About this file
Summary
This document is a Public Works Project Requirements guide issued by the New Mexico Department of Workforce Solutions Labor Relations Division. It outlines the statutory and regulatory responsibilities for contracting agencies, general contractors, and subcontractors participating in Public Works projects valued at more than $60,000 in New Mexico. The requirements establish compliance frameworks for contractor registration, prevailing wage adherence, apprenticeship contributions, and project documentation. Key responsibilities include mandatory registration with the Public Works and Apprenticeship Application (PWAA) website, submission of Notice of Contractor Designation (NOCD) and Subcontractor Lists, display of wage rate posters at job sites, and submission of Affidavits of Wages Paid upon project completion. Contracting agencies must close projects within ninety days of completion through the PWAA system.
All subcontractors and sub-tier entities, excluding professional services, must comply with the Public Works Minimum Wage Act and pay prevailing wages regardless of contract amount. General contractors are required to provide complete Subcontractor Lists and Statements of Intent to Pay Prevailing Wages within three days of contract award. Public Works Apprentice and Training Act contributions must be paid either to approved Apprenticeship Programs or the Public Works Apprentice and Training Fund. The document directs stakeholders to the New Mexico Department of Workforce Solutions Public Works web pages for reference materials and forms, with contact available via email at public.works@dws.nm.gov or phone at (505) 841-4400.
