Solicitation No. DTRT5716R20004 Amendment No. 000003
The purpose of this amendment is to answer Offeror submitted questions and make the following changes to Solicitation DTRT5716R20004:
1. Page 26, Section E, Subsection E.2 “Government Review and Acceptance”, change the attachment reference in paragraph 3 from “Attachment J.11” to “Attachment J.4”.
2. Page 32, Section F, Subsection F.13, remove the word “VTC” and replace with “Skype, Facetime or Lync”.
3. Page 66, Section I, I.2, Federal Acquisition Regulation (48 CFR Chapter 1) Clauses, add the following fillable to FAR Clause 52.244-2, Subcontracts (OCT 2010), paragraph d:
(d) Any subcontract that exceeds the Simplified Acquisition threshold ($150,000).
Based on this change, Alternate I of FAR Clause 52.244-2 is hereby deleted from the solicitation.
4. Page 88, Section L, Subsection L.5.V, “Proposal Format – 2. Page Limits, Volume II: Written Technical Proposal, Section 5 – Past Performance, add the following sentence:
“The page limit to describe in its proposal what types of contracts were excluded and what process was utilized to ensure that the most relevant contracts with the Federal Government over $1,000,000 relevant to the SOW were included, is one (1) page.”
5. Page 97, Section L, L.6.II “Cost and Business Proposal Content, Section 3 – Business Proposal, Conflict of Interest Statement”, change the Section reference from “H.2” to “H.3”.
6. Page 101, Section L, Subsection L.7.II, Volume II – Technical Proposal, Section 5 – Factor 5
– Past Performance, revise the following sentence from the third paragraph:
Remove: “The list must include those applicable contracts reflecting the involvement of the proposed Task Order Program Manager and/or Department Managers.”
Insert: “The list must include those applicable contracts reflecting the involvement of the proposed Program Manager, the Senior Surveillance Systems Engineer and/or the Seven (7) Task Area Leads.”
7. Page 102, Section L, Subsection L.7.II, Volume II – Technical Proposal, Section 5 – Factor 5
– Past Performance, remove the last sentence from the tenth paragraph and replace with:
“If the Offeror does not affirmatively state that no relevant past performance history exists, the Offeror’s proposal may be considered Unacceptable for this evaluation factor. Any Offeror that affirmatively states that it has no past performance history will receive a rating of Neutral. “
8. Page 107, Section M, Subsection M.2.II Factors for Evaluation Factor 5 – Past Performance, remove the last sentence and replace with:
“If the Offeror does not affirmatively state that no relevant past performance history exists, the Offeror’s proposal may be considered Unacceptable for this evaluation factor. Any Offeror that affirmatively states that it has no past performance history will receive a rating of Neutral. “
9. Page 106, Section M, M.2.II Factors for Evaluation, Factor 3 – Staffing, Subfactor 2 – is revised to read as follows:
“The purpose of this subfactor is to assess the Offeror’s staffing plan (proposed skill mix and team composition, as well as the Offeror’s ability to meet staffing and re-staffing requirements).
The staffing plan will include LOE of the Prime Contractor, proposed subcontractors, and individuals for accomplishing the contract requirements. Assessment will also be made of the offeror’s proposed matrix that maps task areas identified in the SOW to specific technical staff, including the person’s name, title, company affiliation, degree(s), professional license(s) or certification(s), years of relevant experience, and planned use for SOW task areas. Additionally, the Offeror’s organizational structure chart (including subcontractors) and lines of communication proposed for the work under this contract will be evaluated.”
10. In Attachment J.2, the Labor Category Qualification for the Program Manager is revised to read as follows:
PROGRAM MANAGER. The program manager shall be responsible for the overall management of tasks performed under this contract and shall be the primary point-of-contact for overall contractual issues. The program manager shall be assigned by the offeror upon award of the contract. He/she shall be responsible for ensuring that practical and effective systems are developed to meet the objectives of the contract. The program manager shall also ensure that quality work is completed on schedule and within the allocated budget. The program manager shall have, as a minimum, the following qualifications:

Air Traffic Engineering and Program Support (ATEPS) Government Responses to Offeror Submitted Questions
Attachment to Amendment 00003
Question Number RFP Part RFP Document Name or Section Page No. Question/Comment and Government Response
1 Part I (Contract)
SECTION 5 –
FACTOR 5 - PAST
PERFORMANCE
“The Offeror must describe in its proposal what types of contracts were excluded and what process was utilized to ensure that the most relevant contracts with the Federal Government over $1,000,000 relevant to the SOW were included.”
