondola cars will be contained in soft-sided packages.
IV. Incoming Inspection of Railcars at BNL
Incoming inspection of railcars shall be performed by BSA to ensure the following:
1. Incoming Inspection of Railcar Complete:
a. Railcar meets size requirements (17' from rail to top of container/package).
b. Railcar is free from damage that may cause damage to containers/packages (i.e., sharp/jagged edges, protruding metal, etc.)
c. Free from debris and other materials.
d. Inspect for cracks of broken welds, no loose or damaged parts.
e. Measure brake shoes to ensure minimum ½” contact surface on all shoes, hoses, and piping, (tubing) mechanically sound, no missing or loose hardware.
2. Railcar Maximum Load Weight (LD LMT) Marked lbs.
3. Railcar Tare Weight (LT WT) Marked lbs.
V. Optional Services (Fixed Unit Pricing)
Option 1 Daily demurrage rates per gondola over the base scope time of seven (7) business days.
Option 2 Provide a per ton rate to stabilize and dispose of any RCRA mercury soil at Veolia Gum Springs.
Option 3 Contractor to provide a daily equipment and labor rate to operate a vac truck for the removal of liquid mercury pools. All waste would be loaded into drums for shipment to Violia. The scope of this work would include all labor, materials, JHA’s, training certs, PPE, and planning paperwork to perform the remediation.
Option 4 Provide a price per drum to stabilize and dispose of drums of elemental mercury mixed with soil due to vac truck removals.

Hazardous Materials Shipment - Operating Requirements
All Hazardous Materials shipments must be placarded as prescribed by DOT- Code of Federal Regulations Title 49 Subpart E, Part D, part 174
All placarded cars that utilize LIRR system tracks must follow all federal, NY state, and
LIRR regulations.
Hazardous Materials Movement – General Operating Practices
The General Superintendent – Transportation or their representative must authorize all scheduled movement of Hazardous Materials via the LIRR.
• The NYAR must give at least a two-week (14 calendar day) notification to the LIRR that they wish to schedule a Hazardous Material shipment unless the material is already authorized to be shipped on the LIRR.
• Any notification of new types of Hazardous Material must be presented with a Safety response plan by the NYAR that will be forwarded to the LIRR Transportation via the LIRR – NYAR Liaison (Superintendent-Engine Service) and LIRR Safety Departments for their approval. Unless approval is made by both departments shipments of the material will not proceed.
• If the Hazardous Material shipment has been pre-approved, then the NYAR must ensure that the notification is made to the LIRR Movement Bureau prior to the shipment leaving its initial terminal.
• Placarded cars must be located in a train in accordance with LIRR Rule CT 225 B Paragraph (F)
Hazardous Materials Shipment – Specific Operating Protocols
The following types of placards are identified as having pre-approval to operate on LIRR system tracks and will follow the guidelines set forth in this publication or any other supplemental publication that has been identified:

Refer to the PHMSA Emergency Response Guide 162 for information about Hazards, Public Safety, and Emergency Response actions (these guidelines are more restrictive than Guide 161 and should be used in either situation until qualified HazMat emergency response personnel instruct otherwise).

Hazardous Materials Shipment Movement - Notifications
• The LIRR Movement Bureau should be immediately notified of any known problems with any placarded car or a consist containing placarded cars.
• Once received the Movement Bureau will notify the proper authorities dependent on the scenario.
o If a problem exists with a placarded car or consist containing a placarded car but that problem does not endanger the placarded material in any way, they will contact the General Superintendent – Transportation or their representative and be guided by their directives o If a problem exists with a placarded car or consist containing a placarded and that placarded material is in any danger of spilling, being released into the atmosphere, catching fire etc...
then the General Superintendent – Transportation must be notified immediately as well as the LIRR Safety Department Representative, and MTAPD representative o If any problem exists with a placarded car or consist containing a placarded car that car and/or consist must not be moved until the problem has been corrected
Any Spill, Release, Fire, or breach of containment of the placarded material the notifications must be made to the necessary state and federal agencies (FRA, state and federal DOT, State and Local OEM’s)

