PENNDOT PUBLICATION COORDINATION 01020-1
SECTION 01020 – PENNDOT PUBLICATION COORDINATION
1.01 MINIMUM STANDARDS
A. All work in State Highway Right-of-Way shall be constructed in accordance with the requirements of:
1. PennDOT Publication 408 Specifications
2. PennDOT Publication 35 Bulletin 15 – Approved Construction Materials
3. PennDOT Publication 72M – Roadway Construction Standards
B. It is the intent of the Contract Documents that the requirements of the above listed
PennDOT Publications are the minimum quality of work and minimum quantity of work to be provided by Contractor. The Contract Documents, including but not limited to the Drawings and Specifications, may require additional work, additional material, a higher quality material, specialized equipment and/or other additional quantity or quality of work to complete the construction. Accordingly, such additional work, additional material, higher quality material, specialized equipment and/or other additional quantity or quality of work shall be provided by Contractor.
For example:
A PennDOT Publication 72M – Roadway Construction Standard Drawing may have a detail which shows that retained material may be used for backfill, while the
Contract Document Drawings and/or Specifications require that 2A Coarse Aggregate be used for all backfill within all state highway right-of-way limits. Then, in this example, the Contract Documents require that the Contractor use 2A Coarse
Aggregate backfill and remove the excavated material. The PennDOT Publication
72M – Roadway Construction Standard reference to retained material is interpreted as the minimum level of construction and is superseded by the higher quality 2A Coarse
Aggregate material and associated work to fully install and construct 2A Coarse
Aggregate backfill complete in place including any associated work of hauling and disposing of any excavated material.
1.02 REFERENCED PENNDOT SPECIFICATIONS
A. It is the intent of the Contract Documents that the Contract Documents as designated in the Agreement, including but not limited to the Agreement, the Instructions to
Bidders, the General Conditions and Supplementary Conditions, govern the terms and conditions of the Agreement between Owner and Contractor, including but not limited to bidding requirements, contract administrative procedures, contract
PENNDOT PUBLICATION COORDINATION 01020-2
payments, contract times, amending and supplementing contract procedures and other similar administrative items. Any references to PennDOT Publication 408
Specifications shall not be construed to supersede such administrative terms and conditions of the Agreement.
For example:
The Contract Documents shall govern over PennDOT Publication 408 Specifications
Section 100 – General Provisions on administrative matters including but not limited to, reporting and resolving discrepancies, subsurface and physical conditions, differing subsurface and physical conditions, underground facilities, hazardous environmental conditions at the Site, bonds and insurance, changes in the work, claims, claims between contractors, cost of the work, unit price work, changes in contract price, changes in contract time, delays, payments to Contractor, dispute resolution and giving notice.
B. Nothing in Paragraph 1.02.A shall in any way diminish, lessen or eliminate the right and authority of PennDOT and its duly authorized representatives from fully exercising their rights of inspecting, reviewing, rejecting the Work and the materials and suspending the Work for cause in accordance with PennDOT’s requirements.
Nor shall this section relieve Contractor’s responsibilities to adhere to applicable state and federal laws and regulations.
Not Used.

This section shall supersede all measurement and payment sections of the Individual Specifications.
B. Itemized Quantities Marked Lump Sum (LS): The bid form may include line items with estimated quantities as a comment, but indicate a quantity of one (1) and as “lump sum” or “LS” as the unit in the bid form. If provided, THESE QUANTITIES
SHALL BE UTILIZED BY THE BIDDER AS A CHECK FOR THEIR OWN QUANTITY TAKE-
OFFS. The actual scope of work may be vastly different. The contractor is responsible to provide the scope of work shown on the contract documents at the bid price, even if it is vastly different.
C. Unit Price Items: The bid form may have some line items with estimated quantities larger than one (1) and associated units of measure typical for unit price projects.
These items are unit price items. The bid will be assessed by multiplying the
LUMP SUM PRICES 01271-2
estimated quantities by the unit prices provided and summing those results with other lump sum items.
D. Allowances: The bid form may have some line items with an allowance. The allowances will only include the cost of purchasing and obtaining that specific item or material or equipment specified. All other costs (such as but not limited to other items, materials, equipment necessary for the allowance to provide a complete operational system, all labor, all installation costs, any overhead and profit and any other costs) shall be included in the most closely associated bid item(s). The bid will be assessed by summing the allowances with the other lump sums and unit price line items.

A. Record of Existing Conditions: Within 10 days after the Effective Date of the
Agreement, Contractor shall submit to Engineer for record:
1. Pre-construction photographs of all planned construction areas, material storage areas, areas adjacent to these areas, including but not limited to, streets, driveways, sidewalks, curbs, ditches, fencing, railing, visible utilities, retaining structures and adjacent building structures. The purpose of the photographs is to document existing conditions and to provide a fair measure of required restoration. Care should be taken to record all existing conditions which exhibit deterioration, imperfections, structural failures or situations that would be considered substandard.
1.02 PROPOSED ADJUSTMENTS IN THE PROGRESS SCHEDULE
A. If, in the opinion of Engineer, Contractor falls behind the Progress Schedule, Contractor shall submit to Engineer for acceptance proposed adjustments in the
Progress Schedule that will not result in changing the Contract Times in accordance with the General Conditions and as follows:
1. Adjustments shall include such steps as will be necessary to improve the progress.
Engineer may require Contractor to increase the number of shifts and/or overtime operations, days of work, and/or the amount of construction planned, all without additional cost to Owner.
1.03 SHOP DRAWINGS AND SAMPLES
A. Contractor shall submit Shop Drawings and Samples to Engineer for review and approval in accordance with the General Conditions for all items to be furnished and/or installed under the Contract Documents.

Documents. Contractor must submit the specified product.
d. "Revise and Resubmit" – When the material submitted is incorrect or insufficient to review properly and it is necessary to see the complete package again.
E. Where a submittal indicates a departure from the requirements of the Contract
Document which the Engineer deems to be a minor adjustment in the interest of the
Owner not involving a change in Contract Price or Contract Times, Engineer may approve the submittal but the approval will be subject to the following clause:
- "The modification indicated on the attached submittal is approved in the interest of the Owner to effect an improvement for the Project and is accepted with the understanding that it does not involve any change in the Contract Price or
Contract Times; that it is subject generally to all Contract stipulations and covenants and that it is without prejudice to any and all rights of the Owner under the Contract Bonds".
F. It is emphasized that Engineer’s approval of Contractor’s submitted data is for general conformance to the Drawings and Specifications, but subject to the detailed requirements of the Drawings and Specifications. Although the Engineer may check submitted data in more or less detail, such checking is an effort to discover errors and omissions in Contractor’s drawings and to assist the Contractor in coordinating and expediting his work, and shall in no way relieve the Contractor from the Contractor’s sole responsibility for complying with the requirements of the Contract Documents.
The Contractor’s responsibility shall continue so that even if shop drawings are marked approved and subsequently it is discovered that the Contractor’s submitted item does not fit the work, does not have the required certification, does not meet a certain characteristic, and/or is in any way not in strict compliance with the Contract
Documents, the Contactor shall be fully and solely responsible for removing and replacing the item including paying all related costs.