We recommend that the Government allocates
0.5 pages, in addition to the 10 pages for past performance citations, for this description.
Government Response: See Item Number 4 of this Amendment.
2 Part I (Contract)
2. Page Limits
Page count:
Please confirm that the “front matter content” – acronym list, compliance roadmap, etc. – be counted against page limits?
Government Response: Any additional information provided that exceeds the RFP stipulated page imitations will not be evaluated.
Part I (Contract)
ATTACHMENT J.2 -
LABOR CATEGORY
QUALIFICATIONS
PROGRAM
MANAGER 114
As the FAA only established the Air Traffic Systems (ATS) organization circa 2011, the solicitation requirement that “a minimum of 10 years of experience must be in Air Traffic Systems” appears overly restrictive.
Based on the relatively new ATS organization, will the Government change the minimum years of experience from 10 to 5 years?
Government Response: See Item Number 10 of this Amendment.
4 Part I (Contract)
ATTACHMENT J.2 -
LABOR CATEGORY
QUALIFICATIONS
PROGRAM
MANAGER
The requirement that the proposed Program Manager’s undergraduate degree be in “engineering or a related technical field” eliminates numerous otherwise qualified candidates. This is especially true for individuals who began their careers as air traffic controllers, many of whom have undergraduate degrees in fields other than technical fields.
Based on the restrictive degree requirements, is the Government willing to accept the current degree requirement along with a Bachelor’s degree from an accredited institution? Further, based on the intensive project and program ATEPS requirements, we recommend that an MBA be able to be substituted for Bachelor’s-level degree requirements.
Government Response: See Item Number 10 of this Amendment.
5 Part I (Contract)
L.7.II; Section 5 – Factor 5 – Past Performance
In Section L on page 101in the SOW the solicitation reads:
“The list must include those applicable contracts reflecting the involvement of the proposed Task Order Program Manager and/or Department Managers.”
The Task Order Program Manager/Department Manager is NOT listed as part of the 24 resumes that are needed to be provided in Section 3 – Factor 3 – Staffing, Subfactor 1 – Staff Resumes.
What is a Task Order Program Manager and Department Manager? These are new terms not identified in the SOW.
Government Response: See Item Number 6 of this Amendment.
6 Part I
Section L, Factor 3, Subfactor 2 Section M, Factor 3, Subfactor 2
On page 100 under Subfactor 2, the RFP states “the Offeror must include a matrix that maps functions identified in SOW to specific technical staff….” However, on page 106 under Subfactor 2, the RFP states “…including the Offeror’s organizational chart mapping functions identified in the SOW to specific management staff”.
Please confirm that these two references (i.e., one to “technical staff” and the other to “management”) are the same as the 24 resumed individuals.
Government Response: See Item Number 9 of this Amendment.
7 Part I (Contract)
Section M, Factor 3, Subfactor 2
Will the Government please confirm that functions identified in the SOW referenced in Sections L and M refer to the seven technical areas as follows: Program Management;
Financial Management; Standards and Rulemaking; Systems Engineering; Operations Support; Field Engineering and System Implementation; Flight Test, Data Collection, and Performance Monitoring?
Government Response: The term “functions” in Sections L and M refers to the ability to perform successfully in all Seven SOW Task Areas.
8 Part I
Section L, Factor 3, Subfactor 2 Section M, Factor 3, Subfactor 2
The Offeror must include a matrix that maps functions identified in the SOW to specific technical staff, including the person’s name, title, company affiliation, degree(s), professional license(s) or certification(s), years of relevant experience, and planned use for SOW task areas
The staffing plan will include LOE of the Prime Contractor, proposed subcontractors, and individuals for accomplishing the contract requirements, including the Offeror’s organizational chart mapping functions identified in the SOW to specific management staff.
Would the Government please confirm that it is specifying a matrix to map functions in the SOW to specific technical staff, rather than the organizational chart mentioned in Section M?
Government Response: See Item Number 9 of this Amendment.
9 Part I (Contract)
L.6.11 – Section 3
Please confirm that in accordance with FAR 52.244-2, which is the clause that is referenced in L.6.11 Section 3 under Subcontract Consent, that as long as an offeror has an certified purchasing system, consent is not required and therefore offerors do not need to provide the information listed in FAR 52.244-2(e)(1)
Government Response: See Item Number 3 of this Amendment.
10 Part I (Contract)
L.6.11 – Section 3
Under the Conflict of Interest Disclosure Statement it says “offerors shall submit a conflict of interest disclosure statement as described in Section H.2”.
