M&M 3.8 Industry Day Questions Funding

1. What is the letter of credit requirement? How much will be required for the line of credit?

Answer: Letter of credit information will be released as part of the solicitation.

2. Will HUD consider requiring the line of credit amount to be reduced to $250,000? Will HUD consider requiring the line of credit to be apart from the actual RFP?

Answer: Letter of credit information will be released as part of the solicitation.

Solicitation/Proposals/Awards

1. Ideally, when would HUD like to award FSM 3.8 contracts?

Answer: Mid -Summer

2. When do you anticipate the solicitation to be posted? What is the timeline for the FSM 3.8 solicitation to be released?

Answer: The solicitation is expected to be released on or about March 14, 2014.

3. How do you anticipate the FSM contracts being awarded-Best Value Trade-off or LPTA?

Answer: Offers received in response to the solicitation will be evaluated in accordance with FAR Part 15.101-2, Lowest Price Technically Acceptable (LPTA) procedures.

4. Will there be a draft RFP?

Answer: Posted with the sources sought

5. How will SCA wage determinations be made when the procurement strategy is LPTA? Will the govt. ask for a cost breakdown in the proposals to ensure that proper wage rates are used and labor categories when cost is looked at?

Answer: See solicitation when posted

6. What type of solicitation, i.e. IDIQ, Fixed-Price or Cost Plus?

Answer: IDIQ

7. Will this requirement be procured directly or via GSA?

Answer: This procurement will be posted to FBO/Fed-connect

8. What are the procurement timeframes?

Answer: See answer to question one and two of this section

9. Is there a certain format for the RFP and where can we access the template?

Answer: HUD does not provide a template for proposals.

10. As recently demonstrated, LPTA is detrimental to quality services, neighborhood recovery support, and small business contractors. Why would LPTA even be in consideration?

Answer: Quality of service is a performance issue

11. What is the estimated timeframe for the release of the pre-solicitation?

Answer: The presolicitation notice was posted on February 14th, 2014.

Technology/Start Up Costs

1. Can you give consideration to having subcontractors of prime contractors (i.e. existing FSMs) more access to P260, i.e. expand the portal. Can you allow for computer sync from company based systems to P260 with a generic type C# to all for large pushes of information?

Answer: Will be taken into consideration Teaming/Joint Ventures

1. In a joint-venture arrangement, whose name should the line of credit be in (the JV, 8(a) or large business)?

Answer: The Joint Venture Set Asides/Small Businesses/NAICS code

1. Craig Karnes kept referring to a small business has greater than 3 million, has this changed to greater than 7 million?

Answer: The North American Industrial Classification System (NAICS) code for this acquisition is 531311, Residential Property Managers with an identified Business Size Standard of $7 million. Qualification as a Small Business under this threshold is calculated by averaging the 3most recent years of annual revenues of the offeror at the time of proposal certification.

2. Based on your market research so far, will there be a small business set aside for any of the contract areas? Where would they likely be? Will you also consider SDBs like disabled vets?

Answer: Based on the results of the market research, HUD has determined that the following opportunities will be set aside for small businesses under FAR Part 19 small business programs: Five (5 ) total Small Business set-asides will be solicited for Areas: 1P, 3P, 4P, 5P 1D. Area 2D will be solicited on an unrestricted basis for full and open competition.

3. How many of the contract areas will be set aside for 8(a), veteran owned and small business companies?

Answer: Based on the results of the market research, HUD has determined that the following opportunities will be set aside for small businesses under FAR Part 19 small business programs: Five (5 ) total Small Business set-asides will be solicited for Areas: 1P, 3P, 4P, 5P 1D. Area 2D will be solicited on an unrestricted basis for full and open competition.

4. If the AMs are big firms why not reserve the FSM contracts for small businesses?

5. Does SAM replace CCR registration?

Answer: Yes

6. Given that there are large areas, how do you anticipate a small business with limited resources will be able to fulfill this need?

Answer: Business decision on part of the small business

7. How are larger businesses still eligible to win bids when it is a small business set aside (i.e. PEMCO, Matt Martin, First Preston)?

Answer: See answer to question two of this section

8. The NAICS code 531311 has been assigned for this procurement. Is this the final NAICS code or is this still up for review?

Answer: The North American Industrial Classification System (NAICS) code for this acquisition is 531311, Residential Property Managers with an identified Business Size Standard of $7 million.

9. The last FSM RFP stated that “Offerors must submit documentation of at least three past or current contracts with requirements similar in size, complexity, and scope to the solicited task within the previous three years.” Considering the size of these FSM contracts, most small businesses probably won’t be able to come up with three projects that are similar in size. How will HUD address this?