BNL Waste Shipments - Operating Requirements
The Brookhaven National Laboratory (BNL) located in Upton, NY is scheduled to ship railcars of low to moderate level radioactive waste at various times via LIRR system tracks. BNL will utilize the New York and Atlantic Railway (NYAR) as their carrier for shipping these railcars. The low to moderate level radioactive waste will be shipped in rail cars contracted to be moved by the New York and Atlantic Railway on Long Island Railroad system tracks from the BNL siding on the Main Line to the NYAR facility in Fresh Pond. From Fresh Pond Yard the rail cars will be interchanged as soon as possible to the next rail carrier in the route.
• Presently, all approved placarded waste shipments are low to moderate level radioactive waste (Class 7).
o Low to medium level radioactive material that has a contact dose rate typically less than 5mR per hour. In comparison, an individual must have direct contact with the debris for a six-hour period to acquire a dosage of radiation equal to a dental x-ray.
There is negligible radiation at distances of 20 feet away from a rail car.
• Any request to move a placarded shipment either to or from BNL must be presented to the LIRR Transportation via the LIRR – NYAR Liaison (Superintendent-Engine Service other specified representative) by the NYAR. LIRR Safety and Transportation Departments will review and approve any other US DOT regulated shipments. No other placarded shipments by rail are permitted without LIRR approval.
• All non-placarded waste shipments do not require any special procedures or packaging for shipment. However, all waste shipments from Brookhaven National Laboratory will follow procedural guidelines as set forth below.
• Waste Shipment Contents: Typically, low to moderate radioactive waste shipment contents are one of the following distinct types:
o Soil and Soil Debris Mixtures o Activated Metal o Activated Concrete
• Loading rail cars: All rail cars transporting placarded materials shall be loaded in accordance with US DOT specifications. For example, soil is often loaded in gondola cars or individual containers. These are lined with a DOT-approved liner “Super Wrapper Liner” or individual DOT-approved “Super Sack” totes. These are then loaded into the rail cars or containers and then covered with DOT-approved lids. Any questions regarding packaging shall be referred to Brookhaven National Labs or their authorized representative. Specific attention shall be given to the following:
o Proper placarding, labelling and/or marking.
o There are no loose or dangling tarps, nets or cables that might pose a hazard when passing adjacent to passenger stations.
o All containers are securely placed and fitted onto the rail car, e.g., pins and retaining bolts.
o Hanging or dragging cables, hoses or parts of the brake rigging that constitute a hazard to the safe passage of the equipment.
• NYAR Locomotive Power: NYAR will provide appropriate locomotive power, with a minimum of two locomotives, complying with all LIRR rules and special instructions for main line operation.
• Freight Train Operation: As with all other movements, NYAR trains will comply with all LIRR Operating Rules, Special Instructions, General Orders, General Notices, Bulletin Notices, Speed Restriction Notices, and any other applicable instructions and/or publications in effect at the time of the movement. All brake tests shall be conducted in accordance with the applicable section of 49 CFR Part 232 regarding freight brake tests, including, but not limited to, Class 1 Initial Terminal brake tests as set forth in the appropriate section of the Train Handling and Equipment Manual (“THEM”). All movements of trains containing hazardous materials shall be governed in accordance with the applicable section of 49 CFR 171 through 179 or set forth in the current edition of C.T. 225B “Regulations for the Transportation of Hazardous Materials”, whichever is more restrictive.
BNL Waste Shipment Movement – General Operating Practices
The General Superintendent – Transportation must authorize all movements of US DOT Regulated Shipments via rail.
• The NYAR must give at least two weeks (14 calendar days) advanced notification to the LIRR-NYA Liaison that they wish to schedule a DOT Regulated BNL Waste Shipment from Brookhaven Siding to Fresh Pond Yard
• Upon receiving notification from NYAR, the LIRR Transportation Department
Representative will notify the MTAPD representative of the shipment specifics.
• In addition, LIRR Transportation will notify LIRR Public Affairs (or successor contact) of the upcoming movement and will notify LIRR Corporate Safety Department Representative