Please confirm that it should state “…as described in Section H.3”
Government Response: See Item Number 5 of this Amendment.
11 Part I
E.2 (3)
The RFP states “Inspection and acceptance of supplies/services for task orders shall be based on the Quality Assurance Surveillance Plan (QASP) included as Attachment J.11”
Please confirm that it should state “…included as Attachment J.4”
Government Response: See Item Number 1 of this Amendment.
12 Part I (Contract)
F.4 (1)(c)
The RFP states that the monthly progress reports will need to include the prime’s success in meeting the Subcontracting Plan goals.
We respectfully request the requirement to report on subcontracting plan goals be removed as that information is not tracked at the TO level since the Small Business Subcontracting Plan covers the entire ID/IQ and since this information is provided bi-annually through the ESRS.
Government Response: FAR Clause 52.219-9 (d)(10)(ii) requires that offerors will “submit periodic reports so that the Government can determine the extent of compliance by the offeror with the subcontracting plan”. The language remains unchanged.
13 Part I (Contract)
L.6.11 – Section 2
It appears that part f is missing. The RFP currently goes from part e (Labor Escalation) to part g (Indirect Rates).
Please clarify.
Government Response: Part f was omitted in error. No change is being made.
14 Part I
L.6.II
If an offeror with a certified purchasing system intends to include Independent Contractors (ICs)/sole proprietors on their team, will the ICs/sole proprietors be burdened with the responsibility to provide a detailed cost build-up/sealed package? Or will the offeror’s cost/price reasonableness justification suffice?
Please clarify what is required to be submitted by an IC or sole proprietor.
Government Response: If a subcontractor is being proposed on a time and material basis, the subcontractor must either provide cost build-up (by cost element) or the commerciality of the billing rates. Refer to page 92 of the RFP for guidance.
Additionally, offerors must also provide a detailed analysis as required in page 96 under Section 3 – Business Proposal – Subcontract Consent.
15 Part I (Contract)
F. 13
This section states that Program Manager be available to the Government via phone, VTC, or email.
Question: Request VTC be removed and Skype, FaceTime, or Lync be inserted.
Government Response: See Item Number 2 of this Amendment.
16 Part I
L.7.II (1) –
Subcontracting Plan
States “Offerors are advised that Subcontracting Plan will be “evaluated” under the new USDOT partnership with the Small Business Administration on subcontracting program reviews.
Question: Please provide evaluation criteria.
Government Response: The language refers to SBA’s Subcontracting Program Compliance Reviews which are performed during contract performance.
17 Part I (Contract)
Section L, Factor 3, Subfactor 2 – Staffing Plan and Organizational Chart
Sec L states: “The Offeror must include a matrix that maps functions identified in the SOW to specific technical staff.”
Considering the page constraints in the Staffing section, please confirm that the government wishes to map only the 24 resumed individuals identified on page 99 under Section L- SECTION
3 – FACTOR 3 – STAFFING
/ SUBFACTOR 1 – STAFF RESUMES.
Government Response: The mapping refers only to the resumed staff.

Section M.2, FACTOR 5 - CONTRACT PAST PERFORMANCE states “If the Offeror does not affirmatively state that no relevant past performance history exists, the Offeror’s proposal may be considered Unacceptable for this evaluation factor.” This is inconsistent with the preceding paragraphs that describe how past performance will be evaluated and what constitutes relevant past performance. We respectfully recommend clarifying to state “In the case where an Offeror has no relevant past performance history, the Offeror will receive a neutral rating, but the Offeror must affirmatively state that no relevant past performance history exists. If such an Offeror fails to affirmatively state that no relevant past performance history exists, the Offeror’s proposal may be considered Unacceptable for this evaluation factor.”
Government Response: See Item Numbers 7 and 8 of this Amendment.
19 Part I (Contract)
Section 3, Factor 3, Staffing, Subfactor 2
The Offeror’s resume submission must be accompanied by a commitment/resume validity letter for all proposed resumes. At a minimum, the resume must include a statement regarding the veracity of the information provided in the resume by the individual, with signature and date. The letter must include commitment from the individual to perform the work (as required) for the duration of the base period of performance, as established in the SOW. Each letter must be individually signed and dated by the proposed person.
Question: Would the government please confirm the signed commitment/resume validity letters are excluded from page count?
Government Response: The resume validity letter does not count towards the 6 page limitation for staffing since it’s considered part of the resume.
