3. Section C, Part II, paragraph C.2.A TRANSITION (CLIN 0001), insert the following sentence after the fourth sentence under the “Job Order Financial Information System Demonstration” deliverable:

“The hardware environment (e.g., space on a server) and software licenses that are necessary to implement and operate the JOFIS in the Volpe Center environment will be provided by the Government.”

4. Section F, Part II, paragraph F.4, DELIVERABLE AND REPORTING REQUIREMENTS – TASK

ORDER 1, the title of Deliverable No. 2, “Job Order Financial Information System” is changed to “Job Order Financial Information System Demonstration”.

Q1: Regarding RFP paragraph L.5.B.1, Section 7 – Contract Past Performance, our federal government customers have only recently adopted the utilization of CPARS / PPIRS as a performance reporting tool and only for those contracts valued at more than $5M for services. Since, our federal government customers are new to CPARS, they have not yet been registered and trained on how to use it. Therefore, can our federal government customers use the Past Performance Questionnaire released as part of Section J, Part III, attachment J.5, Amendment A0003?

A1. In accordance with FAR Subpart 42.1502, subparagraphs b and c, federal government agencies are required to prepare an evaluation of contractor performance for each contract and order that exceeds the simplified acquisition threshold ($150K). Far Subpart 42.1503, subparagraph c states that “agencies must submit past performance reports electronically to the Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov” and the process for submitting such reports to PPIRS “shall be in accordance with agency procedures.” In accordance with L.5.B.1 – Section 7, Contract Past Performance, the Offeror is responsible for making all reasonable efforts to ensure that performance evaluation reports are entered in PPIRS by the appropriate contracting activity's responding official by no later than the due date for receipt of proposals.

Please refer to Amendment No. A0004, Items 5 and 6, which make changes to the solicitation instructions provided in Section L, paragraph L.5.B.1, Section 7 – Contract Past Performance. If a federal government agency has not completed a performance evaluation report in PPIRS as required by FAR Subpart 42.1503 and is unable to do so by the due date for receipt of proposals, the Volpe Center will accept a performance evaluation report that was completed by the agency even if it was not entered in PPIRS. If a federal government agency has not completed a performance evaluation report in PPIRS or in another format utilized by the agency, the agency may use the Past Performance Questionnaire for Non-Federal References included as Section J, Part III, Attachment J.5. If the agency utilizes the Past Performance Questionnaire for Non-Federal References or a format other than PPIRS to provide past performance information for the purpose of this solicitation, the Contracting Officer who provides the performance evaluation report must affirmatively state in writing on the questionnaire/report that a PPIRS record does not exist for the particular contract/order for which past performance information is being provided. Performance evaluation reports that are not prepared in PPIRS must be emailed directly to the Volpe Center Contracting Officer (Alison.Fecht@dot.gov) by the organization providing the past performance information.

Q2. Reference: Amendment A0003, Attachment 2. Page 1 of 3, Q1/A1 and Amendment A0003, item 34.

Many of our clients do not use the PPIRS system in conducting past performance evaluations. As directed, we are requesting that they complete the forms in PPIRS as required under FAR 42.1502 and 1503. We have attempted to obtain a questionnaire from the PPIRS/CPARS website so that we can send it with our request but can’t find a way to download one. In Amendment A0003Atachemnet 4, you provided a past performance questionnaire for non-federal references. Could you provide a similar document for Federal references that we can provide to our clients who are unfamiliar with/do not use the system. If not, is it acceptable for Federal clients to use the non–federal form? Will DOT accept a reference that has not been posted through CPARS and is available from PPIRS?

A2. Federal government agencies are required to submit past performance reports electronically to PPIRS. The Volpe Center does not intend to provide a separate past performance questionnaire for federal government references. Please refer to Amendment No. A0004, Items 5 and 6, which make changes to the solicitation instructions provided in Section L, paragraph L.5.B.1, Section 7 – Contract Past Performance. If a federal government agency has not completed a performance evaluation report in PPIRS as required by FAR Subpart 42.1503 and is unable to do so by the due date for receipt of proposals, the Volpe Center will accept a performance evaluation report that was completed by the agency even if it was not http://www.ppirs.gov/ mailto:Alison.Fecht@dot.gov entered in PPIRS. If a federal government agency has not completed a performance evaluation report in PPIRS or in another format utilized by the agency, the agency may use the Past Performance Questionnaire for Non-Federal References included as Section J, Part III, Attachment J.5. Please refer to the response to Question 1 for further information.

In accordance with FAR subpart 42.1503, the process for submitting past performance reports to PPIRS shall be “in accordance with agency procedures”. Accordingly, the Volpe Center will accept a past performance evaluation report that is available in PPIRS that has not been posted through CPARs.

Q.3 Amendment 0003 modified Solicitation Section K which is to be submitted as part of the contractor proposal. Will there be an updated solicitation with amendments incorporated, or should each Offeror modify the original solicitation in accordance with the amendments? If Offerors are required to make the changes, will there be an MS Word version released?

A3. The changes to Section K were minor, consisting of the deletion of two FAR provisions and the renumbering of the two remaining paragraphs. The Offeror may submit the original version of Section K in its proposal with FAR provision 52.204-8, ANNUAL REPRESENTATIONS AND CERTIFICATIONS completed. The Offeror may elect to make the changes to Section K resulting from Amendment A0003 manually, but there is no requirement to do so.

A Microsoft Word version of the solicitation, with changes incorporated as a result of Amendment A0004, is provided as Attachment 2 to this amendment. This document is provided for informational purposes only. The original solicitation document and amendments thereto serve as the official solicitation of record for this requirement.

Q4. Section C, Part II, paragraph C.2.A, TRANSITION, identifies the Job Order Financial Information System (JOFIS) as a Deliverable under the firm fixed price CLIN 0001. Is the JOFIS a deliverable to the government with title passing to the government at the conclusion of Transition? If so, it appears the JOFIS will be made available to the contractor for its use during the performance of CLINs 0002 and 0003. Or, will the JOFIS remain contractor property for the contractor's use during performance of CLINs 0002 and 0003? Which party owns the rights to the asset at the conclusion of CLIN 0002 and CLIN 0003 performance? Will the government provide the hardware and necessary software licenses to implement and operate the JOFIS in the Volpe Center environment, or must the contractor provide the necessary hardware and software licenses as well as the database structures, applications to run reports, etc.?

A4. The Job Order Financial Information System (JOFIS) deliverable under CORA Task Order 1, CLIN 0001 is the implementation and demonstration of the JOFIS to the Government The Government will not take ownership of the JOFIS at the conclusion of CORA Task Order 1, CLIN 0001. The Contractor will retain ownership of the JOFIS for use during the performance of CLINs 0002 and 0003 and will own the rights to the JOFIS at the conclusion of the task order. The Contractor’s JOFIS must contain (and therefore the Contractor must provide) the database structures and applications necessary to perform the functions described in Section C, Part II, paragraph C.2.A. The hardware environment (e.g., space on a server) and software licenses that are necessary to implement and operate the JOFIS in the Volpe Center environment will be provided by the Government.