• The MTAPD will notify all appropriate local, state, and federal agencies of the scheduled shipment, not previously notified by BNL.
• Unless given prior approval, all DOT Regulated BNL Radioactive Waste
Shipments must be completed on a Saturday.
• To afford both the NYAR and LIRR the safest environment to complete these rail shipments all movements should be performed during daylight hours.
• No extended layovers will be permitted while the freight train is enroute from
Brookhaven Siding to Fresh Pond Yard.
• Prior to pickup of cars from Brookhaven National Laboratory, the NYAR must provide a list of all placarded car numbers.
• NYAR will provide an approximate schedule time of arrival at Brookhaven Siding for BNL Waste Shipment pickup.
• NYAR will provide mechanical personnel at BNL to perform inspections of rail cars on the day of the shipment, ensuring that they meet all Federal, State, Local and LIRR regulations required for transport.
BNL Waste Shipment Movement – Specific Operating Protocols
• LIRR shall designate a Transportation Department supervisor to oversee the shipment and will establish contact with BNL personnel and NYAR personnel (see contact lists below).
• A designated Transportation Department supervisor and a designated Corporate
Safety Department representative will arrive at Brookhaven National Laboratory at least one hour prior to the scheduled arrival of the NYAR RS-Extra crew. These supervisors will be processed at the BNL visitor center and escorted to the pickup area.
• Upon arrival at the designated loading area at the BNL, the NYAR RS-Extra crew shall present to the LIRR Transportation Supervisor on location all requested paperwork and documentation, including, but not limited to:
1. Valid Daily Inspection Form of each Locomotive
2. Valid ASCDT-1 form (or applicable pre-departure form) for each Locomotive
3. All Train Movement Paperwork (Form L Authority, A-Card, etc.)
4. Train Crew Identification (Information must be recorded)
• The LIRR Transportation Supervisor will observe the NYAR train crew and mechanical personnel while the BNL Waste Shipment train is being made up and both, the LIRR Transportation Supervisor and LIRR Corporate Safety Department representative shall confirm the following:
a) All car numbers match what was transmitted to the LIRR from NYAR operations personnel.
b) The train is assembled according to the applicable Hazardous Material
Transportation rules and regulations. For example:
i. All rail cars containing Hazardous Materials are properly placarded.
ii. The train crew is in possession of a written Position in Train document.
iii. The train crew is in possession of all appropriate Hazardous Materials waybills
iv. Rail cars containing placarded materials must not be placed next to a locomotive or occupied caboose. Proper buffer cars must be utilized.
c) The train must successfully pass a Class 1 Initial Terminal brake test. The train crew must complete and present the appropriate written documentation (BTTH- 1 or appropriate form).
d) The train crew must be in possession of the current version of the Emergency Response Guide and appropriate response guide for the shipment.
BNL Waste Shipment Movement - Notifications
The designated LIRR Transportation Supervisor will notify the Movement Bureau when the train now designated as the RS-BNL Extra has left the BNL property and enters the Mainline. They will also confirm the total number of cars/locomotives in the consist.
The Movement Bureau will send out a text page advising that the RS-BNL Extra with total number cars and total number of engines has left BNL property and is occupying the main track proceeding west.
The MTAPD will notify all appropriate local, state, and federal agencies of the scheduled shipment as arranged by the MTAPD
The Movement Bureau will send out periodic text pages regarding the movement of RS-BNL Extra as it travels west to include clearance of all main points of interest (interlockings, major stations etc…)
When the Movement Bureau receives confirmation that the RS-BNL Extra has reached its Fresh Pond, it will send out a text page advising such.
If the RS-BNL Extra experiences any delays while enroute, the Movement Bureau shall send out a text page advising of such delays.
If the RS-BNL Extra experiences any equipment problems while enroute, the Movement
Bureau shall send out a text page advising of such issues. The Movement Bureau should ascertain as soon as possible the extent of the equipment problems and an approximate time for repairs.
The Movement Bureau shall send out a text page advising of the resumption of the movement of NYA RS-BNL Extra after any delay or resolution of equipment problems.
All text pages sent out by the Movement Bureau should include public affairs point person

EMERGENCY RESPONSE INFORMATION – FIRST RESPONDER
Emergency responders performing cleanup activities on the LIRR right-of-way must take LIRR Contractor Safety Training on an annual basis.
What do I do if I am a responder to these incidents?
In all cases…
Establish a 75-foot isolation area in all directions for both types of incidents.
Priorities for rescue, life saving, fire control, first aid and other actions are higher than the priority for measuring radiation levels.
If available, a tarp or covering should be placed over the spillage or debris pile to prevent or mitigate wind dispersion
Response Actions
• Transportation incidents involving radiological materials are just another form of hazardous materials emergency. Remember to respond within your level of training
• Emergency responders who respond to a transportation accident involving radioactive material should perform the following:
Size up accident scene using your HAZMAT training and reference information (such as the ERG). Visually assess the accident from a distance.
Try to identify the following:
• Spills, leaks, or fire
• Apparent hazardous properties of the cargo
• Victims
• Type of vehicle and containers involved
• Placards and markings
• Container/package damage
• Any person knowledgeable of the scene
• Shipping papers
• Runoff problems; work area hazards; exposure problems
Initiate response actions as outlined in the Emergency Response Guidebook Establish initial isolation zone 75 feet in all directions Establish lines of communication as required by jurisdictional policies, plans, and procedures.
Priorities for first responders include the following:
• Safety of response personnel
• Rescue of injured personnel
• Secure the incident scene
• Isolate the area and deny entry
• Ensure safety of people and environment
• Notify appropriate authorities as per the Operating Procedures
• Monitor radiation levels (if trained and equipment is available)
• Restrict entry until your local radiation authority or radiological emergency
• Maintain accident scene control until relieved by a higher authority.
Provide appropriate transfer of command when relieved.

Shipment Specific Information
There is a small possibility of: a release resulting in an inhalation hazard near the source, contamination that is hazardous if ingested and hazardous levels of external exposure from being near the accident for an extended time. Following the ERG Guide provides appropriate initial guidelines for your safety. Firefighters are generally equipped with protective clothing and respiratory protection equipment, which provides good protection against radioactive contamination and inhalation of airborne radioactive material. Being in the vicinity of the material for a short period (e.g. to conduct lifesaving) should not be hazardous.
• Soil/Debris/Bulk Items
Isolate 75 feet in all directions to keep unauthorized personnel away Avoid dispersion of material, cover with tarp, if available, especially if raining If moving in water, dike or dam to prevent further movement If wind blown and no tarp is available, moisten with fog stream If necessary to work with material, wear SCBA and firefighting PPE Follow appropriate decontamination procedures
• Activated Material
Isolate 75 feet in all directions to keep unauthorized personnel away Cover with tarp, if available If necessary to work with material, wear SCBA and firefighting PPE
Rail Car Placards
The rail cars utilized in transporting low to moderate level radioactive materials from BNL are placarded with easily identifiable DOT standard placards. These placards are affixed on all four sides of the package (Container or rail car) and are easily observed from either side.
