QUALITY OF DELIVERABLES

Completeness. The GTR and GTM will review all deliverables to assure they meet the requirements outlined in the contract and lead to the desired outcome. The GTR and GTM will assure that sufficient back-up documentation is provided to support all conclusions and recommendations made.

Accuracy. The GTR and GTM will review all deliverables for accuracy, including correct program content.

Quality of Product or Service. The GTR and GTM will review all deliverables for content and clarity to assure that users can understand the content of the materials provided. While draft documents may contain some minor errors, HUD staff will not serve as the contractor’s quality control function. Written materials with numerous typographical errors, improper grammar, unclear language, or that does not meet adequate writing standards will be rejected.

Timeliness of Performance. The GTR and GTM will track due dates to assure all deliverables are provided within the time frames allowed under the contract. If, due to Government delay or other reasons beyond the contractor’s control, a deliverable date will not be met, the contractor shall notify the CO, GTR and GTM to determine if an extension is appropriate. If a deliverable due date falls on a Saturday, Sunday or Federally recognized holiday, the due date shall be the next business day.

PERIODIC EVALUATION

The GTR and GTM will monitor customer satisfaction with the contractor’s performance through review of overall performance and deliverables for quality and timeliness, ongoing discussions with the Program Manager and bimonthly progress reports. At the end of each calendar quarter, the GTR and GTM will provide an overall assessment of the contractor’s performance. The result of this review will determine if any disincentives for less than “Good” performance are warranted. Additionally, HUD reserves all rights and remedies under the provisions and clauses of the contract when performance of any contract requirement is unacceptable. This evaluation is strictly for the purposes of determining if any disincentives are to be assessed for less than “Good” performance.

The contractor shall meet all of the performance requirements spelled out in the contract. All deliverables under this contract shall be subject to standards dealing with timeliness, completeness, accuracy, and clarity of written materials.

FINAL EVALUATION

A separate evaluation will be accomplished, as required for all contracts exceeding $100,000, prior to exercising any option period and upon contract expiration that will not have an impact upon disincentives, but rather, will reflect the contractor’s overall performance and shall be included in the Contractor Performance Assessment Rating System (CPARS) database.

Nothing in this clause shall abridge the Government’s rights to pursue contractual remedies under other terms or conditions of this contract. Repeated or serious performance problems may result in contractual remedies such as cure or show cause notices and termination for default.