10. Will you provide your conclusions about set aside plans and/or LPTA vs Tradeoff plans before you release the solicitation?

Answer: This process has change to Tradeoff

Subcontracting

1. Will there be subcontractor goals on the contract?

Answer: See solicitation when posted

Areas/Inventory/Realignment

1. Does HUD foresee an increase in asset sales pre-foreclosure to private equity firms, and if so, what percentage?

Answer: It is impossible to speculate FHA disposition strategies that will be used in the future. While there was an increase in the performance of asset sales pre-foreclosure for the previous year, it cannot be assumed that this strategy will be duplicated in the future.

2. How many assets are currently in inventory per state?

Answer: Current inventory information will be released as part of the solicitation.

3. What was the average number of properties, per state, per year maintained?

Answer: Current inventory information will be released as part of the solicitation.

4. What was the average dollar spent per property in FSM 3.8 areas, per state?

Answer: This question cannot be answered at this time

5. Will there be a limit to the number of areas a small business can be awarded?

Answer: No

6. What are the volume estimates per contract area?

Answer: Quantity estimates will be released as part of the solicitation.

7. Are there any discussions being held about redistricting areas 1D and 2D to help accommodate small businesses? Can Texas be a single contract area?

Answer: Under consideration but no decision has been made at this time.

8. Are the existing contract areas staying the same or will they be broken into smaller areas?

Answer: See map posted with sources sought

M&M 3.6 Industry Day

1. Is it possible to get a recording of today’s presentation?

Answer: still working on this one

2. Will the sign in list of attendees be provided?

Answer: The sign in list of attendees will not be provided.

Misc

1. Whose job is it to check on the FSM? Some companies have developed a QA inspection; does HUD have this in place?

Answer: HUD performs quality assurance

2. What is the timeline for “ready to show”?

Answer: See Performance Work Statement

3. What is the average dollar reimbursed per property per state?

Answer: This question cannot be answered at this time

4. There have been occasions when a real estate agent has been unable to access a property and the FSM is required to travel to the property to change the lock only to discover that the agent had the wrong key. Is the cost of this service reimbursable to the FSM since he has to pay someone to go there?

Answer: No

5. Can you elaborate on the increase in inspections that was mentioned at the Industry Day regarding FSM quality? Will such inspections be a separate CLIN?

Answer: Inspection will be performed in accordance with the PWS

6. Most cost estimating tools don’t take into consideration the SCA wages that should cover the labor portion of an estimated repair. This could create a liability issue for FSM contractors if HUD is going to enforce the payment of SCA wages and benefits. How would you address this?

Answer: Enforcement of the SCA is the responsibility of the Department of Labor. It is the offeror’s responsibility to incorporate the SCA WD accordingly into their pricing.

7. The draft PWS states that if appliances are stolen from a property the FSM with approval from the GTR has to replace them. The problem with this is that the amount HUD allows for this are not realistic, $200 for a range, $250 for a refrigerator and $500 for a central air compressor. What happens to the FSM if they can’t find new appliances at these prices? Do they have to pay the difference?

Answer: If the FSM is unable to find replacement appliances at these prices, the amounts listed above are given to the purchaser of the property as a credit. The FSM is no longer required to replace these appliances if the only acceptable replacements that can be found exceed the reimbursement limits.

8. The PWS requires that pools be secured by the FSM but the PWS doesn’t define what type of cover is required or acceptable to HUD. Is as secure fence and locked gate all that is required?

Answer: The FSM Contractor is required to secure the pool in accordance to local legal regulations and guidelines.

9. How will HUD ensure the FSM pays employees and subcontractors in accordance with the Service Contract Act?

Answer: See answer to question six in this section

10. Explain how the FSM and AM will be responsible for HOA and utilities since the AM will get the assignment about 7 days after assignment?

Answer: See Performance Work Statement

11. When is the transition expected from existing contractors to new 3.8 awardees?

Answer: See Performance Work Statement

12. A new sources sought was recently posted for a new P260 type interface. Will any of the new contractors be expected to use this or is it anticipated that the new system will be in effect during this 3.7/3.8 contract term?

Answer: Contractors will be expected to use the system in place at time of award or any replacement put in place thereafter.

13. Will HUD be using a totality approach in the grading of past experience this time around?

Answer: See solicitation when posted

14. Will you please allow for more pages in the technical proposal this time around?

Answer: Page limits will be released as part of Section L in the solicitation.
